WHEREAS, on July 15, 1974, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning atlas of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning ordinance and zoning atlas were approved by the City Commission after
its evaluation of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 2. Article XXXIV, Administration and Enforcement, of
Appendix A, Zoning, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby renumbered and designated as Article XXXV.
Section 3. Appendix A, Zoning, of the Code of Ordinances of the
City of Clearwater, Florida, 1962, is hereby amended to enact a new
Article XXXIV to be titled "Development Requirements and Procedures"
to read as follows:
Article XXXIV. DEVELOPMENT REQUIREMENTS AND
PROCEDURES
Section 34. 01. Community Impact Statements
(1) General: 'Community Impact Statements" shall be
required for projects requiring annexation and zoning, or
rezoning, if developmental and construction costs are
expected to exceed $500, 000. "Community Impact State-
ments" may be required, at the discretion of the City
Manager for projects requiring annexation and zoning,
or rezoning, if developmental and construction costs
are expected to be less than $500, 000.

"Community Impact Statements" shall be required prior
to issuance of building permits for any project where
developmental and construction costs are expected to
exceed $500, 000, and may be required, at the discretion
of the City Manager for projects where developmental and
construction costs are expected to be less than $500, 000.
This requirement may be waived by the City Manager if

a "community impact statement" has been prepared
within the previous six months in connection with the
annexation and zoning, or rezoning, of the identical
property for which a building permit is being requested.
Elements of phased developments under approved master
site plans or elements of contract annexations shall be
treated as separate projects under this ordinance.
Requirements of this ordinance shall be equally applicable
to "public" and "private" projects.
(Z) Content: Community Impact Statements shall, as a
minimum, address the effects the proposed development
would have on public service facilities and other areas that
might affect the health, safety, general welfare and quality
of life in the City of Clearwater, The Community Impact
Statements shall be prepared by qualified professionals and
must indicate the name of the firm or the individual pro-
fessionals preparing the statement. Specific- areas to be
addressed and subjects within each area may vary with the
type and extent of proposed development, but will generally
conform to the following:
(a) _Legal Description: A metes and bounds, plat or other
legal description of the property including, but not
limited to-
(I) Reference to the appropriate Plat Book and page(s)
of the Public Records of Pinellas County, and recitation
of name(s) of owner(s) of record.
(2) Reference to surveys and other documents pertaining
to excluded parcels or parcels identified for future
inclus ion.
(3)Reference to existing rights-of-way, easements, and
any requirements foreseen for future dedication of
additional rights-of-way as identified in the City or
County Land Use Plan or the Official Major Thorough-
fare Plan.
(4)Current land assessment.
(S)For contract purchase, provide details of contract.
(6)A recitation of all covenants, both existing and pro-
posed, to run with the land.

(b) Location and Access: A narrative description of the
general shape of the tract, its size in acres, its location
with respect to bordering roads and natural features, and
a statement of commonly used means and routes of access.
(c) Topography and Drainage; A brief description of the tract
with respect to such matters as relief, flood hazards,
existing outfalls and canals, natural water courses on or
abutting the property, any prior ground water studies,
and site drainage problems which have existed, which now
exist or are forecast. An acceptable plan for ponding or
other disposition of surface runoff is an essential portion
of this section, as is an indication of the relationship
between site drainage under full development and drainage
as shown in the Clearwater Master Drainage Plan.

(d) Adjacent Land Uses A brief description of surrounding land 1
uses (and known planned uses) adjacent'to the tract. State
mente as to the age of existing structures, recent sale prices
or valuation in area, evidence of neighborhood pride or the
lack thereof, the status of vegetation, etc. are appropriate. :'
Provide land assessment data for adjacent parcels. ;=',b-
(e) Site Land Use: A statement of the current uses of the tract.
(f) Ve etation: A detailed accounting of the types, quantities
and locations of trees and unique vegetation features.
Generalized assesements of the economic and aesthetic values
represented and the extent of potential damage.
(g) Soils: A listing of the soil type(s) existing within the tract ?if?,Y i'"a`"{?;,.•`'. +
and an analysis'of any impacts or constraints to development
associated with soils of these types, e. g. structural SF+'?s' ,;
stability, drainage, corrosiveness, etc. Information extracted
from the Pinellas County Soil Survey satisfied this requirement.
(h) Sanitary Sewers: Any and all information available
as to the proximity of sewer lines, the practicality of
tying-in to existing sewer lines, the quantity of sewage and
quality expected to be generated, the treatment facility pro-
posed to handle the sewage and any other information deemed
material to the issue at hand.
(i) Refuse Collection: A statement pertaining to the extent of
of dumpster service or curbside pickups that will be required
and utilized. Also, any anticipated special pick-up requirements.
(j) Air and Noise Pollution: A statement of overall site activity
which will generate, create, cause or sustain air or noise
pollution to include differentiation and identification of point
sources and/or complex sources, both during construction and
after construction is completed.
(k) Water and Gas: Information relative to existing water and
gas mains and/or trunkline s and their capacities, and
comprehensive data as to forecast requirements for potable
water, water for landscape sprinkling, and intentions, if
any, to drill shallow and/or deep wells in partial or total
satisfaction of water requirements.
(1) Dedication of Parks and Recreation Sites (annexations only):
A statement of response which satisfies the Clearwater
requirement for dedication of 10% of annexed land for parks
and/or recreational purposes or, if acceptable to the City,
monetary contributions for park acquisitions or recreational
purposes in lieu thereof. All applicants shall discuss anticipated
usage of municipal and county recreation and park facilities
arising from the proposed project.
(m) Fire Prevention: An indication of compliance with all building
and fire prevention codes, submission of data relative to
accessibility of the site by fire fighting equipment, location
of fire hydrants, and topographical or other constraints to
fire fighting and probable fire service increased staff and
equipment needs.

(o) Demographics: Studies or knowledgeable estimates of the
number of persons to occupy the development, by phase,
and suitable breakdowns of the totals by age and economic.
status. Data as to the mix and total number of school age
children is especially important. Location of schools receiving
additional enrollment should be documented with information as to
whether transportation will be furnished by school system. If
students will be required to walk to a school facility, need for
future sidewalk construction along route should be documented.
(p) Tax Effect: A logical interpretation and evaluation of the
extent to which the proposed development will add to (or
detract from) the tax base of the City of Clearwater.
(q) Traffic and Parking: An extensive description of proposed
means of compliance with Traffic, Parking and Parking Lot
Beautification Ordinances, as well as a discussion of pedestrian
and vehicular traffic circulation both within and adjacent to the
development, methods of parking proposed, parking surface
material, and projected traffic counts (average and peak). The
vehicular traffic impact on public facilities elsewhere shall be
discussed. All parking proposals and discussions will consider
storm water runoff, existing tree preservation (as canopy and
screen) and erosion prevention.
(r) Maps, Charts and Illustrations: Submission of a Location Map
and recent aerial photographs (minimum scale 111=1001) is
required. Inclusion of any or all of the following maps, charts
and illustrations may be appropriate depending upon the size,
scope and extent of the proposed development:
(1) Topographic Map
(2) Architectural renderings of proposed structures (reasonable
assurance should be given that the style and layout will be
adhered to).
(3) Drainage Map
(4) Site Plan
(5) Vegetation Type Map
(s) View Interference: A brief statement as to the impact the
proposed structures might have with regard to obstructing or
degrading traditional views to and through the property.
(t) Housing: An analysis of the effect the proposed development
would have on the availability of housing for persons already
residing in Clearwater, especially those of low and moderate
incomes.
(u)Archeological/Historical Significance: A narrative outline
concerning early human cultures (if any) which may have occupied
the site together with data as to artifacts which have already been
uncovered at or near the site and knowledgeable estimates of the
degree to which development of the site would inhibit or eliminate
the possibility of significant archeological finds.
(v) Wildlife: A statement as to the presence or absence of wildlife
on the property, particularly emphasizing any rare or endangered
species together with a statement of the effect the proposed
development would have on these creatures and on their established
habitats. An up-to-date listing of rare and endangered species,
on file in the Office of the City Environmental Planner, is available
for ''use by developers and the general public.

(w) Shadow Effect: A discussion of any and all effects the proposed
development would have in the way of restricting or altering
benefits currently enjoyed by occupants /tenants of adjacent
properties with regard to the free flow of air and the direct
exposure to sunlight.
(x) Financial Interest: A statement as to the total estimated project
value, the party or parties financially involved, e. g, corporate
identity, principal officers, major (over 516) stockholders, etc.
and all financial arrangements made or contemplated to include:
(1) The identity of the lending institution furnishing mortgage
money or, if more than one institution is involved, the
identities of each and the dollar amounts being furnished
by each.
(2) An indication of parcel break-out from total tract per
future sale or separate financing, if any.
(3) Types and quantities of insurance to be carried together
with information as to the company or companies under-
writing insurance.
(y) Traffic' Control: A complete rundown of the traffic control and
traffic safety equipment needed as a result of the proposed project,
inclusive of increased traffic flow in the immediate area to public
services, such as beach, library, etc. Data furnished must address
both internal and external measures and must list by type, quantity
and location all requirements for street lighting, traffic control
signs and signals, and street name signs,
(z) Compatibility: A general discussion of the more significant
architectural and aesthetic characteristics of the proposed
development to include overall character of design, height,
bulk, open space, etc. together with like date pertaining to
structures on adjoining parcels and an analysis of the compatibility,
or lack thereof, between the existing and the proposed.
(aa) Health Services: A discussion of additional community health
services and facilities required as a result of the proposed
development. Data should be quantitative (number of doctors,
nurses, hospital beds, nursing home beds, etc. ) and, on large
scale projects, should be time phased.
(bb) Mass Transit: A brief summary of existing mass transit service,
if any, to the area of proposed development, to include locations
of bus stops, weather shelters, etc. Also a projection of
required increases to all of the above as a result of development.
(cc) Ecology: A description of the tracts environmental setting,
together with a discussion of any environmental changes,
alterations to ecological systems and/or irreversible commit-
ments of natural resources associated with the proposed
development. All biotic and physical factors, their relation-
ships to the natural environment, and all impacts projected
upon said ecosystems as a result of development and alterations
of landscapes will be fully addressed unless specifically exempted
by the City Environmental Planner.

(dd) Non-Local Coordination: An indication of non-local coordination
requirements already effected and a status listing on those yet
remaining. A partial listing of agencies with whom developers
may have to coordinate, together with examples of the types of
development necessitating coordination with each followsi
(1) Pinellas County Water and Navigation Control Authority—
Construction seaward of mean high water and its effect on
surrounding uplands.
(2) Pinellas County School Board--Reservation of a portion of
large developments for school use.
(3) Pinellas County Planning Department--Conformance with the
County Land Use Plan.
(4) Pinellas County Public Health Department--Package sewage
treatment plants.
(5) Southwest Florida Water Management District--Wells two
inches or more in diameter.
(6) Tampa Bay Regional Planning Council .-Developments of
Regional Impact.
(7) Florida Department of Pollution Control--Package Sewage
Treatment Plants and Complex. Source Permits (any project
that may degrade water quality must have DPC certification
over and above all other permits).
(8) Department of Natural Resources--Coastal construction
setback lines on the open Gulf.
(9) Division of State Planning--"Binding Letters of Interpretation!'
on Developments of Regional Impact.
(10) Coastal Coordinating Council--Review of proposed land
development projects situated within the coastal zone.
(11) Internal Improvement Trust Fund--Bulkheads, docks, etc.
(1 Z) Federal Housing Administration--Land Use Intensity Standards.
(13) Environmental Protection Agency--Effluent discharges.
(14) U. S. Corps of Engineers--Dredge and fill.
(15) Bureau of Sport Fisheries and Wildlife..-Preservation of
Marine and Upland Species.
(ee) Library: A brief summary of the impact the proposed development
would have on Clearwater's Library facilities in terms of patronage,
library personnel, requirements for new or expanded facilities
and any other library impacts /requirements anticipated as a
result of the contemplated development, including traffic flow.
(ff) Market Analysis and Economic Impact: Community Impact
Statements shall indicate the need for this type of project and
for additional private or public supporting facilities that may
arise as a result of the proposed development. Both the short-
term (e. g. during construction) and long-term economic implications
of the proposed project on the City and surrounding area of
Pinellas County shall be discussed.
(gg) Construction Scheduling: Community Impact Statement shall set
forth reasonably accurate construction completion schedules
for the proposed project.
(3)Review Procedures: Community Impact Statements will be received
and processed by the Planning Department. Reports will be submitted
to respective City departments to review and approve those areas that
come under their responsibility. A coordinated staff position will be
developed by the Resource Development Committee for submission to
the City Commission. Resolution of outstanding problem areas will be
the responsibility of the Resource Development Committee. Applicants
will be invited to attend when there are unresolved problem areas.

Section 4. All ordinances or parts of ordinances in conflict herewith

Section 5, Should any part or provision of this ordinance be declared ; by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the

provisions of this ordinance shall, upon conviction in the Municipal Court, be
fined not exceeding the sum of Five Hundred Dollars ($500, 00), or imprisonment
in the City Jail for not exceeding sixty (60) days or by both such fine and
imprisonment in the discretion of the Municipal Judge. Each day that a
violation is permitted to exist shall constitute a separate offense. '
Section 7, Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 8. The Planning Director is directed to include and set out and Y`

AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, AMENDING SUB-SECTION (i) OF SECTION
Z9 OF ARTICLE III, CITY MANAGER, OF THE CHARTER
OF THE CITY OF CLEARWATER, FLORIDA, TO INCREASE
THE DOLLAR AMOUNT OF PURCHASES WHICH MAY BE
MADE BY THE CITY MANAGER WITHOUT THE APPROVAL
OF THE CITY COMMISSION; PROVIDING FOR THE SEPA-
RABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:

Section 1, Sub-section (i), Purchasing Agent, of Section 29, Powers
and Duties, of Article III, City Manager, of the Charter of the City of Clearwater,
Florida, is hereby amended to read as follows:
(i) Purchasing agent. He shall be purchasing agent for the
City, and all purchases of supplies shall be made by him,
and he shall approve all vouchers for the payment of same.
In the capacity of purchasing agent he shall also conduct all
sales of personal property which the commission may authorize
to be sold as having become unnecessary or unfit for the City's
use. All purchases and sales shall conform to such regulations
as the City Commission from time to time may prescribe; but
in any case, if an amount in excess of $500. 00 be involved,
opportunity for competition shall be given; and in all cases of
purchases to be made involving an amount of $5, 000. 00 or more,
before such purchase is made the said City Manager shall first
obtain the approval of the Commission of such purchase.
Section Z. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 4, Notice of the proposed enactment of this ordinance has
been properly. advertised in a newspaper of general circulation in accordance

with Chapter 166. 041, Florida Statutes.
