Dear Mr. Currie:
In accordance with Section 133.09 of the Code of Ordinances of the City
of Clearwater, I have reviewed your request for temporary sidewalk
installation waiver.
The above-cited property does not meet the requirements as set forth
in the aforementioned Code, Paragraph (e), because the absence of a
sidewalk would create a pedestrian hazard by reason of the proximity
of the property to motor vehicle traffic. Therefore, I cannot grant
a temporary waiver of the sidewalk installation requirement on the
above-cited property and your request is denied.

I have reviewed the Ken Marks Ford request for a sidewalk waiver
in front of their new facility on U.S. 19. This location
technically meets the conditions described in the ordinance for
granting of a waiver. However, the property to the north of this
location is undeveloped and as development takes place the oppor-
tunity will exist to provide a continuous sidewalk from the
Ken Marks Ford site to Enterprise Road. A project to the south,
the Jennifer Office Complex, was granted a waiver for sidewalks.
This should be recalled if sidewalks are installed at Ken Marks
Ford.
There have been approximately three pedestrian fatalities over
the past two years within a few hundred feet of this site.
Although the victims were attempting to cross US 19 rather than
to walk along it, the statistics indicate that there is a
potential pedestrian hazard if the sidewalks in this area are
not provided.
It is my recommendation that sidewalks be requir~.

REASON FOR REQUEST 1. There are no sidewalks on either side of US 19 in this area.
2. There lS no place to put a sidewalk, since a large drainage
ditch abuts the property line.
Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the OWner on, across or adjacent thereto.
The OWner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.
