BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 7-65. 1, National Electrical Code--Adopted, of
Division 2, Electrical Code, of Article III, Electricity, of Chapter 7, Building's,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to read as follows:
Section 7-65. 1. National Electrical Code--Adapted.
There is hereby adopted by the City of Clearwater, Florida,
for the purpose of prescribing regulations governing all electrical
construction and all material and appliances used in connection
with the installation, maintenance and operation of electrical
wiring, apparatus or equipment for light, heat or power, inside
of or attached to buildings within the City, that certain code
known as the National Electrical Code recommended by the
National Board of Fire Underwriters for Electrical Wiring
and Apparatus, being particularly the 1975 edition, except
for any penalties contained therein, of which code three (3)
copies thereof are now and have been for the last preceding
ten (10) days on file in the office of the City Clerk of the City
of Clearwater, and the same is hereby adopted and incorporated
by reference as fully as if set out at length herein as authorized
by Chapter 163. 295, Florida Statutes, and from the effective
date of this ordinance shall take effect, the provisions thereof
shall be controlling within the limits of the City of Clearwater,
Florida.
Section Z. Section 7-66, National Electrical Code--Application;
penalty, of Division 2, Electrical Code, of Article III, Electricity, of Chapter
7, Buildings, of the Code of Ordinances of the City of Clearwater, Florida,
1962, is hereby amended to read'as follows:

Section 7.66. National Electrical Code--Application; penalty.
(a)All electrical construction and all material and appliances
used in connection with the installation, maintenance and
operation of electrical wiring, apparatus or equipment for
light, heat or power, inside of or attached to buildings 'within
the City, shall conform to such special rules and regulations
as may be embodied in the "National Electrical Code, Standards
of the National Board of Fire Underwriters for Electrical
Wiring and Apparatus," 1975 edition, except for any penalties
contained herein, as adopted by the City Commission, save
and except such provisions therein which are in conflict with
this Code of Ordinances,, and save and except such provisions
therein which are amended, modified, superseded or deleted
by this Code of Ordinances; provided, however, in the alteration,
repair or rewiring of existing structures, the electrical inspector
shall have the authority to permit such work to be done, whether
in accord with such code or not, in a manner deemed by him to
be sufficient to insure the safe operation of the facilities involved
and to eliminate hazards to property and persons.
(b)Any person, organization, society, association or corporation,
or any agent or representative thereof who shall violate any
provisions of Section 7-65. 1 or 7-66 shall be subject upon
conviction in the municipal court, to a fine not exceeding the
sum of Five Hundred Dollars ($500. 00), oy imprisonment in the
City jail for not exceed sixty (60) days, or by both such
fine and imprisonment in the discretion of the Municipal Judge.
Any violation of the provisions of sections 7-65. 1 and 7.-66 may
also be grounds for the City to suspend or revoke the offending
party's contractor's or sub-contractor's license issued by the
City. Each day's continuance of any violation of sections 7-65. 1
and 7-66 shall constitute a separate offense. The imposition of
one penalty for any violation shall not excuse the violation or
permit it to continue; and all such persons shall be required to
correct or remedy such violations or defects within a reasonable
time.
Section 3. All former ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the code hereby adopted
are hereby repealed.
Section 4. Should any section, paragraph, sentence or word of this
ordinance or of the code hereby adopted be declared for any reason to be
invalid, the same shall not affect the validity of the ordinance or code, as a
whole, or any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
