ORDINANCE NO, 1316
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 26, AS AMENDED, PERTAINING TO
ZONING, OF THE CODE OF ORDINANCES, CITY OF CLEAR-
WATER, FLORIDA, 196x, TO ESTABLISH BUILDING SET-
BACKS FOR WATERFRONT PROPERTIES AND TO PROVIDE
OPEN SPACE REQUIREMENTS FOR WATERFRONT VISTAS
AND AIRSPACE IN ALL ZONES OTHER THAN R- IA, B, C,
D, E AND R-Z ZONESW PROVIDING FOR REPEAL OF ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT HERE-
WITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE,
WHEREAS, on November 9, 1970, the City Commission of the City
of Clearwater, Florida, after proper public notice, held a public hearing on ,
certain proposed changes to the zoning ordinance of the City of Clearwater
in accordance with procedure as established, which public hearing was con-
tinued until March 15, 1971, and thereupon completed; and
WHEREAS, certain of the proposed amendments to the zoning ordinance
were approved by the City Commission after its evaluation of all evidence
presented at the public hearing; and
WHEREAS, apartment, motel, hotel and other structural development
on waterfront in the City of Clearwater and in other water-oriented communi-
ties has tended to erect barriers to public view of the waterfront; and
WHEREAS, waterfront view and airspace are fast becoming a luxury
item reserved for only those of more prosperous means, thus depriving
a• large segment of the public from these views and airspace; and
WHEREAS, waterfront view and airspace has been, is and will con-
tinue to be the main attraction to tourists, a major sector of the City of
Clearwater economy; and.
WHEREAS, waterfront view and airspace are a major cause for
persons choosing to settle in the Clearwater area, thus a factor in con-
tinuing urban growth and vitality; and

Section Z. Section 26-11, Location, Height and Area Regulations—
Setbacks, lot size, height, area, of Code of Ordinances, City of Clearwater,
Florida, 1962, is hereby amended to add thereto a new sub-section (16) to
read as follows:
(16) Open Space Requirements - Waterfront Property
A. Definitions:
1, Waterfront Property: That upland property which abuts the
waterfront including all waterways and canals on the Gulf
of Mexico, Clearwater Harbor, Tampa Bay and Cooper's
Bayou up to 660 feet in depth from mean high tide or bulk-
headline or that upland property from. mean high tide
to the nearest right of way parallel to the waterfront (as defined),'
whichever is the lesser dimension from the waterfront.

2. Narrow Parcel: That upland property which is 330 feat wide or
less (mean width) measured parallel to the roadway (which
public roadway is generally parallel to waterfront).
3. Wide Parcel: That upland property which is greater than 330
feet wide (mean width) measured parallel tp, the roadway (which
public roadway is generally parallel to waterfront).
4. Overly of Structures: Any dimension of one building which is
visually uiocked by another building, when viewed from a public
street looking in a perpendicular direction toward the waterfront
('all on one parcel of ownership).
B. General Criteria:
1. Any parcel of waterfront property (as defined') shall conform,to
the waterfront setback requirements for the total parcel if said
parcel has 5016 or more street frontage generally parallel to the
waterfront; waterfront properties with less than 500/6 street
frontage generally parallel to the waterfront shall meet partial
application requirement for that portion of the property which
has such parallel street frontage, i. e. 1/4 of tract street
frontage - 1/4 of total application of total tract requirement.

2. Maximum Length of Building: 250 feet (This includes all deck
areas and enclosed and covered walks.).
3.. Minimum Distance between Buil in s nterior of Lot
(a). Measured parallel to street as described above)

For Low Rise (defined as one and two story structures): 20
feet or 2 times zone classification side setback, whichever
is greater.
For Medium and High Rise (defined as three or more story
structures): 1/4 of total of height of both buildings, but no
less than 20 feet.

*Only one side yard setback can be used for parking; the other
side yard setback to be clear space from street to w,ter, such
clear space may be used for driveways or parking below street grade.
**For wide parcel side yard setback requirements, a variation would
allow meeting narrow parcel side yard standards, provided the
additional setback differential is placed in spacing between buildings
on site and parallel to street.
D.Affected Waterfront Property Exceptions.
(1)On defined narrow parcels, exceptions--20%6 increase
in density (number of dwelling unite) when residential,
above zone maximum, and 205o increase in floor area or
height (where applicable) used for non-residential purposes;
(2)On defined wide parcels, exceptions--10% increase in
density (number of dwelling units) when residential, above
zone maximum, and 10°16 increase in floor area or height
(where applicable) used for non-residential purpose; and
(3) On defined transitional parcels, exceptions--15% increase
in density (number of dwelling units)' when residential,
above zone maximum, and 1516 increase in floor area or
height (where applicable) used for non-residential purpose.
E. Exclusions: All single family and duplex zoned property is exempted
from compliance with the terms and requirements of this section.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500. 00)', or
imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
