Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning atlas of the City of
Clearwater in accordance with procedure as established, and
WHEREAS, certain of the proposed changes and amendments to the

hereby enacted a new Article XIII, RM-28, High Density Multi-Family Use
District, to read as follows:
Article XIII. RM-28 - High Density Multi-Family Use District
Section 13. 01. General description.
This district is created to provide for high density apartment
development use. The maximum density permitted is twenty-eight
(Z8) dwelling units per net acre.
No new RM-28 High Density Multi-Family Use District may be
created which contains less than four (4) acres.

Section 13. 02. Permitted uses and structures.
In the RM-28 High Density Multi-Family Use District no
premises or building shall be used or occupied and no building
shall be hereafter erected or structurally altered, unless
otherwise provided in the Code of Ordinances, except for
one or more of the following uses:
(1) Apartment houses.
(2) Townhouse development as regulated in Section 30. 05.
(3) Accessory buildings, including recreational buildings
and/or community meeting buildings designed as integral
part of multi-unit development service.
Section 13. 03. Special exceptions as regulated in Article XXXV,
Section 35. 09.
(1) Boardinghouses, lodging houses.
(2) A public dining room restaurant, provided the same is
located within the apartment house, lodging house or
boardinghouse, and provided further that no street, window,
or exterior sign for display exceeding two (2) square feet
in area to be used to advertise same.
(3) Physician or doctor's office.
(4) Convalescent home and hospitals except hospitals or homes
caring for mentally deranged persons or nervous disorders.
(5) Day nursery or private school.
(b) Marina facility Type A (pleasure craft docking), Type B
(launching ramp site, commercial), and Type C (private
marina).
(7) Model apartment.
(8) Noncommercial off-.street parking lots (not operated as a
separate business) or spaces on vacant lots or portions
thereof for parking passenger motor vehicles.
(9) A single family or a two family dwelling unit when built
in compliance to lot and building regulations applicable to
RS-50 or RM-12 Districts, respectively.
(10) Private clubs except those the chief activity of which is a
service customarily carried on as a business.
Section 13. 04. Area and dimension regulations.

(1) Waterfront lots as regulated in Section 30. 07.
(2) Minimum lot or parcel area--10, 000 square feet.
(3) Minimum lot width at building setback line--100 feet.
(4) Minimum front or side street building setback--20
feet from property line or 50 feet from center line of
right-of-way, whichever is greater..
(5) Minimum side or rear building setbacks--Buildings of 20
feet in height or less shall require a minimum of 15 feet
setback. Buildings greater than 20 feet in height, setback
shall be 15 feet plus I foot for each 4 feet of total building
height. One story carports above average street grade may
be constructed within 5 feet of side or rear property line.

(6) Swimming pool or enclosure setbacks--Front setback:
1/2 building setback of zone; side setback: 5 feet; rear
setback: 5 feet.
(7) Maximum height--80 feet.
(8) Required distance between buildings:
The required distance between buildings located on the interior
of a parcel of property shall be the total of the following
requirements determined by the height of the buildings and
whether the facing walls of said buildings have any windows:

(c) In no instance is this reduction to supersede the

Section 13. 05. Fences, walls and screening.
In RM-z$ zoned use district, suitable buffering, in the form of
fences, masonry walls, or plant materials, shall be provided to
visually screen parking areas and outdoor activity areas from
adjacent properties. This screening may be required to be _
extended to parking areas located in the front building setback
areas abutting public right-of-way. Where a suitable permanent,
buffer already exists on the adjacent property line, the buffering
requirements may be waived by the building official. Where parking
areas or similar activity areas adjoin each other on adjacent r
properties both devoted to multiple dwelling use, the peripheral ',.
buffering requirements may be waived by the building official for
both properties. In such instance a common planting plan shall
be agreed to by the applicant parties and such agreement shall
be on file with the building official for his approval.

is hereby repealed in its entirety.

District, of Appendix A, Zoning, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, including Sections 15. 01 through 15. 06, inclusive,
is hereby repealed in its entirety.
Section 8. Article XVI, RM-54A, High Density Multi-Family, Hotel
and Motel Use District, of Appendix A, Zoning, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, including Sections 16. 01 through 16. 06,
inclusive, is hereby repealed in its entirety.
Section 9. Section 17. 01, General Description and Section 17. 04,
Area and dimension regulations, of Article XVII, CTF, Commercial-Tourist
Facilities Use District, of Appendix'A, Zoning, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, are hereby amended to read as follows:
Section 17. 01. General description.
This district provides for the complete range of residential and
motel-hotel development. The major emphasis of the district
is tourist oriented with a permitted maximum density of 28
dwelling units per acre or 4Z hotel or. motel units. No new
CTF, Commercial-Tourist Facilities Use District may be
created which contains less than four (4) acres.
Section 17. 04. Area and dimension regulations.
(1) Waterfront lots as regulated in Section 30. 07.
(2) Minimum lot or parcel area--10, 000 square feet.
(3) Minimum lot width at building setback line--100 feet.
(4) Minimum ground floor area per structure--1, 000 square feet.
(5) Minimum building setback from lot line:
(a) Front or side street--15 feet from property line or 50
feet from centerline of right-of-way whichever is greater.
(b) Side and rear--10 feet; for buildings greater than 20 feet
in height, the rear and side setback of 10 feet shall be
increased by 1 foot for each 4 feet of total height.
(6) Swimming pool or enclosure setback: Front: 1/2 building
setback of zone; side--5 feet; rear--5 feet.
(7) Maximum lot coverage--40% of gross lot area.
(8) Maximum height--B0 feet.
(9) Maximum net density; dwelling units per acre--28
apartments; 42 hotel-motel units.
(10) Minimum usable open space-x•10% gross lot area.
(11)Minimum enclosed floor area in square feet per dwelling area:
(a) Hotel-motel room--300' square feet per unit.

Section 10. Sub-sections (11) and (14) (a) of Section 19. 05, Mobile
home park development standards, and Sub-section (3) of Section 19. 06,
Mobile home spaces requirements, of Article X1X, RMH, Mobile Home Park
District, of Appendix A, Zoning, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, are hereby amended to read as follows;

Section 19. 05. Mobile home park development standards.
(11) Park Peripheral setback requirements--Side and rear:
Six (6) feet; or fifteen (15) feet if adjoining a private
right-of-way or any RS, RM-10 or RM-12 zone; or ten
(10) feet if adjoining any RM-16, RM-20, RM-24 or
RM-28 or CTF or comparable zone.
(14) Screening:
(a) There shall be provided and maintained along the
entire perimeter a continuous visual buffer with a
minimum height of six (6) feet, which shall be a
compact foliage screening or shall be combined
masonry or wooden fence and shrubbery screen
between RMH and Single Family RS, RM-10, RM-12,
RM-16, RM-20, RM-24 and RM-28 zoned properties.
Screening may be waived between RMH and other zoned
properties by the planning and zoning board. No
beautification shall be required when abutting another
mobile home park.

Section 19. 06. Mobile home space requirements.
(3) Drainage, sanitary sewer, electrical wiring and
specifications for foundation and fastening shall be reviewed
by the proper departments so as to determine conformance
to proper city ordinances, Southern Standard Building Code,
and Florida State Board of Health regulations.
Section 11. Sub-section (1) of Section 20. 02, Permitted uses and
structures, of Article XX, PS, Professional Services District, of Appendix
A, Zoning, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby amended to read as follows:
Section 20. 02. Permitted uses and structures.
(1) Multiple dwellings as regulated in the RM-Z8 District
if located in an area zoned PS prior to date of adoption
of this ordinance.

Multiple dwellings as regulated in RM-28, except that within Core
CBD 34 density shall be allowed.
Hotels and motels--For density for Core Central Business District
(Definition Art. II (12A) ) 81 hotel-motel units per net acre, 42
hotel-motel units per net acre otherwise.
Sub-section (2) of Section 23. 05, Area and dimension regulations, is
hereby amended to read as follows:
(2)Apartment uses--As regulated in RM-28, however, in the Core
CBD maximum allowable coverage can be increased to 70%
and FAR not to exceed Z. 0 maximum. In the defined Core CBD
(see Art. 1I (12A) ) only one side building setback shall be
required and no rear setback shall be required.

Flood Hazard Boundary Map available in the office
of the City Engineer.
2. Intentions, if any, to request variance(s) from the

3. Data indicating compliance with Federal requirements
for the mandatory purchase of flood insurance under

provided that sufficient safe access is provided and that
off-street parking is provided for each staff member.

R5-50, RM-8, RM-1Z, RM-16, RM-20, RM-24, RM-28
and CTF Zones in accordance with the following: Such parking
lot (a) shall be contiguous to a CG or PRUC Zone and of same
ownership or leasing; (b) shall not extend beyond two hundred
feet (200), more or less, to the nearest full lot of record or
portion thereof under same ownership; (c) shall not cross a
residential street; and (d) shall provide ingress and egress
only from the business property unless determined otherwise
by the board of adjustment and appeal.
Section 19. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

(4) The board shall, after due notice as set out below, not
less than fifteen (15) days,' and not more than forty-five
(45) days after the filing of the appeal, hold a public hearing
thereon and promptly render its decision. At the hearing an
applicant or other interested party may appear in person or
be represented by an attorney.
Subsection (8), Special exceptions, is amended by amending
paragraphs (a), .(b), (c), (d), the description of marina facilities Types

Section 20. Should any part or provision of this ordinance be declared`` i
