WHEREAS, on October 7, 1976, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain ; proposed changes to the zoning ordinance of the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the proposed changes and amendments to the zoning ordinance were approved by the City Commission after its evaluation of all evidence presented at the public hearing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 35. 07, Procedure for Amending Zoning Ordinance, of Article XXXV, Administration and Enforcement of Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 35. 07. Procedure for Amending Zoning Ordinance. (1) Any person, firm, corporation, board or official of the City of Clearwater may file a written application requesting a zoning pursuant to annexation or a proposed amendment.-supplement, change or modification of the Zoning Ordinance or Zoning Map or Zoning Atlas of the City of Clearwater. The applicant shall provide the following which shall constitute the applications (a) A legal description of the tract proposed to be rezoned; (b) A plat of record or survey showing the dimensions, acreage and location of the tract prepared by a registered land surveyor whose State registration is current and valid, whose seal shall be affixed to the survey, except when a recorded subdivision plat is involved; (c) Except when a recorded subdivision plat is involved, the applicant shall submit a copy of any existing deed restriction relating to the property; (d) The present and proposed zoning classification for the tract; and (e)An affidavit setting forth the names and addresses of the owner or owners of the land together with their representatives, if any, The affidavit shall recite the instrument or instruments by which ownership was obtained, giving the official record book and page where such instrument or instruments may be foUhd. In the alternative, the owner or owners may attach to the affidavit a copy of the instrument or instruments such as demonstrate the fact of ownership or submit a copy of their title insurance policy. The City Commission when considering an application to zone pursuant to annexation or to rezone property may amend such application prior to acting thereon, but only to reduce its size or change the district requested to a less intensive or lower density district than that requested. (2) Applications shall be filed in triplicate with the city clerk and in addition to providing the items set out in Section 35. 07 (1), the applicant, except in the case of an individual single family lot and in case where the proposed development, including the land and proposed improvements, will have a valuation greater than $500, 000, shall present a map showing the location of the property for which an application is submitted and its relationship to adjoining properties and public faciliti..'s and services. Except as otherwise provided herein, he shall submit with the application applicable information concerning the service demands that will be placed on public facilities and services, including but not limited to, information on total anticipated population density; traffic volumes; effect on schools, drainage, traffic and utility facilities; an affidavit containing the names and addresses of all owners of properties within 200 feet of the property identified in the application. Such request for zoning for annexation or zoning change shall conform with the City comprehensive plan, or the applicant shall provide information explaining why theproposed change or the zoning to be established does not conform with the City comprehensive plan. Each application by anyone, other than a board or official of the City of Clearwater, shall be filed by the owner or his duly authorized representative and shall be accompanied at the time of filing by a fee to cover processing the application, which fee 'shall be set and established by resolution passed by the City Commission. "r??p'ti. ?.?.;' o u ?:: "} •i ?r '` ..:sa?,l Mf 0 (3) Except in the case of single family lots, and in those situations where Community Impact Statement submittals are required, the City Clerk shall forthwith transmit a copy of each application to the City Commission for acceptance and referral to the proper City departments for appropriate action and =public hearing. The Planning Department and the Planning and Zoning Board shall determine whether or not the request change or the request for zoning pursuant to annexation conforms with the City comprehensive plan, (4) The Planning and Zoning Board of the City of Clearwater shall make its recommendation to the City Commission within ten (10) days after the final and completed Planning and Zoning public hearing. The recommendation of the Planning and Zoning Board shall be based upon consideration of the following, but shall not be limited thereto; (a) Existing conditions including land use, lot area, building height and population and density patterns. (b) Whether or not the proposed change is reasonable in the sense that any property within a specific zone must be able to be used for the purpose for which it is zoned. (c) Whether or not the proposed change would constitute a grant of special privilege to an individual owner. (d) Does the zoning change requested conflict with the need of the neighborhood or the City? (e) Whether or not the proposed zoning change would adversely influence living conditions in the neighborhood. (f) Whether or not the proposed zoning change would be a deterrent to the improvement or development of adjacent property in accord with existing regulations. In appearing before the Planning and Zoning Board, the applicant may present information required by Section 35. 07 (1) and (2), but shall not be allowed to present renderings, site plans and other exhibits purporting to depict what is to be constructed should an amendment of the zoning code or map be approved. The limitation imposed by this paragraph shall not relieve an applicant from submitting site plans in those sitiations where the zoning code specifically requires their submittal and presentation. (5) Public notice and public hearing. (a) The office of the City Clerk shall publish notice of the Planning and Zoning Board and City Commission public hearings once, at least ten (10) days, but not more than forty-five (45) days, in advance of the hearings in a newspaper of general circulation in the City of Clearwater. The City Clerk shall in addition provide notice of such hearings to the property owners within 200 feet as identified on the affidavit filed by the applicant, as required by Section 35. 07 (2). (c) The City Clerk shall be required to notify from the list in the affidavit all property owners within two hundred (200) feet of any property on which a proposed change in the zoning map has been requested, or on which annexation and zoning is proposed. If such zoning change has been requested by the City Commission ^ ! and includes more than thirty (30) parcels of land, them notice t ' of the proposed zoning change shall be provided by publishing a ; ;• '. , r notice setting forth the proposed change, the land area affected and the date and time of the hearing in a newspaper of general circulation on two (2) separate occasions with first notice at least fourteen (14) days prior to the hearing. , , OeL , I (d) The public hearing shall be held at the time and place set forth t ?. r. In the notice and the City Commission shall consider the proposed amendment or change at the conclusion of the public hearing. In appearing before the City Commission, the applicant may present the information required by Section 35. 07 (1) and (2) of this Code, but shall not be allowed to present renderings, site plans, and other exhibits purporting to depict what is to be constructed should a map or code amendment be approved. The limitation imposed by this paragraph shall not relieve an applicant from submitting site plans in those situations where the zoning code specifically requires their submittal and presentation. (e) The City Commission shall hold such public hearing quarter= ? u '" annually and more often if in its discretion it feels public r'. convenience and necessity require. (6) Protest. Where a protest against a proposed zoning change signed by twenty per cent (20%) or more of the owners of the lots within five hundred (500) feet of the area proposed to be changed, is filed with the City Clerk ten (10) days prior to the date of the hearing before the City Commission, such amendments shall not become effective except by the favorable vote of not less than four (4) members of the City Commission. (7) All proposed changes and amendments to the Zoning Ordinance and the Zoning Map or Zoning Atlas as approved by the City Commission after its evaluation of all evidence presented at the public hearing, shall be incorporated in an ordinance which shall become effective immediately upon its passage. (c) Prior to the second reading of the ordinance annexing the property, the City Commission shall hold a public hearing, after providing the notice required herein, to determine the zoning district in which the annexed property is to be placed. (d)The Planning Director, following passage of the ordinance annexing the property and following passage of the ordinance zoning the annexed property shall amend the zoning map to conform the ;;" -:,° :]•: map to the zoning established pursuant to the ordinance. ,` a er'r''z •'' ' F;' ' (9) No property owner or owners or their successors in title shall initiate or cause to he initiated an action for a zoning change :4,,? r?'r?`;? affecting the same parcel of property or part thereof more often t, ; than once every twelve (12) months, • ° t , ? o ?.. ? Y. ,: (10) Continuances of annexation and zoning or rezoning items shall be continued to a time and date certain at the pleasure of the City Commission, but in no event shall such continuance exceed a period 41 1 of three (3) months, (a) Continuance. Continuance by City Commission shall require a favorable 4/5 majority vote. If the continuation is for a period of thirty (30) days or less, then no additional advertising shall be necessary or additional notice required. If such request for continuation is for a period over thirty (30) days, ! then the public hearing shall be readvertised and notices sent to required surrounding property owners. If continuance is at the request of a property owner applicant, the costs for j} such advertising and mailing shall be charged to the applicant ; unless the City Commission waives such charges. 11 (11) Withdrawals, If written request for withdrawal is received by the City Clerk seven (7) days or more prior to either the Planning and Zoning Board public hearing or the City Commission public hearing, then notice of such withdrawal shall be sent to the required surrounding property owners, costs for such mailing to be charged to the applicant. If written request for withdrawal is made less than seven (7) days prior to the Planning and Zoning Board public hearing, then no new application shallbe accepted for at least six (6) months thereafter. (Costs of notification of withdrawal to surrounding property owners shall be borne by the applicant. ) For purposes of resubmittel, withdrawal during and after Planning and Zoning Board public hearing is treated as a denial and, therefore, such withdrawal may not be resubmitted for a period of twelve (12) months, (12) Non-appearance of applicant or representative at either advertised public hearing, except as noted in (13) below, may'' constitute Planning and Zoning Board and City Commission denial. County Ordinance Inapplicable. The area included within the corporate limits of the City of ' Clearwater, Florida, is deleted from the provisions of Pinellas County Ordinance No. 74..15, entitled; ; .ssr '7 "AN ORDINANCE relating to zoning; providing a' a'??? ?i :?•'• definitions; requiring full disclosure of ownership of all property sought by application to be rezoned; requiring full disclosure of any contract for sale and the names of all parties thereto existing on the property at the time of rezoning; requiring full disclosure of options to purchase and the names of all parties thereto existing on the property at the time of rezoning; pro. hibiting the continuing or rescheduling of zoning hearings;' providing penalties for violations; providing severability; providing areas to be embraced; providing for an "F [ effective date;" and said ordinance shall have no effect within the City of Clearwater, Florida. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Any person, or persons, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment in Jail for not exceeding sixty (60) days or by both such fine and imprisonment. Each day that a violation is permitted to exist shall constitute a separate offense. Section S.
