Dear Mr. Fisher:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
waiver.
The above-referenced property does not meet the requirements as set forth in the
aforementioned Code, paragraph (e), because sidewalks will be installed on Main
Street as part of this development and on the east side of Abbey Lake Road as
part of another development. Therefore, I cannot grant a temporary waiver of the
sidewalk installation requirement on the above-referenced property and your
request is denied.

REASON FOR REQUEST Abbey Lake Road is scheduled to become the Landmark Drive extension
and a widening will be involved. This walk would have to be torn up for thesp improvpmpnts.
Section~8.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of

Sidewalk Waiver: Abbey Lake Road

We have reviewed the request for a sidewalk waiver on Abbey Lake Road at the rear of the
lots in the Oak Ridge Estates Subdivision. The sidewalk would run from Main Street
northward on the west side of Abbey Lake Road. Sidewalks will be installed on Main
Street as part of this development and on the east side of Abbey Lake Road as part of
another development. This location does not meet the criteria for a waiver.
