RECORDS MANAGEMENT AND COMPUTER AIDED DISPATCH PROGRAMS MEMORANDUM OF UNDERSTANDINGRECORDS MANAGEMENT AND COMPUTER AIDED DISPATCH PROGRAMS MEMORANDUM OF UNDERSTANDING Between C(OPY THE PINELLAS COUNTY SHERIFF'S OFFICE And THE CLEARWATER POLICE DEPARTMENT This Memorandum of Understanding (MOU) is entered into by and between the Pinellas County Sheriff s Office (PCSO) and the City of Clearwater Police Department (CPD). ARTICLE 1. THE PROJECT The PCSO will provide a records platform to the CPD for sharing automated records and computer aided dispatch systems in order to maximize data resource sharing„ increase efficiency, eliminate redundant records systems and the associated fiscal impact. ARTICLE II. TERM The term of this MOU shall be from August 1, 2009 through July 31, 2010, with an option to renew for an additional twelve (12) months by mutual agreement of the parties. ARTICLE III. OBLIGATIONS OF THE PARTIES The PCSO shall operate a law enforcement records system (ACISS) on a computer hardware system and provide a point of network connectivity for the CPD. The PCSO is responsible for maintaining the records management computer system, including all required software licenses, upgrades, updates and system administration. The PCSO is also responsible for maintaining the records management software (ACISS), including all necessary software licenses, upgrades, updates and system administration. The CPD and the PCSO shall share the expense for the leased network connectivity between the records management server and the CPD. The CPD will provide a microwave communication link to the PCSO public safety campus at 10750 Ulmerton Road, Largo, Florida. As the network technology continues to evolve, typically with improved throughput and reduced cost, either network connection may be substituted upon agreement by both parties. The network described herein shall provide connectivity for the records management system and the computer-aided dispatch system. Both CPD and the PCSO have independently purchased the rights to a computer-aided dispatch application, TriTech Software Systems. Each agency independently purchased the systems hardware and software and each agency is responsible for maintenance, upgrades and updates of the respective systems. CPD and PCSO shall share all computer-aided dispatch information real time, with minimum delay, so the benefits of a shared system will be maximized and officer safety enhanced. The PCSO will offer to CPD access to software applications that have been developed by the Sheriff's Office Computer Services staff. Initially, PCSO will provide all software relating to the ticket-writer program, the document imaging program and the gps-avl (automatic vehicle locator) program. Other in-house programs will be shared as the software is developed. Modifications and enhancements to the software will be entertained on a case-by-case basis dependent on the statement of work and the availability of staff to accomplish the desired outcomes. Each party will continue to be the custodian of the data, information and reports entered and developed by each. As a result, any public records request received for CPD records will be the responsibility of CPD and be referred to CPD for response should the PCSO receive the request. Likewise, any public records request for PCSO records will be the responsibility of the PCSO and should be referred to the PCSO should CPD receive the request. ARTICLE IV. TERMINATION Either party may terminate this Agreement thirty (30) days after receipt by the other party of written notice of intent to terminate. Should either party decide to terminate the Agreement, all records and data generated by and belonging to each party shall be returned to the party to whom the data belongs. The parties agree to work together cooperatively to ensure a return of data in as timely a manner as possible. ARTICLE V. OTHER CONDITIONS Any alterations, variations, modifications, or waivers of provisions of this Agreement shall only be valid when they have been reduced in writing, duly signed, and attached to the original of this Agreement. The parties agree to renegotiate this Agreement if revisions of any applicable laws or regulations make changes in this Agreement necessary.
