AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
">r ??•' DESIGNATING THE PLANNING DEPARTMENT OF THE CITY
OF CLEARWATER AS ITS LOCAL PLANNING AGENCY FOR THE
PREPARATION OF THE COMPREHENSIVE PLAN FOR SAID CITY
AS REQUIRED BY THE LOCAL GOVERNMENT COMPREHENSIVE
PLANNING ACT OF 1975; DESIGNATING SAID PLANNING
DEPARTMENT TO BE RESPONSIBLE FOR THE PREPARATION
OF MATERIALS, DOCUMENTS AND CRITERIA REQUESTED IN
SAID PLANNING ACT; RECOGNIZING THE EXISTING COORDINA-
TIVE FUNCTION OF THE PINELLAS PLANNING COUNCIL RELA-
TIVE TO SURROUNDING AREAS AND PINELLAS COUNTY; PRO-
VIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFEC-
TIVE DATE OF THIS ORDINANCE.
WHEREAS, the City of Clearwater, Florida, a Florida municipal
corporation, is empowered by its charter to plan for, zone and rezone
land lying within its geographic jurisdiction; and
WHEREAS, the Local Government Comprehensive Planning Act of
1975 requires that all municipalities designate an agency to provide
planning services to their jurisdiction; and
WHEREAS, the City of Clearwater wishes to recognize the existing
coordinative function of the Pinellas Planning Council, but desires to re-
tain for itself the responsibilities of planning, zoning and rezoning within
its boundaries;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. That the City of Clearwater hereby designates its Plan-
ning Department, under the authority of the City Manager as set forth in
the Charter of the City of Clearwater, to be responsible for the preparation
of the comprehensive plan for said City and for the preparation of materials,
documents and criteria required by the Local Government Comprehensive
Act of 1975.
Section Z. That the City of Clearwater retains for itself and said
designated Planning Agency all rights, duties and responsibilities allowed
under its Charter and common acts as regards the Planning, land use,

' Section 3. Certified copies of this Ordinance shall be transmitted
forthwith to the State Land Planning Agency and the Pinellas Planning

Council in accordance.with the requirements of said Local Government :rlt
Comprehensive Planning A of 1975.
Section 4. All ordinances or parts of ordinances in conflict here-

with are, to the extent of such conflict, hereby repealed.
Section 5. Should-any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than
the part declared to be invalid.
Section 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accor-
dance with Chapter 166, 041; Florida Statutes.

MR Section 1. The historic preservation element of the comprehensive
plan as required by the "Local Government Comprehensive Planning Act of
197511, as amended, and as set forth in the attached exhibit, described as.
Composite Exhibit A - Document entitled "Historic
Preservation Element", consisting of a table of
contents sheet and 48 pages,
is adopted in accordance with the "Local Government Comprehensive Planning
Act of 197511, as amended, for the entire City of Clearwater, Florida.
Section 2. The attached exhibit described as.,

is adopted as part of this ordinance as if it was set forth in full herein.
Section 3. For the purposes of this ordinance, the area encompassed
by this ordinance shall be described as:
The entire area within the present boundaries of the
City of Clearwater as such boundaries are expanded and
redefined by future annexations, and the City of Clearwater
service area which service area is further described as follows:
Bounded on the West by the Gulf of Nexicc, on the North by
the centerline of Dunedin Pass; thence Southeasterly to a point
in St. Joseph's Sound approximately 700' feet Southeast of
Moonshine Island, excluding Moonshine Island; thence due East
through St. Joseph's Sound and along Union Street to Keene Road;
thence due North to County Road 34; thence due East to the
Southerly extension of County Road 70; thence due North along
County Road 70 to State Road 580; thence due East to U. S. Highway
19, excluding the Dunedin Industrial Park; thence due North to
Curlew Creek Road; thence due East to McMullen-Booth Road;
thence due South approximately 5, 400 feet to City-owned property;
thence, due East approximately 2, 200 feet; thence due South.

Comprehensive Plan as required or allowed by the "Local Government
Comprehensive Planning Act of 197511, as.amended, which are set forth in
the attached exhibit adopted herein, are hereby adopted as part of this ordinance.
Section 5. All development undertaken and all actions taken in regard
to development orders, all land development regulations enacted or amended
shall be consistent with this Plan and such element and part thereof in regard
to the land covered by this element andportions of the Comprehensive Plan
as hereby adopted shall be consistent with this Plan and each element and
part thereof.
Section 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 7. All public hearings and public participation required
pursuant to Section 163. 3181, Florida Statutes, and Section 153. 3184, Florida
Statutes, has preceded the consideration of this ordinance.'
Section 8. This ordinance is hereby adopted and shall be considered
henceforth adopted for the purposes of Section 163. 3184 (7), Florida Statutes,
and shall become effective immediately upon its passage.

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
:"CQMPLYING WITH THE "FOCAL GOVERNMENT COMPRE-
HENSIVE PLANNING ACT OF 1975",• AS AMENDED;
ADOPTING THE HOUSING ELEMENT AS PART OF THE
COMPREHENSIVE PLAN FOR THE ENTIRE CITY OF
CLEAR WATER, FLORIDA; ADOPTING THE ATTACHED
EXHIBIT; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. The housing element of the comprehensive plan as required
by the "Local Government Comprehensive Planning Act of 1975", as amended,
and as set forth in the attached exhibit, described as;
Composite Exhibit A - Document entitled "Housing
Element", consisting of a table of contents sheet and

is adopted in accordance with the "Local Government Comprehensive Planning
Act of 197511, as amended, for the entire City of Clearwater, Florida.
Section 2. The attached exhibit described as;

89 pages,
is adopted as part of this ordinance as if it was set -forth in full herein.
Section 3. For the purposes of this ordinance, the area encompassed
by this ordinance shall be described as;
The entire area within the present boundaries of the
p trc City of Clearwater as such boundaries are expanded and
redefined by future annexations, and the City of Clearwater
service area which service area is further described as follows;
Bounded on the West by the Gulf of Mexico, on the North by
the centerline of Dunedin Pass; thence Southeasterly to a point
a? in St. Joseph's Sound approximately 700 feet Southeast of
Moonshine Island, excluding Moonshine Island; thence due East
ti through St. Joseph's Sound and along Union Street to Keene Road;

Southerly extension of County Road 70; thence due North along
n, County Road 70 to State Road 580; thence due East to U.S. Highway

Section 5,? All development undertaken and all actions taken in regard
to development orders, all land development regulations enacted or amended

Section 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes,
Section 7. All public hearings and public participation required
pursuant to Section 163. 3181, Florida Statutes, and Section 16 3. 3184, Florida
Statutes, has preceded the consideration of this ordinance.
Section 8. This ordinance is hereby adopted and shall be considered
henceforth adopted for the purposes of Section 163.3184 (7), Florida Statutes,
and shall become effective immediately upon its passage.
