HEREOF AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, the City of Clearwater is experiencing an unprecedented
rate of new construction which, together with the resultant population and/or
commercial activity, places a severe demand on the City to serve the traffic ; .;
needs which accumulate from local streets on the various City collector and
arterial streets; and which demand necessitates new collector and arterial
road construction, widening of existing roads to collector and arterial
standards and improvement of storm drainage facilities; and
WHEREAS, when improvements are placed on vacant land, the VE NOWEV 1-61V
impervious surfaces at least double water runoff to feeder and primary
collection storm drainage systems, which systems will require substantial
additions and improvements; and
WHEREAS, because of these demands there will be required the

expenditure of substantial funds for the acquisition of collector and arterial y'
road rights-of-way, the construction of collector and arterial roads, side-
walks, curbs, drainage structures and signal :Installations; and

WHEREAS, the City of Clearwater feels that a per unit Development
Impact Fee should be established to be applied to all new residential structures, ffm & " "'
whether single family homes, apartments, condominiums or mobile homes,
and a per unit rate established to be applied to new commercial and industrial
structures on a square foot of floor area basis, which funds shall be deposited
in a. special account to be used exclusively for the construction of roads and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: II ?' y1 k. ' '' '
Section 1. Article I, In General, of Chapter 7, Buildings, of the Code '.. .5• a
of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended
by adding thereto a new Section 7-5. 1 to read as follows:; s;I ^. •'`' -t''`.. ;'„
Section 7-5. 1 Development Impact Fee.

certificate of occupancy, also pay a Development Impact Fee

New Residential Structures--single family, apartment,
condominium or mobile home - per unit - $250. 00

New Commercial Structures--$Z50. 00 for each Z, 500 square feet
of floor area or fraction thereof s.?
New Industrial Structures--$Z50. 00 for each 5, 000 square feet
of floor area or fraction thereof.
The funds derived from these fees shall be deposited in a special
account to be used exclusively for the construction of roads, public
transit facilities and storm drainage in the City of Clearwater,
including actual construction costs, acquisition of rights-of-way,
the construction of sidewalks, curbs, drainage structures and
signal installations.
Section Z. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this Ordinance shall be subject, upon conviction in the Municipal
Court to a fine not exceeding the sum of Five Hundred Dollars ($500. 00),tr fz41

or imprisonment in the City Jail for not exceeding sixty (60) days, or by '
both such fine and imprisonment in the discretion of the Municipal Judge.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4, Should any part or provision of this Ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the Ordinance as, a whole, or any part thereof other than the
part declared to be invalid..

Section 5. This ordinance shall become effective immediately upon
its passage-'and shall apply to all pending building permit applications which l'
were filed with the City of Clearwater Building Department on May 11, 1973,
or thereafter.
