BLOCK 1, R. H. PADGETT 70TAL SUBDIVISION, SUBJECT TO A DRAINAGE AND UTILITY EASEMENT WHICH IS RETAINED OVER THE FULL WIDTH THEREOF ; PROVIDING AN EFFECTIVE DATE. WHEREAS, Betty Jones and Joyce Silver along with St. Matthew's First Missionary Baptist Church, Inc., owners of the real property located in the City of Clearwater, have requested that the City vacate the right-of-way described in Exhibit A attached hereto; and WHEREAS, the City Commission finds that said right-of-way is not necessary for municipal use and it is deemed to be to the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORL)AINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: 30.0 foot Right-of-Way of Alden Avenue lying between Lots I through 4, Block 2, and Lots 5 & 6, Block 1, R. H. Padgett Subdivision, as recorded in Plat Book 1, Page 13 of the public records of Pinellas County, Florida, subject to being retained full width as a drainage and utility easement. is hereby vacated, closed and released, and the City of Clearwater quitclaims and releases all of its right, title and interest thereto, except that the City of Clearwater hereby retains a drainage and utility easement over the full width of the described property for the installation and maintenance of any and all public utilities thereon. This vacation ordinance is conditional upon the legal transfer of title from the owners stated herein to Morton Plant Hospital Association, Inc. Failure to transfer title within ninety (90) days from adoption shall render this vacation ordinance null and void. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
