PROPOSED ENACTMENT; AND PROVIDING FOR THE i EFFECTIVE DATE OF THIS ORDINANCE. , WHEREAS, on September 1, 1977, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the zoning ordinance of the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the proposed changes and amendments to the zoning ordinance were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. (c) Phased Development-Separate Projects. Elements of phased developments under approved master site plan or elements of contract agreements relating to annexations shall be treated as separate projects under this section. (d) Waivers--When a Previously Submitted CIS Remains Effective. All or part of a CIS may be waived by the City Manager if a CIS has been approved by the Resource Development Committee within the previous six (6) months in connection with the annexation and zoning or. rezoning of the identical property for which a building permit is being requested. Such waiver shall not be granted, however, if the requested land use is different from that addressed in the original submittal. (e) Waivers--When there is a Reduction in Use Intensity. In the case of rezonings which are less intensive in nature than the existing zone, the CIS may be waived by the City Manager. Such decision shall require a written record showing lack of need based upon evidence of a previous zone impact assessment comparison. CIS may be I'. required by the City Manager for projects where appraised land value and development and construction costs are expected to be less than $500 000 Such instances may include but are not limited to the following: (i) Where the site is in art of or may otherwise impact an environmental) sensitive area ILA R # n -. F f mi , (f) Element Waivers-'-When an Approved Master CIS Remains Effective, Developments with an approved Master CIS covering the overall development of the project may have elements of the CIS waived for subsequent geographical areas within their development. (g) Public Projects. Requirements of this section shall be applicable to all projects whether the applicant is a public, non-profit or private party. (2) QUALIFICATIONS, RESPONSIBILITIES AND PERFORMANCE OBLIGATIONS. The Community Impact Statements shall be prepared by qualified professional in each field to be addressed and must indicate the name of the firm or individuals responsible for the research and preparation of the Statements and any supporting material. The Community Impact Statement shall indicate the firm or individual who will assume responsibility for ensuring that the statements, obligations, and provisions undertaken in the Community Impact Statement are fulfilled. The Community Impact Statement shall include a signed statement from the firm or person assuming responsibility for compliance with the provisions and performance obligations of the Community Impact Statement. Community Impact Statements shall, as a minimum, address the effects and impacts the proposed development will have on public service facilities, the natural environment, and all other areas that affect the health, safety, general welfare, and quality of life in the City of Clearwater. Specific, areas to be addressed and subjects within each area may vary with the type and extent of the proposed development but will generally conform to the following: (a) Legal Description. A metes and bounds, plat or other legal description of the property including, but not limited to; (1) Reference to the appropriate Plat Book and page of the Public Records of Pinellas County and recitation of names of owners of record. (2) Reference to surveys and other documents pertaining to excluded parcels or parcels identified for future inclusion. (3) Reference to existing rights-of-way, easements, and any requirements foreseen for future dedication of additional rights-of-way as identified in the City or County Land Use Plan or the Official Major Thoroughfare Plan. (4) Current land assessment. (5) For contract purchase, provide details of contract. (6) A recitation of all covenants, both existing and proposed, to run with the land. (b) Location and Aces a, A narrative description of the general shape of the tract, its size in acres, its location with respect to bordering roads and natural features, and a statement of commonly used means and routes of access. A location map is a requirement of this item. (c) Special Flood Hazard Areas. A statement as to whether or not the tract lies within an identified "Special Flood Hazard Area. " For tracts so located, the following information is also required: (1) Zone Identification. The zone identification (A, AO, Al through A30, V, VO, or V1 through V30) of the tract as extracted from the Flood Hazard Boundary Map available in the office of the City Engineer. (2) Variances. Intentions, if any, to request variances from the provisions and requirements of Sections 7-9 and 7-10 of the Code of ordinances and if variances are to be requested, their nature and extent. (3) Compliance. Data indicating compliance with Federal requirements for the mandatory purchase of flood insurance under the Flood Disaster Protection Act of 1973 (Public Law 93-234) to include source of insurance, type and extent of coverage, effective date and other pertinent data, (d) Flood Control, A brief description of the tract with respect to such matters as relief, flood hazards, existing outfalle and canals, natural and artifical water courses on or abutting the property, any prior ground or surface water studies, and site drainage problems which have existed, which now exist, or are forecast. An acceptable plan for ponding or other disposition of surface runoff is an essential portion of this section, as is an indication of the relationship between site drainage under full development and drainage as shown in the Clearwater Master Drainage Plan. A topographic survey and preliminary drainage map are requirements of this item. (e) Land Uses and Zoning. (1) Current On-Site. A statement listing all current uses and zoning of the tract. (2) Adjacent. A brief description of surrounding land uses (and known planned uses and zoning) adjacent to the tract. Statements as to the age of existing structures, recent sale prices or valuation in area, evidence of neighborhood pride or the lack thereof, and the status of vegetation are appropriate. Provide land assessment data for adjacent parcels. (3) Site Plan. A site plan for the proposed land use along with a current aerial photograph of a minimum scale of 1:100 ( l inch to 100 feet) are requirements of this item. Information relative to existing and proposed water mains and trunklines and their capacities, and comprehensive data as to forecast requirements for potable water, water for landscape prinkling, and intentions, if any, to drill shallow or deep wells in partial or total satisfaction of water requirements., (f) Demographics. Studies or knowledgeable estimates of the number of persons to occupy the developinant, by phase, and suitable breakdowns of the totals by age and economic status are required. Data as to the mix and total number of school age.children is especially important. Location of schools receiving additional enrollment should be documented with information as to whether, transportation will be furnished by the school system. If students will be required to walk to ' a school facility, need for future sidewalk construction along route should be documented. (g) Transportation. (1) Traffic and Parking. An extensive description of proposed means of compliance with Traffic, Parking and Parking Lot Beautification Ordinances, as well as a discussion of pedestrian and vehicular traffic circulation both within and adjacent to the development, methods of parking proposed, parking surface material, and projected traffic counts (average and peak). The vehicular traffic impact on public facilities elsewhere shall be discussed. All parking pro- posals and discussions will consider storm water runoff, existing tree preservation (as canopy and screen) and erosion prevention. Worksheets showing trip generation rates, reference source used to determine the rate, directional flow, and other computations are to be submitted separately to the Traffic Engineering Department for analysis. (2) Traffic Control. A complete rundown of the traffic control and traffic safety equipment needed as a result of the proposed project, inclusive of increased traffic flow in the immediate area to public services, such as the beach and library. Data furnished must address both, internal and external measures and must list by type, quantity and location all requirements for street lighting, traffic control signs and signals, and street name signs. (3)Mass Transit. A brief summary of existing mass transit service, if any, to the area of proposed development, to include locations of bus stops and weather shelters. Also, a projection of required increases to all of the above as a result of development. (h) Utilities. (1) Sanitary Sewers. Any and all information available as to the proximity of sewer lines, the practicality of tying into existing sewer lines, the quantity of sewage and quality expected to be generated, the treatment facility proposed to handle the sewage and any other information deemed material to the issue at hand. am'.? i.?itSy ??La?YK a'rR•.` ., k -5- # 1.725 . Information relative to existing and proposed gas mains and trunklines, their capacities, and other pertinent information on gas consumption. (4) Refuse Collection. A statement pertaining to the extent of dumpster service or curbside pickups that will be required and utilized. Also, any anticipated special pickup requirements. (i) Public Services. (j) Housing. An analysis of the effect the proposed development would have on the availability of housing for persons already residing in Clearwater, expecially those of low and moderate incomes. Developers of housing should estimate the extent of which residents of their development will be drawn from outside the City. The proposed price/rent range of housing should be stated. Developers of non-residential properties should indicate the extent to which their project might attract new residents who would increase the demand for housing in the City. If a rezoning or plan change is requested, the net dwelling unit impact of the change in use should be calculated. (1) Library, A brief summary of the impact the proposed development would have on Clearwater's library facilities in terms of patronage, library personnel, requirements for new or expanded facilities and any other library impacts /requirements anticipated as a result of the contemplated development, including traffic flow. (2) Health Services. A discussion of additional community health services and facilities required as a result of the proposed development. Data should be quantitative and include the number of doctors, nurses, hospital beds and nursing home beds and, on large scale projects, should be time phased. (3) Dedication of Park Sites (Annexations Only). A statement of response which satisfies the Clearwater requirement for dedication of ten per cent (1076) of annexed land for parks or recreational purposes or, if acceptable to the City, monetary contributions for park acquisitions or recreational purposes in lieu thereof. All applicants shall discuss anticipated usage of municipal and county recreation and park facilities arising from the proposed project. (4) Fire Prevention, An indication of compliance with all building and fire prevention codes, submission of data relative to accessibility of the site by fire fighting equip- ment, location of fire hydrants, and topographical or other constraints to fire fighting, and probable increases in fire service staff and equipment needs. (5) Police and Fire Protection. A short statement of anticipated requirements for police or fire services or general increased personnel and equipment on duty functions funded by the City of Clearwater and off duty reimbursable functions. -6- " 1,/3/77 ' ? es .. A general discussion of the move significant architectural and aesthetic characteristics of the proposed development to include overall character of design, height, bulk, open space, or similar items, together with like data pertaining to structures on adjoining parcels and an analysis of the compatibility, or lack thereof, between the existing and the proposed structure are a requirement of this item along with reasonable assurance that the style and layout will not be altered significantly. ee }} i , Try (2) View Interference. A brief statement as to the impact the proposed structures might have with regard to obstructing or degrading traditional view to and through property. (3) Shadow Effect. A discussion of any and all effects the proposed development would have in the way of restricting or altering benefits currently enjoyed by occupants of adjacent properties with regard to the free flow of air and the direct exposure to sunlight. (4) Energy Conservation. A narrative outline of the efforts that will be made by the development to conserve energy, including use of solar heat, use of absorbent materials, insulation, relating source of heat to point of usage, and planting of wind breaks or other similar conservation activities. (S) Handicapped and Elderly. A narrative outline of the efforts that will be made by the development to accommodate ease of use and convenience of access to facilities for the handicapped and the elderly, including sidewalks, ramps, elevators, doorways, restroom facilities, telephone locations, and parking areas. (1) Natural Environment, (1) Soils. A mapping of the individually identified soils according to the Soil Survey of Pinellas County, Florida (U. S. Department of Agriculture, Soil Conservation Service, in cooperation with University of Florida Agricultural Experiment Stations) that presently exists on the tract and an analysis of the impacts or constraints to development associated with these soils, including bearing capacity, flood hazard, corrosiveness, depth to seasonal high water, or other similar factors is a requirement of this item. Any proposed soil removals or fills, whether from on or off site. An overlay of the proposed development over the soils map is also a requirement of this item. (2) Vegetation. A detailed mapping and accounting of all individually identifiable vegetation community types found on the tract. A qualitative and economic assessment of all vegetative resources, especially trees, and any plant species known to be rare, endangered, threatened, of special concern, or unique to the area. A detailed statement as to the impacts of the proposed development on the . tract's vegetation, including all proposed removals and subsequent landscaping activities. An assessment of the wildlife resources on the tract, emphasizing any species that are considered by the U. S. Fish and Wildlife Service or the Florida Game and Fresh Water Fish Commission to be rare, endangered, threatened, of special concern, or unique to the area. All impacts of the proposed development upon the wildlife resources, their habitat, and any breeding areas that may, be found to exist, either seasonally or permanently, on the tract. (4) Water Quality. A general assessment of the existing water quality of all creeks, streams, and ditches and all surface bodies of water. All impacts upon the natural environment resulting from the flood control or drainage activities identified in item (d) Flood Control. All impacts upon surface water quality resulting from surface runoff, erosion and sedimentation, vegetation removal, grade changes, well drilling, or any other known activity which may cause a degradation of water quality. An assessment of all impacts anticipated upstream and downstream from the tract with respect to water quality. An assessment of all existing or anticipated problems with exotic and noxious aquatic vegetation. Any potential point or non-point sources of pollution other than normal residential fertilizing and pesticide usage. All drainage and other surface water management impacts must relate to the adopted City policies in the conservation element of the City's comprehensive Plan. (5) Ecology. An assessment relating the four previous environmental items to the physical features of the site and each other on a systems basis. All biotic and physical factors associated with the defined ecosystems and all impacts of the proposed development upon these ecosystems will be fully addressed. (6) Air and Noise Quality. A statement of overall site activity which will generate, create, cause, or sustain air or noise pollution to include differentiation and identification of point sources or complex sources, both during construction and after construction is completed. NOTE: All items under "Natural Environment" must be prepared by professionals from life sciences, earth sciences or land resource management fields and must conform to the clarification sheets provided by the Planning Department. (m) Archeological/Historical Significance. A narrative outline concerning early human cultures (if any) which may have occupied the site together with data as to artifacts which have already been uncovered at or near the site and knowledgeable estimates of the degree to which development of the site would inhibit or eliminate the possibility of significant archeological finds. A narrative outline 13,m of the efforts made by the development to improve the cultural or aesthetic appearance of the community, including art work, mosaics, sculpture or other art forms for the public use and enjoyment. f.,k'?1Y V (o) Financial. (I) Market Analysis. This item shall indicate the financial feasibility of the proposed development. The applicant should consider both existing demand factors of the .. • ,. ,. ,,?? resident market and projected changes in market size to the build-out period. !. ?!::'Y:.Yy ??kt (Z) Economic Impact. The local economic impact of a project shall be estimated for both the construction phase and the proposed project's ultimate use. The impact of construction shall show both number of skilled and unskilled workers needed, the length of time they will be employed, and the total wages to be paid. The post-construction impact shall be estimated by the labor force required for non-residential construction or the jobs required to support the occupants of new housing construction. (3) Tax Effect. A logical interpretation and evaluation of the extent to which the proposed development will add to (or detract from) the tax base of the City of Clearwater, (4) Financial Interest. A statement as to the total estimated project value, the party or parties financially involved, including corporate identity, principal officers, major (over 576) stockholders, and all financial arrangements made or contemplated to include: a. The identity of the lending institution furnishing mortgage money or, if more than one institution is involved, the identities of each and the dollar amounts being furnished by each. b. An indication of parcel break-out from total tract per future sale or separate financing, if any. C. Types and quantities of insurance to be carried together with information as to the company or companies underwriting insurance. (p) Construction Scheduling. The Community Impact Statement shall set forth reasonably accurate construction completion schedules for the proposed project. (q) Non-Local Coordination. An indication of non-local coordination requirements already effected and a status listing on those yet remaining. A CIS pre-application conference with the Planning Department staff is a requirement of this section. (b) Resource Development Committee. In accordance with an Administrative Directive of September 17, 1973, the "Resource Development Committee (RDC)" was established for the purpose of reviewing development activities and determining potential environmental impacts on the resources of the City. The RDC reviews the impact statement for completeness of data presented, adequacy of assessment, reasonableness of conclusions and attempts to mitigate adverse impact. Such committee, as appointed, and by record hereby is the essential coordinative element that effectively applies this section's requirement to public and private development projects. Any appeals from an RDC determination shall be directed to the City Commission. (c) CIS Processing. The CIS is received and distributed by the Planning Department. The Planning Department will inform the applicant of the number of copies required for the CIS texts and complete site and development plans according to the magnitude or intensity of the proposed development. Reports received are distributed to the members of the RDC for review and comment. Comments are discussed at a meeting called by the chairman at which time any unresolved problems are discussed. Within five days after this meeting the applicant is informed of such problem areas in order that he may respond with additions or' corrections or confer with the committee which then develops a coordinated staff report which summarizes the position of the committee. Such report is submitted by the City Manager to the City Commission for consideration approving or rejecting the application for development. Contents of this report are transmitted to the applicant ten days prior to the City Commission meeting. (5) NONCOMPLIANCE, Failure to comply with the statement of performance contained in the Community Impact Statements as approved by the City officials shall constitute a violation of this ordinance per each act of noncompliance. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Each day that a violation is permitted to exist shall constitute a separate offense. Section S. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166. 041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabove set out. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
