Application, (1) The AL District shall be established upon all waters, including, but not limited, to basins, bays, bayous, canals, lakes, rivers, streams, waterways including waters of the Gulf of Mexico and all private and public submerged lands thereunder from mean high tide seaward or seaward from an established engineered bulkhead line and an upland area 30 feet landward of mean high water where mangroves (recognized of special ecological value to the City of Clearwater) are identified. (2) The aquatic land established under this section shall include the submerged bottom lands and the water column upon such lands as well as all publicly owned islands within the boundaries of the district. Special Exceptions Criteria: Requests for special exceptions to use any of the waters and submerged lands zoned AL for any uses other than the foregoing permitted uses may be made to the Board of Adjustment and Appeal on Zoning. Such requests shall be accompanied by evidence that the proposed use of any waters and submerged lands will: (1) Protect the right of thepublic to use and enjoy for recreational purposes of any of the waters or submerged lands affected; (2)Preserve grass flats and mud flats for breeding and spawning grounds for fish; (3) Not cause or contribute to erosion of waterfront properties; (4) Not create any alteration of water flow, accumulation of debris or creation of water pockets for incubation of "red tide"; (5) Demonstrate that adequate precautions are taken to prevent salt water intrusions into surface water tables; and (6) Display that there are proper provisions to be taken for protection of and access to existing or proposed navigable channels or basins. Section 29. 07. Riparian Rights and Property Improvements. Neither the establishment nor the management of the aquatic lands under the provisions of this section shall operate to infringe upon the t riparian rights of upland property owners adjacent to or within the District. Reasonable improvement for ingress and egress, mosquito control, shore protection and similar purposes may be permitted by the Trustees of the Internal Improvement Fund of the State of Florida, subject to the applicable provisions of the City of Clearwater. Section 17. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 18. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid.
