PENSION ADVISORY COMMITTEE MEETING MINUTES
CITY OF CLEARWATER

The Chair called the meeting to order at 9:00 a.m. at City Hall.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.
2 - Approval of Minutes
Member Doran moved to approve the minutes of the regular Pension Advisory
Committee meeting of January 8, 2009, as submitted in written summation to each board
member. The motion was duly seconded and carried unanimously.
3 – Employees to be Heard – None.
4 – Action Items:
a. Review and Action on Employee Requests for Regular Pensions:
1. Alan Whitacre, Police
2. Wayne Andrews, Police
3. Vernon Packer, Development & Neighborhood Services
4. James Ennis, Fire
5. Craig S. Cramer, Fire
Member Jensen moved to approve the requests for regular pensions for Alan Whitacre,
Wayne Andrews, Vernon Packer, James Ennis, and Craig S. Cramer. The motion was duly
seconded and carried unanimously.

b. Review and Action on Employee Requests to Vest Pensions:
1. Thomas Sewell, Gas
Thomas Sewell, Gas, has resigned his position after being employed by the City for
more than 10 years. He will qualify to receive his reduced pension beginning September 1,
2011.
Member Jensen moved to recommend approval of the request by Thomas Sewell to
vest his pension. The motion was duly seconded and carried unanimously.
c. Approval of New Hires as Plan Members:

The motion was duly seconded and carried unanimously.
5 – Pending/New Business
a. Hearing date re status of Thomas Stubblefield’s Disability Pension
Human Resources Director Joe Roseto requested continuing Thomas Stubblefield’s
Disability Pension hearing to March 12, 2009. Mr. Stubblefield’s IME (Independent Medical
Exam) was postponed from February 11 to February 23, 2009 and may not be processed in
time for the March meeting. The Pension Attorney had recommended scheduling an IME to
provide Mr. Stubblefield due process and a hearing; the ordinance does not require these
measures.
Discussion ensued regarding concerns that the IME had been postponed while Mr.
Stubblefield continues to collect disability pension payments that he may not be eligible to
receive. It was recommended that staff communicate to Mr. Stubblefield and his attorney that
the PAC (Pension Advisory Committee) would hear this case on April 9, 2008, at the latest,
unless dire circumstances occur.
Mr. Roseto said if the PAC rules that Mr. Stubblefield is not eligible to receive a disability
pension, staff will determine the date of disqualification and how best to recoup overpayment.
Member Doran moved to continue Item 5a to March 12, 2009. The motion was duly
seconded and carried unanimously.
