ORDINANCE NO. 1535
WHEREAS, the estimated income to be received by the City during

ENDING SEPTEMBER 30, 1975, FOR OPERATION PURPOSES
INCLUDING PENSIONS AND DEBT SERVICE; AUTHORIZING
THE CITY MANAGER TO ISSUE SUCH INSTRUCTIONS THAT
ARE NECESSARY TO ACHIEVE AND ACCOMPLISH THE SERVICE
PROGRAMS SO AUTHORIZED; AUTHORIZING THE CITY
MANAGER TO TRANSFER MONEYS AND PROGRAMS AMONG
THE DEPARTMENTS AND ACTIVITIES WITHIN ANY FUND
AS PROVIDED BY THE CITY CHARTER; RATIFYING AND
APPROVING ANY EXPENDITURES MADE IN ACCORDANCE
WITH THE SAID BUDGET FROM OCTOBER 1, 1974, TO
DATE OF ADOPTION OF THIS ORDINANCE; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDNG FOR THE REPEAL OF ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; PRO-
VIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, the City Manager of the City of Clearwater, Florida,
has submitted an estimate of the amount of money necessary t o carry on the
City Government for the fiscal year beginning October 1, 1974, and ending
September 30, 1975; and
said period from ad valorem taxes and other sources has been submitted
to the City Commission; and
examined carefully, considered and approved same; and
WHEREAS, the City Commission on September 3, 1974, passed and
taxation and gave notice of public hearing thereon to be held on September 9,
adopted Resolution No. 74..101, which adopted a budget, fixed the rate of
1974, at 7:00 P.M.; and
WHEREAS, in accordance with Section 83 of the Charter of the City
of Clearwater, Resolution No. 74»101 was published in one issue of the Clear.
water Sun giving proper notice of said public hearing upon the proposed
budget and tax levy; and

WHEREAS, a public hearing was hold on September 9, 1974, at 7:00
P. M. in the Clearwater City Hall Auditorium, public response was heard,
and Resolution No. 74-101 was confirmed as adopted; and
WHEREAS, the Budget was properly adopted in accordance with
the Charter of the City of Clearwater; and
WHEREAS, the Attorney General of the State of Florida has
interpreted Section 166. Z41, Florida Statutes, a portion of the Municipal
Home Rule Powers Act, to require that a municipality adopt its budget by
ordinance and not by resolution or motion, and further that the said Municipal
Home Rule Powers Act supersedes the Charter of the City of Clearwater,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the City Manager's Annual Report and Budget for the
fiscal year beginning October 1, 1974, and ending September 30, 1975, a
copy of which is on file with the City Clerk and is by reference made a part
hereof, a summary of which is attached hereto and marked Exhibit A, is
hereby adopted as the Budget for the City of Clearwater.
Section Z. That it is hereby determined that a tax of 5.456 mills against
the real and personal property within the City, not exempt from taxation by law,
is necessary to raise said sums appropriated for operation purposes, including
pensions and debt service, and said rate of millage is hereby assessed against
said property for said purposes.
Section 3. That the City Manager is authorized and directed to issue
such instructions and directives that are necessary to achieve and accomplish
the service programs authorized by the adoption of this budget,
Section 4. That the City Manager is authorized as he deema appropriate to
transfer moneys and programs among the departments and activities within any
fund, as provided for in the City Charter.

Section 5. Any expenditures made in accordance with the terms and .
provisions of the said budget from October 1, 1974, to date of adoption of
this ordinance, :ire hereby ratified and appro.vod.
Section 6. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid.
Section 7. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section B. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 9. This ordinance shall become effective immediately upon
its passage.
