All activities to be performed on the "Property" under this Right of Entry shall be limited to activities required to meet environmental due diligence associated with an environmental site assessment required by Chapter 62-770, F.A.C. 2. All assessment activities to be performed under this Right of Entry will be approved by the City of Clearwater Environmental Group prior to commencement. A description of activities to be performed, including diagrams and locations of proposed work efforts on the "Property", shall be provided to the "Owner" prior to commencement. 3. A minimum of 48 hours notice shall be given to the "Property Owner" prior to the initiation of any subsurface monitoring or testing activities, or the installation or removal of any monitor wells or equipment. 4. An attempt shall be made by "Contractor" to conduct assessment activities in a manner that will not interfere with daily operations on the "Property", 5, "Contractor" shall conduct its activities in a manner so as to minimize damage to existing site conditions. Any disturbance to existing conditions will be repaired, and if found to be unacceptable to the "Property Owner" shall be corrected to the satisfaction of the "Property Owner" within 3 working days, Contractor shall be responsible for repairs to any utilities damaged due to activities conducted at the "Property". 6. "Contractor" shall observe any and all applicable local, state and federal safety, health and environmental regulations, 7, Results of any analytical data from within the "Property" limits shall be provided to the City of Clearwater Environmental Programs Coordinator, Karma Killian, for review prior to submittal to regulatory agencies. The "Property Owner" may contact the Contractor at any time for access to the data, 8. Any waste materials, soil cuttings, hazardous materials or contaminants resulting from activities conducted under this Right of Entry shall be the sole property of the "Contractor". Any materials which must be transported and disposed of, will be securely stored off of City property until transportation and disposal can be arranged in accordance with all applicable local, state and federal laws, regulations and ordinances. Copies of all waste disposal manifests resulting from assessment activities on the "Property" shall be made available to the "Property Owner" for review, if requested, 9, All tools, equipment, wells or other property of the Contractor or its representatives shall be removed within a reasonable time. Any monitor wells installed by the Contractor on City property shall be properly abandoned in accordance with rules established by the Southwest Florida Water Management District Chapter 400-3. 10, The Contractor shall provide written notice of project completion to the "Property Owner" within 30 days of completion. RIGHT OF ENTRY AGREEMENT RE: See Attached Property Appraiser Records (2) 1) Value Environmental Services, Inc., its employees, agents and designees, are hereby granted the right and privilege of entry, ingress and egress over and across the above described properties located at 115 S. MLK and NW corner of MLK and Pierce St for the purpose of conducting soil and/or groundwater assessment activities to meet Chapter 62-770, F.A.C. requirements for a groundwater site assessment. The horizontal extent of the dissolved petroleum hydrocarbons cannot be determined by the existing on-site well network, so wells are required at most readily- accessible points to the north, west, and northwest of the AAMCO Transmission property. The ROW is full of utilities and fiber optic cable. thus making it too risky to install the wells in the ROW. 2) In consideration of the rights granted herein, Value Environmental Services, Inc., its employees, agents or designees, agree that all persons entering the property by virtue of the rights herein granted shall do so at their own risk. The "Property Owner" accepts no liability whatsoever for any claims for injury or damages in connection with this Right of Entry, 3) Value Environmental Services, Inc. agrees that it shall provide evidence of insurance prior to commencement. Value Environmental Services, Inc. further agrees that its employees, agents or designees shall not engage in any activities that could result in any mechanics liens being filed against the property. 4) Value Environmental Services, Inc. agree to hold the City of Clearwater harmless from any and all claims for injury and all liability for property damages arising during, and in connection with all activities undertaken by Value Environmental Services, Inc., its employees, agents or designees pursuant to privileges granted herein; provided, however, that in no event or under any circumstances shall the "Property Owner" incur any financial liability that would exceed statutory limits as set forth in Section 768.28, Florida Statutes. Greenwood Ave. Clearwater, Pinellas County FDEP Facility ID# 528630822 Dear Mr. Balow: The Environmental Engineering Division of the Pinellas County Health Department (PCHD) has reviewed the Groundwater Sampling Report (GSR) dated May 3, 2004 (received May 3, 2004), prepared and submitted by Value Environmental Services, Inc, (VES), for the discharge dated December 16, 1997, at the above referenced facility, The GSR does not meet the requirements of the contamination assessment requested in PCHD's November 7, 2003 letter nor of Rule 62-770.600, Florida Administrative Code (F.AC.).A Supplemental Site Assessment (SSA) is required. The report implies that adjacent properties are also sources of co-mingling groundwater contamination, but provides no substantiation data. In accordance with Chapter 62-770, F,A,C., the extent of the groundwater contamination must be assessed (even if the contamination extends beyond the originating property). In addition, the soil assessment has not been completed in accordance with Chapter 62-770, F ,AC. No soil analyses have been conducted on soil samples collected from above the water table, The extent of soil contamination to the south of the source area remains undefined. Please complete the contamination assessment in accordance with applicable regulations and submit the results in a Site Assessment Report Addendum to this office within 60 days of the date of this letter.
