ORDINANCE NO. 5159-91
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE 10-FOOT DRAINAGE AND UTILITY EASEMENT LYING
ALONG THE EASTERLY AND SOUTHERLY BOUNDARIES OF A PARCEL
OF LAND LOCATED IN SECTION 21, TOWNSHIP 29 SOUTH, RANGE
15 EAST, HAVING A STREET ADDRESS OF 1569 SOUTH FORT
HARRISON AVENUE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by Fairwinds Properties, Inc., owner of
certain real property located in the City of Clearwater, that the City vacate the
drainage and utility easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The East 10 feet and the South 10 feet of the following described
tract:
Begin at the Northwest corner of the Southeast 1/4 of the Southeast
1/4 of Section 21, Township 29 South, Range 15 East, and run thence
South 89°11'25" East along the fractional section line, 373.57 feet;
thence South 00°08'42" West, 453 feet for a POINT OF BEGINNING;' from
the POINT OF BEGINNING thus established, run thence South 00°08'42"
West, 60 feet; thence South 70°56'42" West, 115.72 feet more or
less, to the Easterly boundary line of South Fort Harrison Avenue
(Alternate U. S. 19); thence North 32°36'18" West along said
boundary line, 95.84 feet; thence South 89°11'25" East, 165.92 feet
more or less to the POINT OF BEGINNING,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
