ORDINANCE.
WHEREAS, the Federal Insurance Administration is requiring certain
amendments to the City of Clearwater Code of Ordinances in order to meet -the
requirements of the National Flood Insurance Program; and
WHEREAS, these amendments must be made before June 1, 1977,
in order that the City of Clearwater may remain in the National Flood Insurance
Program; and
WHEREAS, an emergency exists within the City of Clearwater in that
these amendments must be made immediately in order to remain eligible for
the National Flood Insurance Program and thereby preserving the health,
safety and welfare of the citizens of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 1_ Section 7-9, Erection of buildings in area designated flood
hazard--Criteria established, and Section 7-10, Erection of buildings in area
designated flood hazard--Application for variance from criteria, of Article I,
In General, of Chapter 7, Buildings, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, are hereby amended to read as follows:
Section 7-9. Erection of buildings in area designated
flood hazard--Building permit requirements
and criteria therefor.
A Building Permit issued by the Director of the City Building
Inspection Department in conformity with the provisions of
this ordinance shall be secured prior to the erection, addition
or alteration of any building, structure or portion thereof
resulting in substantial improvement thereto, or other
development including, but nut limited to the placement of a
mobile home, dredging, filling, grading, paving or clearing of
land lying within areas identified as Zone Al through AS inclusive
or Zone AI V through A4V inclusive on the Flood Hazard Boundary
Map prepared by the Federal Insurance Administration for the
City of Clearwater, Florida.
(1) Application for a Building Permit shall be made, on a form
or forms to be provided by the City, to the Director of the
City Building Inspection Department. The Director shall
have the responsibility for accepting such application and
also shall have the authority to require the following submittals
in addition to the application:
(a) Plans drawn to scale showing the nature, location,
dimensions and elevations of the areas in question;
existing or proposed structures, fill., storage of
materials; and the location of the foregoing, where
applicable, in relation to mean sea level, drainage
facilities, the regulatory flood protection elevation
and any applicable Flood Hazard District.
(b) Required certifications by a registered professional
engineer or architect (relating to the adequacy of
flood proofing methods or anchorage design).
(Z) In determining whether or not to issue a Building Permit,
the Director of the City Building Inspection Department or
his authorized representative, shall examine the application and
all supporting materials submitted to determine the following;
(a) That all necessary permits have been received from those
governmental agencies from which approval is required by
Federal, State, or local regulations, and that the building or
development is in substantial compliance with the Coastal Zone
Management and Conservation Elements of the updated
Comprehensive Plan for the City.
(b) That plans and specifications conform to the criteria
established by the Federal Insurance Administration
for the applicable flood zoning district.
(c) That existing elevations shown on plans are certified
by a registered land surveyor or registered professional
engineer.

(d) That in the case of new construction or substantial
improvements of residential structures within Zones
Al through AS inclusive on the Flood Hazard Boundary
Map have the lowest floor (including basement) elevated
to or above the 100 year flood level as designated by the
Federal Insurance Administration.
(e) That in the case of new construction or substantial
improvements of non-residential structures within
Zones Al through AS inclusive on the Flood Hazard
Boundary Map have the lowest floor (including basement)
elevated to or above the 100 year flood level as designated by
the Federal Insurance Administration; or that the attendant
utility and sanitary facilities be designed so that below the
100 year flood level, the structure is watertight with walls
substantially impermeable to the passage of water, and with
structural components having the capability of resisting
hydrostatic and hydrodynamic loads and effects of buoyancy.
(f) That all subdivision proposals and other proposed iiew
developments greater than 50 lots or 5 acres, whichever
is lesser, include within such proposals the 100 year flood
elevation data.
(g) That all mobile homes to be placed within Zones Al through
AS inclusive on the Flood Hazard Boundary Map shall be
anchored to resist flotation, collapse, or lateral movement
by providing over the top and frame ties to ground anchors
as specified by the Federal Insurance Administration.
(h) That within Zones Al through AS inclusive on the Flood
Hazard Boundary Map, new mobile home parks and
mobile home park subdivisions; or existing mobile home
parks and mobile home park subdivisions that request a
permit to expand their facilities; or to repair, reconstruct
or improve their streets, utilities and pads at a cost equal
to or exceeding 5076 of the value of the streets, utilities
and pads before the repair, reconstruction, or improvement
has commenced:
1. Stands or lots are elevated on compacted. fil).
or on pilings so that the lowest floor of the
mobile home will be at or above the 100 year
flood level as established by the Federal
Insurance Administration.
2. Adequate surface drainage and access for a
hauler are provided.
3. In the instance of elevation on pilings, lots
are large enough to permit steps, piling foundations
are placed in stable soil no more than 10 feet apart,
and reinforcement is provided for pilings more than
6 feet above the ground level.
(i) That all new construction and substantial improvements
with Zoneo AIV through A4V inclusive on the Flood Hazard
Boundary Map are elevated on adequately anchored pilings

or columns and securely anchored to such piles or columns
so that the lowest portion of tha atructural members of the
lowest floor (excluding the pilings or columns) is elevated
to or above the 100 year flood level as established by the
Federal Insurance Administration, and that a registered
professional engineer or orchitact has certified that the
structure is securely, anchored to adequately anchored
pilings or columns in order to withstand velocity waters and
hurricane wave wash. Also that the space below the lowest
floor is free of obstructions or constructed with'Ibreak-
away walls" intended to collapse under stress without
jeopardizing the structural support of the structure so that
the impact on the structure by abnormally high tides or
wind driven water be minimized. Such temporarily,

(3) The following activities are prohibited within those areas
Zoned Al V through A4V inclusive on the Flood Hazard Boundary
Map:
(a) The use of fill for structural support of buildings.
(b) . Man-made alterations of sand dunes and mangrove stands
which would increase potential flood damage.
(c) Placement of mobile homes, except in existing mobile
home parks and mobile home subdivision. (Anchorage
shall conform to (2) (i) above)
(d) New construction seaward of the reach of mean high tide.
(4) Mobile home parks and mobile home subdivisions located
within Zones Al through A5 inclusive on the Flood Hazard
Boundary Map shall file an evacuation plan indicating alternate
vehicular access and escape routes with the local Disaster
Preparedness Authority.
(5) New and replacement water supply systems located within
flood prone areas shall be designed to minimize or eliminate
infiltration of flood waters into the system.
(6) New and replacement sanitary sewer systems located within
flood prone areas shall be designed to minimize or eliminate
infiltration of flood waters into the system and dibcharges from
the system into flood water and on site waste disposal systems
shall be located to avoid impairment to them or contamination
from them, during flooding.
Section 7-10. Erection of buildings in area designated
flood hazard--Procedure for variance and
criteria therefor.
Any person, persona or corporate entity may seek relief from the
regulatory flood elevation for residential and non-residential
" structures or mobile homes identified in Section 7-9 of'this Code
of Ordinances by submitting a written application to the Board of
-Adjuntment and Appeals on Buildings of the City of Clearwater. .

(1) A variance may be granted by the Board if all of the
following criteria are met:
(a) The property on which the structure is to be erected
is an isolated lot of one-half acre or less, contiguous
to and surrounded by existing structures constructed
below such required first floor elevation; or a structure
is listed on the National Register of Historic Places or a
State Inventory of Historic Places to be restored or
reconstructed.
(b) Failure to grant the variance would result in exceptional
hardship to the applicant.
(c) The issuance of the variance would not result in the
increased flood heights, additional threats to public
safety of extraordinary public expense.
(d) The variance allowed is the minimum necessary to
afford relief.
(e) The variance would not have the effect of nullifying
the intent and purposes of the ordinance.
(2) The applicant shall be notified in writing over the signature
of the Director of the Building Inspection Department that:
(a) The issuance of the variance to construct a structure
below the base level will result in increased premium
rates for flood insurance up to amounts as high as $25
to $100 of insurance coverage.
(b) That such construction below the base flood level
increases risk to life and property.
(3) Such notification shall be maintained with a record of
all variance actions, including justification for their
issuance.
(4) A report of such variances shall be reported annually to the
Federal Insurance Administration.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction, to a fine not
to exceed the sum of Five Hundred Dollars ($500. 00), or imprisonment for
not exceeding sixty (60) days, or by both such fine and imprisonment in the
discretion of the Judge,

safety and welfare of the citizens and inhabitants of the City of Clearwater;
that an emergency is hereby declared; and that this ordinance shall be in full
force and effect immediately upon its passage. This ordinance shall automatically
expire ninety (90) days from the date of its passage unless the ordinance is
submitted during such time for consideration as a nonemergency ordinance. ,

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE I, IN GENERAL, OF CHAPTER 7,
BUILDINGS, OF THE CODE OF ORDINANCES OF THE CITY
OF CLEARWATER, FLORIDA, 1962, TO REQUIRE A BUILDING
PERMIT BE ISSUED IN CONFORMITY WITH THIS ORDINANCE
PRIOR TO THE ERECTION, ADDITION OR ALTERATION OF
ANY BUILDING LYING WITHIN CERTAIN AREAS IDENTIFIED
ON THE FLOOD HAZARD BOUNDARY MAP; TO SET FORTH
FORM FOR APPLICATION FOR A BUILDING PERMIT, TO NAME
THE DIRECTOR OF BUILDING INSPECTION DEPARTMENT AS
RESPONSIBLE FOR ACCEPTING APPLICATIONS AND. ISSUING
OR REFUSING TO ISSUE SUCH PERMITS, TO ESTABLISH
CRITERIA TO BE FOLLOWED IN MAKING SUCH DECISION FOR
ISSUANCE, TO ESTABLISH PROHIBITED ACTIVITIES WITHIN
CERTAIN FLOOD HAZARD AREAS; TO ESTABLISH PROCEDURE
FOR VARIANCE BY APPLICATION TO THE BOARD OF ADJUST-
MENT AND APPEALS ON BUIDING, TO SET FORTH CRITERIA
FOR GRANTING A VARIANCE, TO REQUIRE NOTIFICATION IN
WRITING TO THE APPLICANT AS TO THE DECISION, AND TO
REQUIRE A RECORD OF ALL ACTIONS TO BE MAINTAINED
AND REPORTED TO THE FEDERAL INSURANCE ADMINISTRATION
ANNUALLY; PROVIDING FOR REPEAL OF ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING PENALTIES FOR
THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING
THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE
HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF THE
CITY; PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE; AND PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT.
WHEREAS, the Federal Insurance Administration is requiring certain
amendments to the City of Clearwater Code of Ordinances in order to meet the
requirements of the National Flood Insurance Program; and
WHEREAS, these amendments must be made before June 1, 1977,
in order that the City of Clearwater may remain in the National Flood Insurance
Program; and
WHEREAS, an emergency exists within the City of Clearwater in that
these amendments must be made immediately in order to remain eligible for
the National Flood Insurance Program and thereby preserving the health,
safety and welfare of the citizens of the City of Clearwater;

(1) Application for a Building Permit shall be made, on a form
or forms to be provided by the City, to the Director of the
City Building Inspection Department. The Director shall
have the responsibility for accepting such application and
also shall have the authority to require the following submittals
in addition to the application:
(a) Plans drawn to scale showing the nature, location,
dimensions and elevations of the areas in question;
ezi.sting or proposed structures, fill, storage of
materials; and the location of the foregoing, where
applicable, in relation to mean sea level, drainage
facilities, the regulatory flood protection elevation
and any applicable Flood Hazard District.
(b) Required certifications by a registered professional
engineer or architect (relating to the adequacy of
flood proofing methods or anchorage design).
(21) In determining whether or not to issue a Building Permit,
the Director of the City Building Inspection Department or
his authorized representative, shall examine the application, and
all supporting materials submitted to determine the following;
(a) That all necessary permits have been received from those
governmental agencies from which approval is required by
Federal, State, or local -regulations, and that the building or
development is in substantial compliance with the Coastal Zone
Management and Conservation Elements of the updated
Comprehensive Plan for the City.
(b) That plane and specifications conform to the criteria
established by the Federal Insurance Administration
for the applicable flood zoning district.

(g) That all mobile homes to be placed within Zones Al through
AS inclusive on the Flood Hazard Boundary Map shall be
anchored to resist flotation, collapse, or lateral movement
by providing over the top and frame ties to ground anchors
as specified by the Federal Insurance Administrations.
(h) That within Zones Al through AS inclusivo on the Flood
Hazard Boundary Map, new mobile home parks and
mobile home park subdivisions; or existing mobile home
parks and mobile home park subdivisions that request a
permit to expand their facilities; or to repair, reconstruct
or improve their streets, utilities and pads at a cost equal
to or exceeding 50°16 of the value of the streets, utilities
and pads before the repair, reconstruction, or improvement
has commenced;
1. Stands or lots are elevated on compacted fill
or on pilings so that the lowest floor of the
mobile home will be at or above the 100 year
flood level as established by the Federal
Insurance Administration.
2. Adequate surface drainage and access for a
hauler are provided.
3. In the instance of elevations on pilings, lots
are large enough to permit steps, piling foundations
are placed in stable soil no more than 10 feet apart,
and reinforcement is provided for pilings more than
6 feet above the ground level.
That all new construction and substantial impruvements
with Zones A1V through A4V inclusive on the Flood Hazard
Boundary Map are elevated on adequately anchored pilings

(4) Mobile home parks and mobile home subdivisions located
within Zones Al through A5 inclusive on the Flood Hazard
Boundary Map shall file an evacuation plan indicating alternate
vehicular access and escape routes with the local Disaster
Preparedness Authority.
(5) New and replacement water supply systems located within
flood prone areas shall be designed to minimize or -eliminate
infiltration of flood waters into the system.
(6) New and replacement sanitary sewer systems located within
flood prone areas shall be designed to minimize or eliminate
infiltration of flood waters into the system and discharges from
the system into flood water and on site wast•r disposal systems
shall, be located to avoid impairment to them or contamination
from them during flooding.
Section 7-10. Erection of buildings in area designated
flood hazard--Procedure for variance and
criteria therefor.
Any person, persons or corporate entity may seek relief from the
regulatory flood elevation for residential and non-residential -
structures or mobile homes identified in Section 7-9 of this Code
of Ordihances by submitting a written application to the Board of
A.djustr rent and Appeals on Buildings of the City of Clearwater.'

ff.
(1) A variance may be granted by the Board if all of the
following criteria are rnet:
(a) The property on which the structure is to be erected
is an isolated lot of one-half acre or less, contiguous
to and surrounded by existing structures constructed
below such required first floor elevation; or a structure
is listed on the National Register of Historic Places or a
State Inventory of Historic Places to be restored or
reconstructed.
(b) Failure to grant the variance would result in exceptional
hardship to the applicant.
(c) The issuance of the variance would not result in the
increased flood heights, additional threats to public
safety of extraordinary public expense,
(d) The variance allowed is the minimum, necessary to
afford relief.
(e) The variance would not have the effect of nullifying
the intent and purposes of the ordinance.
(2) The applicant shall be notified in writing over the signature
of the Director of the Building Inspection Department that:
(a) The issuance of the variance to construct a structure
below she base level will result in increased premium
rates for flood insurance up to amounts as high as $25
to $100 of insurance coverage.
(b) That such construction below the base flood level
increases risk to life and property.
(3) Such notification shall be maintained with a record of
all variance actions, including justification for their
issuance.
(4) A report of such variances shall be reported annually to the
Federal Insurance Administration.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction, to a fine not

to exceed the sum of Five Hundred Dollars ($500.00), or imprisonment for
not exceeding sixty (60) days, or by both such fine and imprisonment in the
discretion of the Judge.

Section 4. Should any section, paragraph, sentence or word of this
ordinance bo declared for any reason to be invalid, the same rhall not affect
the validity of the ordinance as a whole, or any part thereof other than the
pas.1 declared to be invalid.
Section 5. It is hereby found, determined and declared that this
ordinance is necessary and urgently needed for the preservation. of the health,
safety and we'-fare of the citizens and inhabitants of the City of Clearwater; .
that an emergency is hereby declared; and that this ordinance shall be in full
force and effect immediately upon its passage. This ordinance shall automatically
expire ninety (90) days from the date of its passage unless the ordinance is
submitted during such time for consideration as a nonemergency ordinance.
Section 6. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with
Chapter 166.041, Florida Statutes.
