AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE
LAND DEVELOPMENT CODE; AMENDING SECTIONS 135.086 AND 135.092, CODE
OF ORDINANCES, ALLOWING ART GALLERIES/STUDIOS AS A CONDITIONAL USE
IN LIMITED OFFICE AND GENERAL OFFICE ZONING DISTRICTS; AMENDING
SECTIONS 135.104, 135.110, 135.116, 135.122, 135.128, 135.134, AND
135.141, CODE OF ORDINANCES, ALLOWING ART GALLERIES/STUDIOS AS A
PERMITTED USE IN THE BEACH COMMERCIAL, RESORT COMMERCIAL "TWENTY-
FOUR," RESORT COMMERCIAL "TWENTY-EIGHT," GENERAL COMMERCIAL, HIGHWAY
COMMERCIAL, COMMERCIAL CENTER AND URBAN CENTER DISTRICTS; AMENDING
SECTION 136.025, CODE OF ORDINANCES, TO ESTABLISH SUPPLEMENTARY
CONDITIONAL USE STANDARDS FOR ART GALLERIES/STUDIOS; AMENDING
SECTION 137.005, CODE OF ORDINANCES, TO DEFINE "ART GALLERY/STUDIO;"
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Subsection (11) is added to Section 135.086, Code of
Ordinances, to read:
Sec. 135.086. Conditional uses.
Within Limited Office Districts, the following uses may be allowed as
conditional uses:
(1 Veterinary Offices.
(2 Level I group care.
(3 Level II group care.
(4) Level III group care.
(5) Congregate care.
(6) Nursing homes.
(7) Child day care.
(8) Commercial or trade schools.
(9) Noncommercial parking.
(10 Residential shelters.
11 Art galleries/studios.
Section 2. Subsection (6) is added to Section 135.092, Code of Ordinances,
as amended by Ordinance 5101-91, to read:
Sec. 135.092. Conditional uses.
Within General Office Districts, the following uses may be allowed as
conditional uses:
(1) Veterinary Offices.
(2) Nursing homes.
(3) Child day care.
(4) Commercial or trade schools.
(5) Noncommercial parking.

Section 3. Subsection (10) is added to Section 135,104, Code of
Ordinances, as amended by Ordinance 5088-91, to read:
Sec. 135.104. Permitted Uses.
Within Beach Commercial Districts, only the following uses (and structures
designed for such uses) shall be permitted:
(1) Indoor retail sales,
(2) Personal services.
(3 Restaurants.
(4 Indoor commercial recreation/entertainment.
5 Business/professional offices.
(6 Accessory dwellings.

(8) Interval ownership and timeshare dwellings.
(9) Remote switching stations.
(10) Accessory uses.

Section 5. Subsection (12) is added to Section 135.116, Code of
Ordinances, as amended by Ordinance5088-91, to read:
Sec. 135.116. Permitted Uses.
Within Resort Commercial "Twenty-eight" Districts, only the following uses
(and structures designed for such uses) shall be permitted:
1) Hotel/motels.
2 Convention centers.
3 Indoor retail sales.
(4) Personal services.
(5) Restaurants.

structures designed for such uses) shall be permitted:

2 Restaurants.
3 Business/professional offices.
4 Medical clinics/laboratories.
5 Business services.
6 Personal services.
7) Indoor commercial recreation/entertainment.
8 Nonprofit social or community services.
9 Commercial or trade schools.
10 Gasoline stations.
11 Hotels/motels.
12 Accessory dwellings.
13) Interval ownership and timeshare dwellings.
14) Remote switching stations.
15 Accessory uses.

Ordinances, to read:

Within Highway Commercial Districts, only the following uses (and
structures designed for such uses) shall be permitted:

Section 8. Subsection (9) is added to Section 135.134, Code of
Ordinances, to read:
Sec. 135.134. Permitted Uses.
Within Commercial Center Districts, only the following uses (and structures
designed for such uses) shall be permitted:
(1) Indoor retail sales.
(2} Restaurants.
3} Personal services.
4 Indoor commercial recreation/entertainment.
5) Business/professional offices.
(6) Medical clinics/laboratories.
(7) Television and radio broadcast studios, provided that external
equipment or facilities not ordinarily appurtenant to office usage, including but
} not limited to antennas and satellite dishes, shall be prohibited within the
district.

Section 10. Paragraph (3.1) is added to Subsection (c) of Section 136.025,
Code of Ordinances, to read:
136.025. Conditional use standards.
(c) Supplementary standards by category of use. The following standards
(which apply to the identified category of use) shall supplement the general
standards of use identified above and no conditional use shall be authorized
unless determined to meet all of the standards applicable thereto.

Section 11. Subsection (a) of Section 137.005, Code of Ordinances, is
amended to read:
Sec. 137.005. Definitions.
(a) Words and terms used in this development code shall be given the
meanings identified hereinafter:
Art oallerv/studio: Room or building occupied by a business,excludin
business licensed as a home occupation, and devoted primarily to the exhib
of works of art, the sale of works of art on exhibition, or the work place
