AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, APPROVING A CONCEPT PLAN AND
AMENDING THE ZONING ATLAS OF THE CITY BY
ZONING CERTAIN REAL PROPERTY LOCATED ON THE
EASTERLY RIGHT-OF-WAY LINE OF U.S. 19 NORTH AND
NORTH OF ALLEN CREEK, CONSISTING OF METES AND
BOUNDS 22101 IN SECTION 29, TOWNSHIP 29 SOUTH,
RANGE 16 EAST, AND METES AND BOUNDS 33107 IN
SECTION 20, TOWNSHIP 29 SOUTH, RANGE 16 EAST,
UPON ANNEXATION INTO THE CITY OF CLEARWATER,
AS MASTER PLANNED DEVELOPMENT (MPD), SUBJECT
TO CERTAIN CONDITIONS; PROVIDING AN EFFECTIVE
DATE.

WHEREAS, the City Commission has reviewed a concept plan for the proposed project in
accordance with Section 40.261, Code of Ordinances, and finds it sufficient; and
WHEREAS, the assignment of a zoning district classification as set forth in this ordinance
is found to be reasonable, proper and appropriate, and is consistent with the City's comprehensive
plan; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The attached Concept Plan for the proposed project is hereby approved. The
following described properly located in Pinellas County, Florida, is hereby zoned as indicated
upon annexation into the City of Clearwater, and the zoning atlas of the City is amended, as
follows:

Master Planned Development (MPD)
As part of the MPD concept plan approval, the Applicant shall provide, subject to approval by
the Engineering Division, engineered plans to upgrade the City's Sanitary Sewer Lift Station
No. 5 to adequately serve the proposed development. Such lift station improvements shall be
completed prior to the issuance of the first certificate of occupancy for the development with all
such improvements being made solely at the property owner's expense.
Section 2. The Central Permitting Director is directed to revise the zoning atlas of the City
in accordance with the foregoing amendment.

Section 3; This ordinance shall take effect immediately upon adoption, contingent upon
and subject to the adoption of Ordinance No. 6284-98, the approval of the land use designation
by the Pinellas County Board of County Commissioners, and subject to a determination by the
State of Florida, as appropriate, of compliance with the applicable requirements of the Local
Government Comprehensive Planning and Land Development Regulation Act, pursuant to
§ 163,3189, Florida Statutes. The Director of Planning and Development is authorized to
transmit to the Pinellas County Planning Council an application to amend the Countywide Plan
in order to achieve consistency with the Future Land Use Plan Element of the City's
Comprehensive Plan as amended by this ordinance.
