In accordance with Section 133.0~ of the Code of Ordinances of the City of Clear-
water, I have reviewed your request for a temporary sidewalk installation waiver.
Since there are no sidewalks within 200 feet of the above-referenced property,
you meet the requirements as set forth in the aforementioned Code Section.
Therefore, I am pleased to inform you that a temporary waiver of the sidewalk
installation requirement is granted on tne aoove-referenced property. Should
it oe determined that a sidewalk is required at this location in tne future,
it will be installed oy the assessment process.

Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

Dear Mr. Leach:
I realize that the matter of City sidewalk requirements in the Oak
Creek at Countryside subdivision has been up in the air for quite
some time. At the City Commission meeting held February 17, 1983,
I received a concensus from the Commission to approve future sidewalk
waiver requests for new construction in the Oak Creek at Countryside
subdivision.
Tnese waivers cannot be issued unless the proper request is made
through the Building Inspection Department. I am sending a copy of
this letter to Roger Rolfe, the current president of the subject
property owners' association and trust that this information will be
disseminated to the appropriate people.
