The above-cited property does not meet the requirements as set forth in the aforementioned Code, Paragraph (e), because the absence of a sidewalk would create a pedestrian hazard by reason of the proximity of the property to motor vehicle traffic. This location technically meets the conditions described in the ordinance for granting of a waiver. However, the property to the north of this location is undeveloped and as development takes place the oppor- tunity will exist to provide a continuous sidewalk from the Ken Marks Ford site to Enterprise Road. A project to the south, the Jennifer Office Complex, was granted a waiver for sidewalks. This should be recalled if sidewalks are installed at Ken Marks Ford. There have been approximately three pedestrian fatalities over the past two years within a few hundred feet of this site. Although the victims were attempting to cross US 19 rather than to walk along it, the statistics indicate that there is a potential pedestrian hazard if the sidewalks in this area are not provided.
