WHEREAS, on May 22, 1972, and on June 5, 1972, the City ;
Commission of the City of Clearwater, after proper public notices, held
public hearings on certain proposed changes to the zoning ordinance and
zoning map of the City of Clearwater in accordance with procedure as
established, and
WHEREAS, certain of the proposed changes and amendments to
the zoning ordinance and zoning map were approved by the City Commision
after its evaluation of all evidence presented at the public hearing; ,

Section 1. Sub-paragraph (b) of Sub-section (51), Notice of
Article II, Definitions, of Appendix A, Zoning, of the Code or Ordinances s '

per net acre or fifty-one (51) hotel or motel units per net acre.
No new RM-34 High Density Multi-Family Use District may be
created which contains less than four-(4) acres.

Section 5. Section 16. 01, general description, Section 16. 02,
permitted uses and structures is amended to add a new sub-section (8), and

and Motel Use District, of Appendix A, Zoning, of the Code of Ordinances
of the City of Clearwater, Florida, 1962, are hereby amended to read
as follows:

district is tourist oriented with a permitted maximum density

No new CTF Commercial-Tourist Facilities Use District may
be created which contains less than four (4) acres.

Section 30. 06. Special Right of Way Setbacks.

(1) Notwithstanding the zone classification there shall be established
on the following streets a minimum building setback of ten feet
(101) from the existing right of way or forty feet (401) from the
centerline of the right of way, whichever is the greater. In
cases where the classification has a greater setback, such
zone district setback shall prevail.
Myrtle Avenue--Lakeview Road North to Garden Avenue.
Greenwood Avenue--Turner Street to Marshall Street.
Missouri Avenue --Belleair Road to Drew Street.
Highland Avenue--South City limit line North to Union Street.
(2) Notwithstanding the zone classification there shall be established
on U.S. Highway 19 from the northernmost City limits to the
southernmost City limits a minimum building setback of forty
feet (401) from the existing right of way. Such setback shall
also be established and required on all properties hereafter
annexed and which are abutting U. S. Highway 19 right of way
from the Clearwater City limits on the North to the Clearwater
City limits on the South.
Said Article XXX is further amended to add thereto a new Section
30. 11 to read as follows:
Section 30. 11. Churches--Conditional Uses
(1) Churches established prior to March 16, 1970, may expand
on existing ownership and subsequent abutting property, for
church and accessory uses only.
(2). Off-street parking use may be extended to existing ownership

The following off-street parking and loading space requirements
apply to all new building, additions or change of land use within
the City of Clearwater as of the date of passage of this amendment;
except that established uses can rebuild, if damaged (whole or part),
but not be enlarged within the Core CBD, without meeting the parking
requirements of this article, also, as long as they are not part of
assimilated acreage for enlarged or new development. If a block
area is damaged, redevelopment shall meet requirements contained
herein.]
Parking requirements for apartment usage in the Core CBD

Section 20. Any person or persons, firm or corporation or
association of persons, who shall violate or fail to comply with any of tk ' terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or
imprisonment in the City Jail for not exceeding sixty (60) days, or by both
such fine and imprisonment in the discretion of the Municipal Judge. Each
day that a violation is permitted to exist shall constitute a separate offense.
Section 21. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 22. The provisions of this ordinance shall take effect
immediately upon its passage.
