AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION B-57 OF CHAPTER 8, ELECTIONS, OF
THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO CLARIFY CAMPAIGNING REGULATIONS
PERMITTING ANY ELECTED OFFICIAL OR EMPLOYEE OF
THE CITY TO EXERCISE HIS RIGHT OF FREE SPEECH AND
EXPRESSION OF OPINION ON ANY CANDIDATE OR ISSUE;
PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING PENALTIES FOR THE
VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING
THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE
HEALTH, SAFETY AND WELFARE OF THE CITIZENS OF
THE CITY; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Paragraph I of Section 8-57, Campaigning Regulations,
of Article III, Candidates, of Chapter 8, Elections, of the Code of Ordinances
of the City of Clearwater, Florida, 1962, is hereby amended to read
as follows:
Section 8-57. Campaigning Regulations.
1. No employee or official of the City of Clearwater may use his
official authority or influence for the purpose of coercing or
influencing another person's vote, or directly or indirectly
attempting to control the outcome of an election. This shall
not be construed so as to limit the individual's campaigning
in his own behalf, but shall apply to the campaigns of others.
a Nothing contained in this section shall be deemed to prohibit
any elected official of the City of Clearwater from exercising
his right of free speech and expression of opinion on any
candidate or issue. No employee of the City of Clearwater
shall be denied the right of expressing his opinion on any
candidate or issue or from participating in any political
campaign during his off-duty hours as a private citizen.
Section 2. All ordinances or parts of ordinances in conflict herewith

are, to the extent of such conflict, hereby repealed.
Section 3. Any person, organization, society, association or
corporation, or any agent or representative thereof who shall violate any
provisions of this ordinance or fail to comply therewith, shall, upon conviction
in the Municipal Court, be fined not exceeding the sum of Five Hundred Dollars
($500. 00), or imprisoned in the City Jail for not exceeding sixty (60) days,

It being specifically understood that prosecution for the violation of any of the
said provisions may be commenced before, but not after, two years shall
have elapsed from the date of the violation.
Section 4. Should any section, paragraph, sentence or word of
this ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other than
the part declared to be invalid.
'Section S. It is hereby found, determined and declared that this
ordinance is necessary and urgently needed for the preservation of the health,
safety and welfare of the citizens and inhabitants of the City of Clearwater;
that an emergency is hereby declared; and that this ordinance shall be in
full force and effect immediately upon its passage,
