AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, REPEALING SECTIONS 9-10, 9-10. 1,
9-10.2, 9-10.3, 9-10.4 AND 9-10.5 IN THEIR ENTIRETY,
RELATING TO FIRE PREVENTION CODE, OF THE CODE
OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, AND ENACTING NEW SECTIONS 9-10,
9-10. 1, 9-10. 2, 9-10. 3, 9-10.4 AND 9-10. 5 TO ADOPT
THE FIRE PREVENTION CODE, 1970 EDITION THEREOF,
PRESCRIBING REGULATIONS GOVERNING CONDITIONS
HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR
EXPLOSION, EXCEPT CERTAIN PORTIONS WHICH ARE
HEREINAFTER DELETED, MODIFIED OR'AMENDED;
PROVIDING A PENALTY FOR FAILURE TO COMPLY
THEREWITH; PROVIDING FOR REPEAL OF ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO
THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 9-10, Fire Prevention Code--Adapted, of the Code
of Ordinances of the City of Clearwater, Florida, 1962, is hereby repealed
in its entirety and a new Section 9-10 is enacted to read as follows:
Section 9-10. Fire Prevention Code--Aopted.
There is hereby adopted by the City of Clearwater, Florida, for the
purpose of prescribing reguia.tiona governing conditions hazardous to life
and property from fire or explosion, that certain code known as the Fire
Prevention Code recommended by the American Insurance Association,
being particularly the 1970 edition thereof and the whole thereof, save and
except such portions as are hereinafter deleted, modified or amended by
Section 3 of this ordinance, of which code three (3), copies thereof are now
and have been for the last preceding ten (10); days on file in the office of the
City Clerk of the City of Clearwater, and the same are hereby adopted and
incorporated by reference as fully as if set out at length herein as authorized
by Section 165. 191, Florida Statutes, and from the effective date of this
ordinance shall take effect, the provisions thereof shall be controlling within
the limits of the City of Clearwater, Florida.

b. Whenever the term 'Corporation Counsel' is used in the Fire Prevention
Code, it shall be held to mean the Attorney for the City of Clearwater, Florida. {{=' :•
c. Whenever the term "Bureau of Fire Prevention!' is used in the Fire
Prevention Code or this ordinance it shall be held to mean the Bureau of Fires" ¢?'?+#?++'',r';
Prevention, the Fire Prevention Division of the Fire Department of the City of
Clearwater, or any equivalent thereof.
Section 3. Section 9-10.2, Fire Prevention Code--Amendments, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
repealed in its entirety and a new Section 9-10. 2 is enacted to read as follows:
Section 9-10.2. Fire Prevention Code--Amendments.
The Fire Prevention Code recommended by the American Insurance
Association, being particularly the 1970 edition thereof, is amended and
changed in the following respects:
Article 1, General Provisions:
Sub-paragraph a of Section 1. 4, Inspection of Buildings and Premises,
is amended to read as follows:
a.. It shall be the duty of the chief of the fire department to
inspect, or cause to be inspected by the bureau of fire prevention,
or by the fire department officers or members, all buildings and
premises as often as may be necessary for the purpose of ascertaining
and causing to be corrected any conditions liable to cause fire,
endanger life from fire, or any violations of the provisions or
intent of this code and of any other ordinance affecting the fire hazard.
Article 11, Exit Ways, Maintenance -of:
Section 11. 2, Marking of Exit Ways, is amended by adding thereto
a subsection (c} to read as follows:
(c)All exit sighs shall be of a distinctive red color and shall pro-
vide contrast with decoration, interior finish and other signs.
Lettering of internal exit signs shall be a minimum of 4-1/2 inches
high and 3 /4 an inch wide. Lettering of external exit signs shall
be a minimum of 6 inched high and 3/4 an inch wide.

Article 13, Fireworks:
Section 13. 2, Definition, is amended to read as follows:
(a) The term fireworks shall mean and include any combustible
or explosive composition, or any substance or combination
of substances, or, except as hereinafter provided, any article
prepared for the purpose of producing a visible or an audible
effect by combustion, explosion, deflagration or detonation,
and shall include blank cartridges and toy cannons in which
explosives are used,' the type of balloons which require fire
underneath to propel the same, firecrackers, torpedoes,
skyrockets, roman candles, dago bombs and any fireworks
containing any explosives or flammable compound or any
tablets or other device containing any explosive substance.
(b}The term fireworks shall not include sparklers, toy pistols,
toy canes, toy guns, or other devices in which paper caps
containing twenty-five hundredths grains or less of explosive
compound are used, providing they are so constructed that
the hand cannot come in contact with the cap when in place
for the explosion, and toy pistol paper caps which contain
less than twenty hundredths grains of explosive mixture, the
sale and use of which shall be permitted at all times.
Article 21, Liquefied Petroleum Gases:
Section 21.3, Permits and Reports of installations, is amended
to read as follows:
(a) A permit shall be obtained for each installation of
liquefied petroleum gas employing a container of over
499 gallons water capacity, and for each permanent
installation, irrespective of size of containers, made at
buildings in which people congregate for civic, political,
educational., religious, social or recreational purposes.
Such buildings shall include schools, churches, hospitals,
institutions, hotels and restaurants, each having a capacity
of 20 or more persons.

(b)A permit shall also be required for storage, piping and
distribution systems which are installed in trailer parks, mobile
home parks and subdivisions. Where the nature of adjoining occupancy,
' proximity of adjacent buildings or unusual conditions indicate the
need, the chief of the bureau of fire prevention may require the
submittal of plans to the bureau of fire prevention prior to making
the installation and if compliance with the requirements of this
code is shown by said plans, a permit shall be issued.
;(c)Installers shall maintain a record of all installations for
which a permit is not required by Section 21. 3 (a). (but not
including installation of gas burning appliances and replacing
of portable cylinders) and have it available for inspection by
the bureau of fire prevention.

Section 21. 6, Location of Containers, is amended by deleting sub-
section (b) thereunder in its entirety,
Article 28, Precautions Against Fire, General:
Section 28. 1, Bonfires and Outdoor Rubbish Fires, is amended
to read as follows:
(a)-Permit required. No person shall kindle or maintain •
any bonfire or rubbish fire or authorize any such fire to
be kindled or maintained on or in any public street, alley,
road or other public or private property within the corporate
limits of the City of Clearwater without first obtaining a
permit or other proper authorization from the Clearwater
Fire Department. During construction or demolition of
buildings or structures no waste materials or rubbish shall
be disposed of by burning on the premises or in the immediate
vicinity without having obtained a permit or other proper
authorization.
(b) Location restricted. No person shall kindle or maintain
any bonfire or rubbish fire or authorize any such fire to be
kindled or maintained on any private land unless (1) the location
is not less than fifty (501 feet or some other distance approved
by the Clearwater Fire Department from any structure and
(Zj adequate provision is shade to prevent fire from spreading
to any structure.
(c)Attendance of open fires. Bonfires and rubbish fires shall
be constantly attended by a competent person until such fire
is extinguished. This person shall have a garden hose connected
to the water supply, or other fire extinguishing equipment
readily available for use.
(d) Chief may prohibit. The chief of the fire department may in
his discretion prohibit any or all bonfires and outdoor rubbish
fires when atmospheric conditions or local circurnstances make
such fires hazardous or constitute a public nuisance.
Section 4. Section 9-10.3, Fire Prevention Code--Modification by
Officials, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby repealed in its entirety and a new Section 9-J0.3 is enacted to
read as follows:
Section 9-10.3. Fire Prevention Code--Modification by officials.
The chief of the bureau of fire prevention, or the fire prevention
division of the fire department, or any equivalent thereof, shall have power
to modify any of the provisions of the Fire Prevention Code upon application in
writing by the owner or lessee, or his duly authorized agent, when there are
practical difficulties in the way of carrying out the strict letter of the code,

The city manager, the chief of the fire department and the chief of the
bureau of fire prevention shall act as a committee to determine and specify,
after giving affected persons an opportunity to be heard, any new materials,
processes or occupancies, which shall require permits, in addition to those
now enumerated in said code. The chief of the bureau of fire prevention shall
post such list in a conspicuous place in his office, and distribute copies thereof
to interested persons.
Section-6. Section 9-10.5, Appeal from denial of permit or decision
based on Fire Prevention Code, of the Code of Ordinances of the City of
Clearwater, Florida, 1962, is hereby repealed in its entirety and a new
Section 9-10. 5 is enacted to read as follows:
Section 9-10. 5. Appeal from denial of permit or decision based
on Fire Prevention Code.
Whenever an application for a permit is denied or when it is claimed
that the provisions of the code do not apply or that the true intent and meaning
of the code have been misconstrued or wrongly interpreted, the applicant may
appeal, in writing, from the decision of the chief of the fire prevention bureau
to the city commission within thirty (30), days from the date of the decision
appealed. ,

affirmed or modified by the City Commission or by a court of competent
jurisdiction, within the time fixed therein, shall severally for each and every
such violation and noncompliance respectively, be guilty of a misdemeanor, LL.Y,1y?
punishable by a fine not exceeding Five Hundred Dollars ($500. 00) or by
imprisonment for a term not exceeding sixty (60) days or by both such fine J.-

and imprisonment. Each day's continuance of any violation of any provisions
of said Code shall constitute a separate offense. The imposition of one
penalty for any violation shall not excuse the violation or permit it to continue;
and all such persons shall be required to correct or remedy such violations
or defects within a reasonable time.
Section B. All formes ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the code hereby adopted
are hereby repealed.
Section 9. Should any section, paragraph, sentence or word of this
ordinance or of the code, as amended, hereby adopted be declared for any
reason to be invalid, the same shall not affect the validity of the ordinance or
code, as amended, as a whole, or any part thereof other than the part declared
to be invalid.
Section 10. This ordinance shall become effective immediately upon
its passage.
