AND WATERWAYS, OF THE CODE OF ORDINANCES
OF THE CITY OF CLEARWATER, FLORIDA, 1962,
AND ENACTING A NEW CHAPTER 6, RELATING TO
BOATS, DOCKS AND WATERWAYS, PROVIDING FOR
THE ESTABLISHMENT OF DESIGNATED AREAS BY THE
CITY MANAGER OF CITY-OWNED DOCKING FACILITIES
FROM WHICH RENT IS TO BE OBTAINED AND PROVIDING
FOR ISSUANCE OF WRITTEN PERMITS ON A MONTH-
TO-MONTH BASIS AND FOR THE ESTABLISHMENT OF ALL
FEES, CHARGES, RULES AND REGULATIONS BY THE

WITH FEDERAL OR STATE REGULATIONS; AUTHORIZING
HARBORMASTER TO DESIGNATE MAXIMUM SPEED OF
BOATS AND TO DESIGNATE AREAS WHERE SPEED
SHOULD BE CONTROLLED; SETTING FORTH AREAS
WHERE OPERATION OF BOATS ARE PROHIBITED;
MAKING IT ILLEGAL TO OPERATE A BOAT IN A RECKLESS
OR NEGLIGENT MANNER OR UNDER THE INFLUENCE OF
INTOXICATING LIQUORS OR NARCOTIC DRUGS OR TO
TOW ANY PERSON ABOARD AN INFLATABLE TUBE;
PROHIBITING MOORING OR BEACHING OF BOATS ON

DOCK, WHARF OR PIER IN ADDITION TO ANY PERMITS
REQUIRED BY COUNTY, STATE AND FEDERAL AGENCIES;
PROVIDING RULES AND REGULATIONS IN ORDER TO
MINIMIZE WATER POLLUTION FOR CONTROL OF WATERFRONT
AND WATERCRAFT ACTIVITIES; PROVIDING THE DEFINITION
OF SHARK{ FISHING AND PROHIBITING SAME ON MANDALAY
PIER, BIG PIER 60 AND THE PUBLIC BEACHES OF THE CITY;
PROVIDING THE DEFINITION OF PUBLIC SOLICITATION AND
PROHIBITING SUCH SOLICITATION OF FARES OR PASSENGERS
FOR BOAT RIDES, FISHING PARTIES, EXCURSIONS, LAND
DEVELOPMENT PROMOTIONS OR OTHER SUCH ACTIVITY

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Chapter 6, Boats, Docks and Waterways, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed in
its entirety and a new Chapter 6 is hereby enacted to read as follows:
Chapter 6. BOATS, DOCKS AND WATERWAYS.
Seca 6-1. City-owned docking facilities--Property included,
permit required.
The City Manager or his designated representative is authorized
to designate specific areas from which rent is to be obtained
and to establish the specific use to be made thereof for the
following City-owned property: The City Dock located in
front of and due West of the City Auditorium, Island Estates
Marina Station, the Clearwater Marina, the Seminole Docks
and all other marine properties owned by the City. In
designating the use to be made where boat slips and docking
spaces are provided, division thereof shall be made for
pleasure craft and commercial craft; those areas set aside
for commercial craft shall be limited to the type of commercial
craft known and operated as "open party boats", "charter boats",
"excursion boats", and 'tsmall boats for hire". Written permits
shall be used which shall be uniform except as to rent to be
charged for different type spaces, and which shall contain the
conditions under which use is to be allowed. Such permits shall
be on a month-to-month basis only, except where specifically
excepted from such requirements by the City Manager or his
authorized representative. The City Manager or his duly
authorized representative shall establish monthly charges for
the use of the boat slips and docking spaces from which revenue
is to be received, which charges shall be uniform as to type of
space or services to be furnished, shall be established in writing,
shall be posted at the Marina Building on Clearwater Beach and
shall be effective seventy-two hours after written notice of a
change thereof has been so posted.
Sec. 6-2. City-owned docking facilities--Use without permit prohibited.
No person shall dock a boat of any kind or nature at any City-
owned boat slip or docking space for which charge has been
established for the use thereof, without first having paid for and
obtained a written permit for the use of the same.
Sec. 6-3. City-owned docking facilities--Motor vehicles prohibited.
No motor vehicle shall be allowed on any City-owned dock at
any time excepting only City-owned emergency vehicles and
others first having permission from the Harbormaster of the
city.

Sec. 6-4. CitX-owned docking facilities--Sale of petroleum products
thereon.
The City Manager shall have authority to designate locations on

or delivered except from said locations. The City Manager, or
his duly authorized representative shall establish prices for
petroleum products sold by it or from said property, which

Sec. 6-6. Rules and Regulations.,
r The Harbormaster, with the approval of the City Manager, is Fib
authorized and directed to establish written rules governing the x;
use of all City-owned marine facilities. Such rules may encompass
the areas of public safety, decency of conduct, unethical business ۥ
practices, and other areas wherein the safety and well being of the
public and the reputation of the City may be affected. '
Sec. 6-7. Authority of City to Regulate Waterways. ,
,? The City shall have the right to regulate the use of all waterways
within the City limits and the conduct of all persons using same,
consistent with and not in conflict with Federal or State regulations.

Sec. 6-9. Speed of boats--Posting areas. SIN,
The Harbormaster or, in his absence, the Chief of Police,
shall designate appropriate areas in the waters of Clearwater
Bay and the Gulf of Mexico in which areas it is reasonable
and appropriate that the speed of boats be controlled. The
Harbormaster or, in his $bsence, the Chief of Police, shall post or
cause to be posted in said areas the speed limit established for

Sec. 6=10. Boats, vessels, barges; where prohibited.
No person shall operate any type of boat, vessel or barge,
whether mechanized or not within a distance of five hundred
(500) feet from the shoreline of any public beach owned by the
City of Clearwater, along the Gulf of Mexico side of Clearwater
Beach, Florida, except when within the designated channel
-marked through Clearwater Pass, and except in case of an
emergency. (Florida Motorboat Law 371. 52Z)
Sec. 6'-11. Operating or docking boats while under the influence
.
of intoxicating li uors or narcotic drugs
It shall be unlawful for any person to operate or attempt to
operate any boat in any of the waters within the corporate limits
of the City while under the influence of intoxicating liquors or
narcotic drugs; or for any person to attempt to dock a boat at a
municipal dock while under the influence of intoxicating liquors
or narcotic drugs, or in a reckless or careless manner.
(Florida Motorboat Law 371.51)
Sec. 6-12. Careless operation of surfboards, boats, vessels and

No person shall operate any surfboard, boat, vessel, barge or other
craft, whether mechanized or not, in the waters within the City in a
reckless or negligent manner so as to endanger the life, limb or
property of any person. (Florida Motorboat Law 371.50). No person
or persons shall be towed aboard inflatable tubes or similar devices,
or any other device which, by reason of size, shape, or construction,
does not afford a safe degree of controllability.
Sec. 6-13. Mooring to private docks or beached without permission.
No vessel or watercraft of any kind whatsoever shall moor to or
tie up to a private seawall or dock or be beached upon private property
within the City limits without the permission of the owner thereof.
Sec. 6-14. Abandonment of boats; mooring so as to menace navigation.
It shall be unlawful for any person to abandon any boat or watercraft
in the public waterways within the corporate limits of the City or to
moor the same in such manner as to cause such watercraft to become
a menace to navigation.
Sec. 6-15. Muffling devices required.
The exhaust of every internal combustion engine used on any vessel
shall be effectively muffled by equipment so constructed and used as
to muffle the noise of the exhaust in a reasonable manner. The use
of cutouts is prohibited, except for vessels competing in a regatta
or official race, and for such vessels while on trial runs. When
permitted under this section, the no level attained through use of
cutouts or similar devices shall not be of sufficient volume as to
unreasonably disturb or inconvenience the general public or residents
of adjacent areas. (Florida Motorboat Law 371. 56)

Sec. 6-17. Unsightly or badly deteriorated boats prohibited,
(a) No vessel or watercraft of any kind whatsoever which is
of unsightly appearance or in badly deteriorated condition, or
which is likely to damage docks or other vessels, or which might
become a menace to navigation shall be permitted to moor or tin
up at any dock within the City limits; such vessels or watercraft
in such condition are hereby declared to be a public nuisanco.
(b)' The City Manager, or his designated representative, shall
determine whether any such watercraft is of unsightly appearance
or in a badly deteriorated condition, and if found no to be, niuill
take steps to compel the repair or removal of same.
(c) Where such action is necessary in the performimce of hie
duties under this chapter, the City Manager, or his designated
representative, shall have authority to remove any boat from it,
moving, or causing the same to be removed, to a bunt yard or
to a public dock. The owner of said vessel shall ba assesnad all
charges accruing from such action.
Sec. 6-18. Houseboats--Defined.
A houseboat is defined as any boat used as a dwelling.

Sec. 6-19. Houseboats--Anchoring or mooring at other than
licensed facilities or private docks.
The rules contained in this section shall apply to all boats being
used as a temporary or permanent abode. The intent of this
section is to prevent unrestricted anchoring or mooring of
houseboats within the waters of the City.
(a)• Any houseboat as defined herein moored or anchored within
the water of the City of Clearwater for any period in excess of
seventy-two (72) hours or intended to be so moored or anchored
shall require permission of the Harbormaster.
(b)! The language of this section shall not be so construed as
to prohibit any boat from occupying available space within the
waterways of the City during a period of time reasonably necessary
for protection of the boat from inclement weather conditions.

The indiscriminate use of searchlights, horns, whintlee, or belle
on any watercraft within the corporate limits of the City is prohibited,

Sec. 6-20. Public anchora e.
Public anchorages within the City limits may bo established
or designated only by the City Manager, or his authorized
representative. Therefore, except as provided under Section
6-19 (d), and, except as further provided hereunder, the
establishment o£'permanent floating mooring devices, or ilia
anchoring of vessels in the waters of the City on a permanent
or semipermanent basis in lieu of mooring at a dock or
similar facility, is prohibited.
Public anchorages may be designated by the City Manager, or
his authorized representative, in which areas floating mooring
devices may be established by the City or by private parties,
at the option of the City. Establishment or use of such a device
will require a permit from the City, for which reasonable charges
may be assessed, and no such device shall be established or
used prior to issuance of such permit.
Sec. 6-21. Regattas, races, marine parades, tournaments
or exhibitions --Permit required. ?
Any person directing the holding of a regatta, tournament or marine
parade or exhibition, shall secure a permit from the City when such
event is held in waters within the City limits. A person directing
such affairs shall apply to the City Manager for a permit at least
thirty (30) days prior to the scheduled date of any event. Safety,
noise level and public convenience will be considered in allowing or
refusing permits for such affairs. The issuance of such a permit
shall not relieve the applicant of the responsibility for securing
such additional permits as may be required by the U.S. Coast Guard
or other agency having jurisdiction. (Florida Motorboat Law 371. 55)
Sec. 6-22. Dock construction on waterways.
In addition to such permits as may be required by County, State
and Federal agencies, a building permit shall be obtained from
the City Building Inspector prior to construction of any dock, wharf,
pier, or similar structure abutting the waterfront of the City.
Application shall be made in accordance with established procedures.
Sec. 6-23. Water pollution--Control of waterfront and watercraft

The rules contained in this section shall apply to all watercraft
operated or moored within the corporate limits of the City,
and to all properties abutting or bordering upon the waterfront
of the City.
(a) No garbage, trash, litter, or other debris, shall be thrown
overboard from any vessel while moored or underway within
the limits of the City.
(b) The operators of vessels carrying passengers for hire
will be responsible for the actions of passengers and crew in
respect to the rules of this section. Warning signs advising
of the content of this ordinance, and/or penalties prescribed
therefor shall be conspicuously posted in each vessel, and
each vessel shall be equipped with such trash and garbage
receptacles as necessary to contain accumulations of such
materials during cruises.

Mandalay Pier, Big Pier 60, the public beaches of the City,
and elsewhere in close proximity to public swimming areas

Sec. 6-25. Public Solicitation--prohibited.
(a) Public solicitation is defined as the accosting of passers-by,
visitors, or other members of thepublic in the attempt to sell or
promote any service, product or other merchandise. The act
of solicitation may include verbally accosting or passing out
handbills, cards, or other advertising literature.
(b) Solicitation of fares or passengers for boat rides, fishing tE"
parties, excursions, land development promotions, or other
such activity is prohibited upon any City marina premises, the »i
public beaches, the docks, piers, sidewalks, parking lots,
streets, or any other public place within the City of Clearwater. E
Section 2. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon, conviction in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500.00•),
or imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.

are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
