THIS GENERAL UTTLTTY EASEMENT, made this � day of (��'l d�� 20 d0,
by and between THE CITY OF CLEARWATER, FLORIDA, whose address is 10� South Myrtle
Avenue, Clearwater, Florida, 33756, hereinafter referred to as "Grantee" and PINELLAS COLTNTY,
Attention: Department of Real Estate Management, Real Property Division, whase address is 509
East Avenue South, Clearwater, Florida, 33756, a political subdivision of the State of Florida,
heareinafter referred to as "Grantor."
WITNESSETH:
THAT THE GRANTOR, far and in consideration of One Dollar ($1.00) and ather good and
valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, bargain, sell
and convey to Grantee, its successors and assigns, and enter inta a permanent General Utility
Easement over, under and upon that portion of that certain property which is owned by Grantor,
located in Pinellas County, �'lorida, to wit:
Lands described in legal description attached as Exhibit "A" hereto
and made a part hereof, her�inafter referred to as the "Easement."
TO HAVE AND TO HOLD said Easement unto said Grantee forever, subject to th�
following conditions:
1. The grant of this Easement may restrict the right of the Grantor in the use of the
Easement area to the extent that na structures or trees shall be allaw�d on the Easement axea.
2. The rights herein granted to the Grantee by the Grantor specifically include: (a) the
right to install, inspect, rnaintain, and repair all current and future City af Clearwater utilities under,
over and upon the Easement; (b) the right for the Grantee to clear the Easement of trees, limbs,
undergrowth, and ather physical objects which may endanger or interfere with the safe and efficient

installatioz�, operation or maintenance of the utility systerns, and (c) the reasonable right with
reasonable notification, for the Grantee to have ingress and egress across the Grantor's property to the
Easement.
3. The grant of this Easement may allow the Grantar quiet enjoyment of the Easement to
the extent that such use daes not inter%re with rights gratrted herein.
4. Except �ox those acts reasonably necessary to accamplish the purposes oi this
Easement, Grantee also cavenants not to do any acts or things, which it could reasonably expect to
cause damage to Grantor's premises. With respect to any person not a party ta this Easement, this
paragraph should not be construed as a waiver of any defense or limitation available to the Grantee
or Grantor pursuant to Florida Statutes, Section 768.28, as now in effect or as may be amended from
time to time.
