indicate that fact as hereinafter set out:
Zoned as ISP - Institutional Semi-Public District
A. That portion of the East 360 feet of South 100 feet of
North 1090 feet of Government Lot Z, West of Bayshore
Boulevard, in Section 16, Township 29 South, Range 16
East, lying within 330 feet North of the centerline of
State Road 60.
B. That portion of Lot 7, Wm. Brown's Bayview Subdivision,
according to the map or plat thereof as recorded in Plat
Book 1, page 13 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly

Section 30. 07. Waterfront property setback.
Waterfront property setbacks are established in all zoning,
districts, other than RS ZOO, RS 100, RS 75, RS 50, RM 8
and RM 1Z (required of RM B and RM 12 when built as apartments).y
Open space requirements--Waterfront property.
(1) Definitions :
(a) "Waterfront property"--That upland property which
abuts the waterfront including all waterways and canals
on the Gulf of Mexico, Clearwater Harbor, Tampa Bay
and Cooper's Bayou up to six hundred sixty (660) feet in
depth from mean high tide or bulkhead line, and also must
abut a public right-of-way which runs approximately parallel
to the mean high tide line and is within six hundred sixty
(660) feet depth (distance). NOTE; In some cases property
may have frontage on the water but may not also abut a
public right-of-way parallel to the waterfront--thus it
does not afford the public an opportunity to be in a position
to see the waterfront through the subject property and is
not eligible for the bonus provisions of added height or
density.
(b) "Narrow parcel"-'-That upland property which is two hundred
and ninety-five (295) feet wide or less (mean width) measured
parallel to the roadway (which public roadway is generally
parallel to waterfront). See Drawing.
(c) "Wide parcel"--That upland property which is greater than
three hundred thirty (330) feet wide (mean width) measured
parallel to the roadway (which public roadway is generally
parallel to waterfront). See Drawing.
(d) "Overlap of structures "--Any dimension of one building
which is visually blocked by another building, when viewed
from a public street looking in a perpendicular direction
toward the waterfront (all on one parcel of ownership).

(e) "Transition dimension s0..-That mean width dimension which
is 296 feet to 329 feet Inclusive within which transitional
standards between the wide and the narrow parcel shall
prevail. See Drawing,
Also by amending sub-paragraph (d) of Subsection (2), General Criteria,
to read as follows:
(d) Transitional standards--On property that is between
two hundred ninety-six (296) feet and three hundred
twenty-nine (329) feet in mean width, the side yard
setbacks shall be as per the mean or mid-dimensions
between the lesser and the greater setbacks as per this
ordinance under narrow and wide parcels.
Also by deleting footnotes following Subsection (3) (d) (3) and amending Subsection
(3), Specific Setback Criteria, to add new sub-paragraphs (e) and (f) to read
as follows-
(e)Clear Space Requirement.
Only one side yard setback can be used for parking;
the other side yard setback to be clear space from
street to water, such clear space may be used for
driveways or parking below street grade.
For wide parcel side yard setback requirements,
a variation would allow meeting narrow parcel side
yard standards, provided the additional setback
differential is placed in spacing between buildings
on site and parallel to street.' However, the clear
space, as one continuous apace must be 200/6 of the
width of the property.
If a side yard has parking in plan of which the finished
elevation (grade) is a minimum of 3 feet below the
lowest point of the gutter or edge of pavement adjoining
and such drainage is approved by the City Engineer,
then such parking area (open space) may be considered
for meeting the clear space requirement.
Shrubs and berms within the clear space area (cone
of vision) shall not exceed thirty (30) inches in height.
(f) Property which is fronting on the water but does not
abut a public right-of-way road (approximately parallel
to the waterfront) thus not affording the public an
opportunity for public view, shall not be eligible for any
height or density bonus provisions.

forth, as follows:

Section 32. 01. General requirements.
The following fence heights apply to other than retaining t

(Z) Fences and wails, other than necessary retaining walls,
may exceed six (6) feet in height; but shall not exceed ten

any zoned district property other than residential; however,
this shall not permit the erection of the above height of fence .''

(3)Salvage or junk operations as an accessory and/or ti

(a) For secondary uses which meet junk yard/salvage yard
definition, the following conditions shall be met: On
any CP, CG, PRUG, CS or ML Zone, the entire area ,
occupied by a secondary salvage or junk operation shall
be screened by a continuous, attractive seventy-five
per cent (7556) opaque masonry, metal (not corrugated `•
sheet metal or other roofing materials), wood fence or `
wall, at a minimum of eight (8) feet in height. Such
fence or wall shall be without openings, except for f a
entrance and exit, which opening shall be equipped with
opaque gates. Supplemental planting shall be required 1

along the fence or wall on that portion abutting any
street right-of-way. Standards per Section 33. 09 (5) (a) "
shall apply, except that recognition shall be given to
beautification in the right-of-way. If this setback works N

(b) Such secondary use fencing shall be required of all
operations which require a business license to operate
in the City of Clearwater. All such operations shall be
so fenced prior to the next period of licensing and shall
be a requirement for license renewal after the date of
passage of this ordinance.
(4) (a) No occupancy permit shall be granted until all fences,
walls and screening are constructed as required.
(b) No license for business shall be granted until all fences,
walls and screening are constructed as required in CG,
PRUC, CS and ML within a two (2) year period of passage
of this ordinance.
(5) Barbed wire fences and fences built of potentially injurious
material (such as jagged metal or glass) and electric fences
are prohibited in residential used areas.
(6)All fences after the date of passage of this ordinance shall

legal location of'the proposed fence on site.
Section 7. Section 33. OZ, Definitions, of Article XXXIIX, Off-Street
Parking Requirements, of Appendix A, Zoning, of the Code of Ordinances of
the City of Clearwater, Florida, 1962, is hereby amended by amending the
second paragraph thereof relating to Floor Area and adding•a new definition
for Cross Leasable Area to read as follows:
Retail Floor Area. For the purpose of this ordinance "retail
floor area" in the case of offices, merchandising or service
types of uses shall mean the retail floor area. or space used or intended to be
used for service to the patrons or tenants, including areas used
for display or sale of merchandise.
Gross Leasable Area (GLA). The total gross floor area within
buildings which is occupied exclusively by individual tenants
and upon which the tenants pay rent.
Section S. Section 33. 04, Minimum Parking Space Requirements, of
Article XXXIU, Off-Street Parking Requirements, of Appendix A, Zoning,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by amending subsection (1), Table of Minimum Parking Spaces
Required to change title of right hand column from "Parking Spaces Required"
to "Parking Spaces or Area Required" and to amend requirements for
Shopping Centers to read as follows:

Shopping Centers There shall be a ratio of three (3)
square feet of parking area to each
one (1) square foot of gross leasable
area (GLA). The above parking area
shall include:
allocations for the car stalls
the moving aisles, access drives,
planting spaces and pedestrian walkways.
Section 9. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 10. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the

part declared to be invalid.
Section 11. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court, be
fined not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment
in the City Sail for not exceeding sixty (60) days or by both such fine and
imprisonment in the discretion of the Municipal Judge. Each day that a
violation is permitted to exist shall constitute a separate offense.
Section 12. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 13. The Planning Director is directed to include and set out and
show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 14. The provisions of this ordinance shall take effect immediately
upon its passage.
