BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Paragraph (a) of Subsection (1), General Construction
Terms, of Section 18-3, Definitions, of Article I, In General, of Chapter 18,
Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is
hereby amended to read as follows:
(I) General Construction Terms.
(a) Alter, shall include but not be limited to the following:
the addition of surface area, the changing of name of business,
the changing of the location of light source.
Section Z. Section 18-4, Existing Nonconforming Signs, Removal,
of Article I, In General, of Chapter 18, Signs, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, is hereby repealed in its entirety and
a new Section 18-4, Existing Nonconforming Signs, is enacted to read as
follows:

Section 18-4. Existing Nonconforming Signs.
(A)Intent, It is the intent of this section to recognize that the
eventual correction of existing signs that are not In conformity
with the provisions of this Ordinance, is as much a subject of
health, safety and welfare as is the erection of new signs that
would violate the provisions of this Ordinance. It is also the
intent of this section that there shall not be any unreasonable
invasion of established private property rights,
(B)Continuance. Subject to the on-premise sign amortization
schedules set forth below, a nonconforming on-premise sign
may be continued and shall be maintained in good condition, but
it shall not be:
(1) Enlarged or changed to another nonconforming sign,
(2) Structurally altered so as to prolong the life of the sign,
(3) Re-established after its discontinuance for ninety (90) days, or
(4) Re-established after damage or destruction if the estimated
expense of reconstruction exceeds fifty per cent (507o) of the
appraised replacement cost.
(C)Conformance - Amortization Schedule. An on-premise sign,
including the supporting structure, which is in existence upon the
effective date of this Ordinance, and which theretofore conformed
to all legal requirements but which is made nonconforming by the
provisions of this Ordinance, shall be brought into conformity in
accordance with the following:
(1) All existing on-premise signs which do not comply with the
provisions of this Ordinance as set out in the Schedule of Sign
Regulations, Section 19-9 (C) (2), are declared to be nonconforming.
All On-Premise Signs shall be dealt with under the following
amortization plan if found to be nonconforming under the terms
of this Ordinance:

The above cost appraisals shall be determined by the Sign
Appraisal Board after receiving the itemized estimates
of costs to conform submitted by at least ,
two (2) licensed sign companies to the Sign Appraisal Board.
(2) Responsibility of Removal. Any sign, including the supporting
structure, now or hereafter existing which advertises a business
no longer conducted, or a product no longer sold, shall be
taken down and removed by the owner, agent or person having
the beneficial use of the building, structure or land upon which
the sign may be found. Such removal shall be within thirty (30)
days after written notification from the building official.

(D)Procedure for Recording Inventory.
(1) All of the following required changes in nonconforming
signs shall be reported to the building official and shall be
classified as "No Fee" or "Fee", such classification to be
determined in accordance with a prepared list of changes-
alteratton, relocation or maintenance descriptions, per
definition. Such classification shall declare and record
nonconformities and/or a sign meeting ordinance standard.
(2) An owner of a sign who desires to rely on an amortization
period longer than that specified in the amortization schedule
provided herein, shall file with the Building Department
within one year from the effective date of this Ordinance, a
statement setting forth the cost of such nonconforming sign,
the date of erection, or the cost and date of the most recent
renovation.
(3) It shall be the responsibility of the building official to make
inventory and -record of all nonconforming signs and serve
notice on such owners or users of such signs. The period
of nonconformity shall begin as of date of this inventory
notice, and such period of enforced conformity or removal
shall begin within 30 days after such notice. Such inventory
shall include:

Section 3. Paragraph (4) of Subsection (A), Procedures, of Section
18-6, Permits; all signs, of Article II, Administration, of Chapter 18, Signs,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to read as follows:
(4) The City building official may delay the issuance of any permit
for a sign for a reasonable length of time for the purpose of
determining the effect the sign may have on public health, safety,
morals and general welfare.
Section 4. Paragraph (1) of Subsection (A), Interference with Public,
of Section 18-7, General Regulations Governing Signs, of Article III, Regulations
and Specifications, of Chapter 18, Signs, of the Code of Ordinances of the City
of Clearwater, Florida, 1962, is hereby amended to read as follows:
(1) The sign must not create a traffic or fire hazard or interfere
with the free use of public streets or sidewalks.
and Subsection (C), Repair and Maintenance, of said Section 18-7, General
Regulations Governing Signs, is hereby amended to read as follows:

(5)
(C)Repair and Maintenance. All signs must be kept in good
condition, neat appearance and good state of repair. Any
sign more than sixty-five per cent (65%) destroyed must be
immediately removed at the owner's expense and a new permit
secured before the sign is replaced. If not replaced or removed
within a reasonable time, the sign and its supports shall constitute
a public nuisance and shall be removed.
Section 5. Subsection (A), Prohibited Sign Situations, of Section 18-8,
Regulations Governing Specific Type Signage, of Article III, Regulations and
Specifications, of Chapter 18, Signs, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby amended to read as follows:
(A)Prohibited Sign Situations.
(1) Location of signs within or upon public property and
rights-of-way is prohbited. Exceptions: Except as
permitted herein, no sign shall be located in or upon any
"P", Public District, as defined in the City Zoning Ordinance,
or in any street or in any street or railroad right-of-way,
except upon specific permission of City Manager therefor.
(a) Pole (ground) signs projecting over right-of-way shall
be prohibited in all zones.
(b) Scenic Waterways - The following waterways within the
City of Clearwater are hereby designated as "Scenic
Waterways":
(1) Clearwater Harbor
(2) Old Tampa Bay
(3)Or their Tributaries
Applicants for sign permits in the designated areas
within 660 feet of a waterway, or between any road
and the waterway, shall submit a detailed proposal
showing intended sign location and a plan of the intended
design for consideration by the Sign Review Board. It
is intended that these waterway areas shall be treated as
Special Sign Control Districts.

(2) Rental Rates. It shall be unlawful for any person, firm or
corporation who owns and operates, or has control of the
operation, or manages any hotel, apartment house, rooming
house, motor court, tourist camp or trailer camp, to erect,
maintain and display on or about the outside and on the grounds
of any such hotel, apartment house, rooming house, motor
court, tourist camp or trailer camp, any written sign thereby
setting forth or advertising the rates charged to its guests for
the rental of rooms, apartments, trailer space or any other
accommodation provided for and available at such hotel,
apartment house, rooming house, motor court, tourist
camp or trailer camp.

(3) Snipe Signs. Snipe signs, except when used as real estate f
signs, as defined herein in Sec. 18-3 sidewalk or sandwich .

(5) Flashing or activated signs as defined are prohibited in
all zones.
(6) Electrical Distrubance. No sign shall be constructed or
maintained of which all or any part causes static electricity
or otherwise interferes with radio or television reception.
(7) Distraction. No spot, beacon or floodlight shall be permitted
in any area within the City, except where such beacon, spot
or floodlight is non-revolving and in a fixed position, and
when said light shines only on the owner's premises or signs
and away from any street or roadway, and that the light spill
shall not exceed three (3) foot candle light at a point five (5)
feet from the owner's property. A permit shall not exceed a
period of five (5) days; however, in the absence of a bona fide
complaint, the time period may, without additional fee, be
extended by the Building Department for an additional five (5)
days. Only one (1) permit may be issued to each parcel or
ownership during any four (4) month period,
(a) Banners, Streamers, Spinners, Pennants and Similar
Distractive Displays. The display of banners, streamers
and spinners and pennants as defined is prohibited.
(b) Application. The above prohibited uses shall not apply to
private and public interest involved with a declared public
or noncommercial celebration of a significant civic, religious,
municipal, county, state or national event or period. On
such occasions the City Commission shall authorize the City
building department to issue permits for said special situations.
The conditions of permit issuance shall be publicized by the
Commission stating the nature and period of display and
setting a final date for removal. Tees, if and when
required, shall be established by the City Commission.

(c) Special Permission. Business groups may apply to
to the City building department for special permission to
have commercial displays of a temporary nature for certain
commercial celebrations; for example, grand openings,
change in ownership, one hundred year anniversaries, but
not for the sole purpose of advertising sales and other
promotional enterprises. If an application is denied, the
applicant may appeal to the City Manager and if he denies
same, then to the City Commission, which Commission
shall make a determination within sixty (60) days as to
whether such celebration or promotion is in the interest
of the public welfare, and if it so determines, then the City
Commission may order the City building department to issue
such permit. Authorization shall include, but not be limited
to, the following:
Organization(s) responsible for erection and removal.
Time of erection - deadline Ifor removal.
Nature and location of each display.
Fees shall be at the rate of twenty-five dollars ($25.00)
for the permit.
Permit shall not exceed a period of two (2) weeks.
However, an appeal and determination by the City
Commission, the length of the permit may be
extended up to a total period not to exceed one (1)
month upon a showing of public interest and public
welfare by the applicant.
and Subsection (D), Special Sign Control Districts, of said Section 18-8,
Regulations Governing Specific Type Signage, is hereby amended to read as
follows :
(D) Special Sign Control Districts. The City Commission, after
public hearing, may establish special sign control districts,
consisting of not less than 1, 000 running feet along a public
waterway or a public recreational facility. Such district may
involve several zones and have more or less restrictive
requirements than any or all of the zones in the district, and
shall require the recommendation of the Sign Review Advisory
Board prior to public hearing.
Section 6. Paragraph (2) of Subsection (C), Permitted Signs by
Zoning Districts, of Section 18-9, On-Premise Sign Eligibility and Regulations
for Zones and Uses, of Article III, Regulations and Specifications, of Chapter
18, Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby amended by amending under the designation "Multi-Family and
Professional Related Services" of the Schedule of Regulations, the Basis
of Eligibility to read as follows:

Section 7. Section 18-10, Outdoor Advertising Display--Off-Promise,
of Article III, Regulations and Specifications, of Chapter 18, Signs, of the 'Code
of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
to read as follows-
Section 18-10. Outdoor Advertising Display--Off-Premise.
(A)General Regulations.
(1) New Sign Construction. No Outdoor Advertising Display--
Off-Premise Sign shall hereafter be constructed in any zone
until a permit therefor has been obtained from the Building
Official.
(2) Permit for Alteration of Existing Signs. Outdoor Advertising
Display---Off-Premise Sign now existing shall not be altered
unless a permit as provided in Sec. 18-6 (B) (Z) hereof is
first obtained. Copy change does not require permit.
(3) Site Ownership or Lease. Persons desiring a permit for the
construction of an Outdoor Advertising Display--Off-Premise
Sign shall first exhibit to the Building Offical valid title to
or lease upon the lands on which they desire to erect such
sign or signs.
(4) Spacing between Signs. No Outdoor Advertising Display--Off-
Premise Sign shall be nearer another Off-Premise Sign than
600 feet; such measurement to be made on the same side of
the street. However, Off-Premise Signs shall only be located
on corners in accordance to the following:
(a) When an Off-Premise Sign- is placed on a corner in a
position in which it can be seen (legible) from two
approaching directions (generally diagonal to the inter-
secting right--of-way), then no other signs shall be placed
along the right-of-way of the two approaching directions
for a distance of 600 feet.
(b) When an Off-Premise Sign is located on a corner parcel
generally perpendicular to the right-of-way, then another
Off-Premise Sign shall not be permitted on the other
intersecting right-of-way (abutting parcel frontage) for
a distance of 300 feet (measured along right-of-way).
(5) Surface Area. Surface area of any Outdoor Advertising Display--
Off-Premise Sign shall not be greater than 400 square feet.
(6) Safety Requirements. Reference is made to Sec. 18.-7 (A) (Z).

(e) Minimum height to bottom: 3 feet.
Maximum height to top: 40 feet.
(8) Outdoor Advertising Display..-Off-Premise Signs shall be
prohibited as a roof sign.
(7) Height and Setbacks. The following height and setbacks
shall apply for Outdoor Advertising Display Off-Premise Signs:
(a) Ground Sign - Minimum setbacks 8 feet from existing or
hereafter constructed building and 8 feet from existing
property line with platform projections not extending
closer than 3 feet to property line.
(b) Minimum setback from right-of-way; 15 feet in CG,
CS and CP Zones.
(c) Minimum setback from right-of-way: Conditional 40 feet
in any commercial zone on U.S. 19. Where a 40 foot
casement proposed right-of-way has been established by
City Commission, Off-Premise Signs are permitted but
only under a stipulation (covenant agreement) that if such
area is necessary for additional traffic requirements, then
the sign owner shall remove said sign at his own expense.
(d) Minimum setback from intersecting street rights-of-way:
50 feet.
(9) Outdoor Advertising Display--Off-Premise Signs shall be
prohibited as activated, animated or flashing signs except
time and temperature.
(B)Outdoor Advertising Display--Off-Premise Product and Service Sign7'
Location Requirements.
(1) Permitted areas. Any of the following business and industrial
type zones: CP,' CG, CS, ML as located along all officially
designated Federal or State Highways (routes) so recorded with
the Engineering and Traffic Engineering Departments of the
City of Clearwater, this date.
(Z) Permitted Areas with Limited Requirements. Off-premise
signs (product and service) may be permitted
(a) In CP, CG, CS, ML zones along non Federal or State
designated streets provided they meet eligiblity standards
of the on-site sign requirements.
(b) maximum size Z50 square feet in a Shopping Center Zone
if approved at time of zoning and plan review provided
they meet eligibility standards of on-site sign requirements.
(3) Prohibited areas (transitional and separated districts).
(a) In all residential zones.
(b) In all PS and CTF zones.
(c) Within 100 feet of a residential zone.
(d) Within 50 feet of intersecting rights-of-way.
(e) Within 100 feet of any property which is used for public
park, public schools, church, courthouse, city hall,
public library or public zone, and AL zone.

(C)Outdoor Advertising Display--Off-Premise Sign Identity
and Directional Only.
(1) Such sign shall advertise no product or specific service,
but shall denote only identify of name and/or general business
activity which is located elsewhere than on the premises of
the sign.
(x) Such sign may be permitted in any business type zone (including
PS, but not CTF). Application shall justify location in respect
to logical route direction.
(3). Such sign, if located in a CP, PS, CG, CS or ML zone, shall
conform to the following height and setback requirements:
(a) Ground Sign: Minimum setback five (5) feet from existing
or hereafter constructed building;
(b) Minimum setback from right-of-way; Fifteen (15) feet
in CG, CS and ML zones;
(c) Minimum setback from intersecting street curb line:
Fifty (50) feet;
(d) Minimum setback from right-of-way: Forty (40) feet
in CP Zone on U. S. 19; and
(e) Minimum height to bottom: Three (3) feet.
(4) Such sign shall not exceed forty (40) square feet in surface area.
(5) Such sign, if located within one hundred (100) feet of a corner
right-of-way intersection shall not have any red or green
illuminated or luminescent portions. Also, see Section 18-7 (A)
and Section 18-8 (A) (6) and (8).
(6) No outdoor advertising display--off-premise identify and
directional sign shall be activated or flashing as defined.
(7) Outdoor advertising display--off-premise identify and
directional signs shall be prohibited as a roof sign.
(D)Outdoor Advertising Display--Off-Premise Master Directory
and Merchant Group Signs. Master Directory, Merchant Group,
uniform or individual signs of a directory nature may be installed
by the City of Clearwater for:
Downtown Development Board
The Clearwater Beach Association
The Chamber of Commerce
Or others as approved by the City Commission
on public right-of-way or on private property, provided sufficient
legal clearance is obtained from the owner of the property or
structures. Such request must be made to the Building Official
for approval by the City Manager.

Section 10. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.

Section 12. This ordinance shall become effective immediately upon
