BE [T ORDAINED BY THE C1TY COMMISSI�N OF THE ClTY OF CLEARWATER, FLORIDA: Section 'i . Article IX, Section 32.380, Code nf Ordinanc�s, is amended #o read: Sec. 32.380. Availability charge. The utility account of any impro�ed property adjacent to a sufficiently sized reclaime� water distribu#ion main shall include a monthly availability charge to alieviate the capital outfay o# extending access�bilify to the reclaimed water system. �Ees#-a#-##e . See aQpendix A for availabiCitv_rates. Upan application for and connec#ion to the rec�aimea wat�r system, the availability charge shall cease. Pro�erties with existinq irriqation wells shall not be charged for availability as lonq as the irriqation well remains active. _The burden of proof is on the ro e owner to veri t�at an irri ation wel! is active and the director shall make the finai determir�a#ion.
