WHEREAS, on April 7, 1977, the City Commission of the City of
Clearwater, after proper public notice, held public hearing on certain proposed
changes to the zoning ordinance of the City of Clearwater in accordance with
procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. Appendix A, Zoning, 'of the Code of Ordinances of the
City of Clearwater, Florida, 1962, is hereby amended by establishing a new
Article XVI, CTF-24, Commercial-Tourist Facilities Use District, to read
as follows:

ARTICLE XVI, CTF-24--COMMERCIAL- TOURIST
FACILITIES USE DISTRICT
Section 16, 01. General description.

This district provides for the complete range of motel-hotel
developments. The major emphasis of the district is tourist
oriented with a permitted maximum density of 24 dwelling units
per acre or 36 hotel or motel units. No new CTF-24 Commercial-
Tourist Facilities Use District may be created which contains
less than four (4) acres.
Section 16. 02. Permitted uses and structures.
In the CTF-24 Commercial-Tourist Facilities Use District
no premises or buildings shall be used or occupied and no
buildings shall be hereafter erected or structurally altered,
unless otherwise provided in this ordinance, except for one
or more of the following uses:
(1) Combination hotel, motel, apartment and business
buildings, subject to the following limitations- In any
hotel, motel or apartment building containing sixteen
or more units (guest rooms), business usages catering
to guests and not general public shall be permitted
within said building under the main roof thereof to the
extent of not to exceed thirty per cent (3070) of the
ground space occupied by the structure.
(2) Apartment houses, dormitory, lodging (rooming)
houses, boarding houses.
(3) Townhouse development as regulated in Section 30, 05.
(4) Accessory buildings, including recreational buildings
and/or community meeting buildings designed as an
integral part of multi-unit development service.
(5) Restaurants.

(7) Churches in accordance with Section 30. 11.

Section 16.031. Prohibited uses.
The following uses are prohibited in the CTF-24 Commercial-
Tourist Facilities Use District:
(1) Heliports and helistops. This prohibition shall not apply
to helicopters engaged in performing emergency or law
enforcement activities.
Section 16. 04. Area and dimension regulations.
(I) Waterfront lots as regulated in Section 30. 07.;-
(2) Minimum lot or parcel area--15, 000 square feet.
(3)Minimum lot width at building setback line--150 feet.
(4) Minimum ground floor area per structure--1, 000 square feet.
(5) Minimum building setback from lot line:
(a) Front or aide street--20 feet from property line or
50 feet from centerline of right-of-way whichever
is greater.
(b) Side and rear--15 feet; for buildings greater than 20
feet in height, the rear and side setback of 10 feet
shall be increased by I foot for each 4 feet of total
height.
(6) Swimming pool or enclosure setback: Front: 15 feet;
side--8 feet; rear--8 feet.

(7) Maximum lot coverage--407o of gross lot area.
(8) Maximum height--30 feet or three starieA unless 7576 of
the grade floor is used for parking and the building is
greater than 100 feet from single family, duplex or triplex
zone. This grade level parking option may permit a bonus
of 1 story or an increase in height to 40 feet.
(9) Maximum net density; dwelling units per acre--24
apartments; 36 hotel-motel units.
(10) Minimum usable open space--15% gross lot area.
(11) Minimum enclosed floor area in square feet per dwelling
area:
(a) Hotel-motel room--300 square feet per unit.
(b) Efficiency apartment--300 square feet per unit.
(c) 1 bedroom apartment--425 square feet per unit.
(d) 2 bedroom apartment--550 square feet per unit.
(e) Each bedroom over 2 must have 100 square feet
additional area.

The following uses arc prohibited in the CTF-28 High Density
Commercial-Tourist Facilities Use District:
Section 17. 04. Area and dimension regulations.
(8) Maximum height--80 feet, provided the lot is greater than
200 feet in average depth. (Said depth to be measured from
the street frontage to the rear of the lot, or in the case of
a lot bounded an 3 or more sides by streets, it shall be
measured between the two closest streets. ) Should average
lot depth be less than 200 feet, then height restrictions as
set forth in CTF-24, Section 16.04 (8) shall apply.

Section 3. Article XVIII, RPD--Residential Planned Development;
CPD--Commercial Planned Development; MPD--Manufacturing Planned
Development, of Appendix A, Zoning, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended by amending Section 18. 06 (2),
Section 18. 07 (2) and Section 18. 08 (2) to road as follows:
Section 18. 06. Processing of the plan; prezoning, predevelopment
stage.
(2) Such plan intent shall become effective and operative
upon final approval by the city commission for planned unit
development zoning. The city commission, upon grunting
RPD, CPD or MPD or combination type zoning, shall at
that same public hearing determine any further; public
hearing or public meeting requirements involving the final
plan adoption, or subplan adoption, if considered as
independent units, or shall assign in lieu thereof, responsi-
bility for administrative review of the final plan, or sub-
plans, before official acceptance by the city commission at a
public meeting. Such assignment action by the city commission
at the prezoning public hearing eliminates an advertised
public hearing on the final plan and thus overrules such
procedure set out in section 18.07 (3). The above public
hearing requirement determination may be based upon the
following criteria (but; not limited thereto),

(d) The nature and effect of the development upon existing
and future utility extensions or city services.
(e) The extent or effect of the proposed development upon
and the concern of abutting property ownership (such
as architectural renderings, fences, buffering hedges,
recreational facilities, etc. )
Section 18.07. Final plan approval procedure.
(2) Within 60 days after holding an advertised public hearing,
the planning and zoning board shall make recommendations
and submit its decision based upon the following considerations,
but shall not be limited thereto:
(a) Intensity of land use pattern of adjoining area.
(b) Compatibility of development as to physiography,
intensity of land use, structure heights and arrangements
of structures within the plan as it is related to adjoining
area, FHA land use intensity ratings will be used as a guide.
(c) Design and adequacy of circulation, parking and services
provided.
(d) Total development as it conforms to the comprehensive
land use and major street plan of the city.
(e) Compliance with waterfront lots as regulated in
a ection 30.07.
Section 18. 08. The execution of plan or subplan; development;
major changes.
(2) All major changes in the plan or subplan shall be processed
in a manner similar to that utilized in processing the first
final plan approval; with all recommendations required to be
made available to the City Commission at its advertised public
hearing. in determining whether or not a major plan change
has occurred, the City Manager shall consider and base his
decision on the following;
(a) Reports from City departments that have examined the plan.
(b) A change in the intensity of use at a location., i. e. , SF
to multiple on a corner or entrance or interior.
(c) The change of the density of an area, block or design
element. Still remains the same density overall but
rearranged or distributed as to cause new relationships
to services.
(d) Redistribution of architectural structures, including
recreational buildings and service structures.
(e) Change of entrance or exit road locations or number,
affecting use of community collectors or arteries
outside the tract.
(f) Change in design to affect mixture of public, private or
service traffic within the tract or (especially) that on the
periphery of the tract.
(g) Change in order of subplan completion, based upon
agreement with City, i. e., a commercial portion to be
completed before a residential portion, or by a residential
portion to be completed before'a community building or
recreation area as planned.

(h) Setback changes affecting views or common open space
usage, is e., location of enclosed patios into original
spacing between buildings; new location or addition of
community swimming pool.
(i) Parking lot changes decreasing size of lot - thus causing
increases to occur elsewhere.
(j) Change in type of residential structures, is e., many
duplexes becoming Z detached or vice versa, or multi
structures becoming smaller and more numerous.
(k) The following may not be considered major changes:
] . Change of one or two buildings to avoid removal
of trees.
Z. Turning buildings to affect better relationships
to common service areas.
3. Turning service areas or recreational courts to
provide better drainage or access patterns,
4. Fencing requirements added prior to condo owner-
ship transfers to owner occupants.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 5. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 6. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500. 00), or imprisoned in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 7. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with
Chapter 166.041, Florida Statutes.
Section 8. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove sot out.
