Dear Mr. Turner:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
waiver.
Since sidewalk exists along the Myrtle Avenue frontage but none exists along
Metto Street or Jurgens Street, the installation of a side~alk along Metto
Street would be beneficial to pedestrians by butting up to existing sidewalk
along Myrtle Avenue. Therefore, a waiver for this portion of the above-
referenced property is denied.
However, since the installation of a sidewalk along Jurgens Street would be of
little benefit since there would be a 160-foot section of missing sidewalk east
of Myrtle Avenue, a temporary waiver of the sidewalk requirement is granted for
the Jurgens Street frontage only of the above-referenced property. Should it be.
determined that a sidewalk is required at this location in the future, it will
be installed by the assessment process.

The subject property is located on the northeast corner of N. Myrtl e Avenue
and Metto Street, with the Lot 2 portion of the property fronting on Jurgens
Street.
We have reviewed the sidewalk waiver request and found that sidewalk exists
along the Myrtle Avenue frontage, but none exists along Metto Street or
Jurgens Street. The installation of sidewalk along Metto Street would be
beneficial to pedestrians by butting up to existing sidewalk along Myrtle
Avenue. It has been our policy to not grant a waiver in these cases.
The installation of sidewalk along Jurgens, however, would be of little
benefit since there would be a 160 ft. section of missing sidewalk east of
Myrtle Avenue.
It is my recommendation that a sidewalk waiver be granted for the Jurgens
Street frontage only.

Section~8.09 of the Code or Ordinances of the City requires that all land
that abuts a pub~ic ,right-of-way, which is to have new construction on it,
either for residential, commercial" industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.
