TERMINA TION OF AGREEMENT
TIllS TERMJNA TlON OF AGREEMENT is made and entered into this ;2,,~ day of
<)1~D -f 1993, by the CITY OF CLEAR WATER, a Municipal Corporation, hereinafter referred to
as "City"
WITNESSETH:
WHEREAS, Wal-Mart Stores, Jnc, now owns the real propeny described in the attached
Exhibit "A" and made a part hereof by reference (the "Propeny'~); and
WHEREAS, on October 27, 1982, the City and William G. Blackburn and Gloria J.
Blackburn, the previous owners of the Propeny, entered into an Agreement, recorded at O.R.
Book 5211, Page 160, Public Records of Pinellas County; which Agreement was modified by that
Agreement dated February 25, 1982 and recorded in O.R. Book 5323, Page 1864, Public Records
of Pinellas County; and which Agreements were partially released by Partial Release recorded in
o.R. Book 5382, Page 1377, Public Records of Pinellas County (collectively, the "Agreements");
and
WHEREAS, the Agreements provided that the City would provide water and sewer service
to the Propeny provided that the Propeny would be annexed into the City and that the previous
owners would pay a connection fee; and
WHEREAS, the City agrees that all the terms of the Agreements have been met, and that
the Agreements should be tenninated.
NOW TI-IEREFORE, the City does hereby acknowledge that all the terms of the
Agreements have been met 4Uld does declare the Agreements terminated.
