THIS AGREEMENT made and entered into this ~ -- ~. , 1981, by and between the CITY OF CLEARWATER, FLORIDA and VAN L. McNEEL. day of WIT N E SSE T H : WHEREAS, Van L. McNeel intends to develop a tract of real property originally encompassing 26.4 acres more or less (hereinafter "property") into a residential development entitled "Coachman Road Condominiums"; and WHEREAS, the City of Clearwater desires Van L. McNeel to proceed with development in accordance with the laws, regula- tions, and procedures of the City of Clearwater; and WHEREAS, the laws of the City of Clearwater require, under Record Plats and Subdivisions, Chapter 20, Ordinance Number l449, a dedication of land up to ten percent (lO%) of the gross acreage of said plat, or monetary value in lieu thereof; and WHEREAS, ten percent (lO%) of the land or monetary value in lieu thereof is equal to approximately 2.64 acres; and WHEREAS, the Record Plats and Subdivision Ordinance applies to developments such as the proposed "Coachman Road Condominiums", NOW THEREFORE, in consideration of the sum of Ten and nO/lOO Dollars ($lO.OO) and other good and valuable consideration passing by and between the parties hereto, the receipt, suf- ficiency and adequacy of which is hereby acknowledged, the parties hereto agree as follows: 1. Van L. McNeel shall deed to the City of Clearwater land as described in the attached legal description, Exhibit "A", for right-of-way purposes. 2. Van L. R. 5 2 4 5 PA GET 6 1 1 all of his right, title and interest in the approximate 6.73 acre parcel upon which a lake is situated, as described in the attached legal description, Exhibit "B". 3. Van L. McNeel shall deed to the City of Clearwater approximately l.78 acres of land as described in the attached legal description, Exhibit "C", for park land purposes. 4. Van L. McNeel shall convey to the City of Clearwater Eight Thousand Six Hundred Eighty-Five and no/lOO Dollars ($8,685.00) in cash. 5. The City of Clearwater agrees to provide Van L. McNeel with sewage treatment at the Northeast Pollution Control Facility for forty-eight (48) units upon completion of the Alligator Creek Pumping Station and Force Main. The City of Clearwater agrees, that in the event the above Alligator Creek Pumping Station and Force Main is not operational at the time Certificates of Occupancy are to be issued for the Coachman Road Condominiums, to permit Van L. McNeel to collect sewage at an appropriate manhole within the development and transport the sewage via tank trucks to a location within the City of Clearwater designated by the City. The procedure for pumping and transporting sewage via tank trucks shall be subject to the approval of the City Manager of the City of Clearwater, which approval shall not be unreasonably withheld. Transportation of sewage will continue until the Alligator Creek Pumping Station and Force Main are placed in operation. Van L. McNeel agrees to v/ post a bond or nonrevocable Letter of Credit in favor of the City of Clearwater to guaranty an amount equal to the cost of transportation of sewage for a period of one (l) year. Cost estimate for said transportation shall be prepared by Van L. McNeel's engineer who shall submit it to the City of Clearwater and shall include allowances for expected flow volume increases Page 2 " J I O. R. 52 4 5 PA.GE 1 6 ? "- and ten percent (10%) factor for inflation. In the event Van L. McNeel fails to follow the procedure for pumping and transporting sewage as aforesaid, and d")es not remedy his breach within ten (10) days of written notice from the City of Clearwater to Van L. McNeel, the City shall be entitled to reimbursement from the surety for all of its damages, if any. Said written notice shall be made by certified mail, return receipt requested, and addressed to Van L. McNeel, c/o Michael L. Hastings, Esquire, P. O. Box 41100, St. Petersburg, Florida, 33743. 6. The City of Clearwater agrees that the public will be prohibited from using power boats on the lake. 7. The City of Clearwater agrees to maintain and preserve the lake described in Exhibit liB". Van L. McNeel agrees to maintain and preserve wetland areas owned by Van L. McNeel, to the north of the park land described in Exhibit "0'. 8. Van L. McNeel shall have vested rights in the zoning so as to construct a maximum of two hundred forty (240) multi- family residential dwellings on property, provided that Van L. McNeel submits the intial documentation to seek and obtain a building permit or permits within twelve (12) months of the date the City of Clearwater no longer has a moratorium in effect for the East Sewage Treatment Plant area. 9. Van L. McNeel's performance of the conditions imposed up')n him hereunder shall be in full and complete satisfaction of the City's Parkland dedication requirements, such requirements shall be fulfilled before the first building permit is is sued. 10. ' ~ . adjoins McNeel's land and which is twenty (20) feet from the shore line. ll. Van L. McNeel agrees to maintain the fishing dock and pier shown on the approved site plan and for whatever period of time the dock and pier exists, Van L. McNeel agrees to assume the defense of and save the City of Clearwater harmless on any and all claims for personal injury or property damage that may arise by reason of the use or occupation of such dock and pier. Conditions of this Agreement are binding and are trans- ferable to any other person, group, organization, or corporation.
