BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER* FLORIDA:
Section 1. Section 7-1 (al of Chapter 7, pertaining to Buildings,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is
hereby amended to read as follows:
Sec. 7-1. Southern Standard 13izilding Code--Adopted.
(a) Therf) is hereby adopted by the City of Clearwater,
Florida, that certain code known as the Southern
Standard Building Code, 1969 Edition, and the 1970
Revision to the 1969 Edition, as adopted by the
Southern Building Code Congress, and the whole
thereof, save and except such portions as are
hereinafter deleted, modified or amended by Sections
2, 3 anti 4 of this ordinance, of which code three (3)
copies thereof are now and have been for the last
preceding ten.(10) days on file in the office of the City
Clerk of the City of Clearwater, and the same are
hereby adopted and incorporated by reference as fully
as if set out at length herein as authorized by Section
165. 191, Florida Statutes, and from the effective
date of this ordinance shall take effect, the provisions
thereof shall be controlling within the limits of the City
of Clearwater, Florida. .
Section 2. Section 7-2 of Chapter 7, pertaining to Buildings, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to read as follows:

Sec. 7-2. Southern Standard Building Code--Amendments.
The Southern Standard Building Code,. 1969 Edition, and they ' 1r +
1970 Revision to the 1969 Edition, as adopted by the Southern ''t4rs?F;''t •,?,.
Building Code Congress, is amended and changed in the
following respects:
Section 103. 4. Unsafe Buildings, is amended to amend
sub-section (1) and to add new sub-sections (7), (8), (9) and F:,;•.:•
(10), to read as follows:

(1) Whenever the Building Official shall find any building or
structure or portion thereof to be unsafe, as defined in this
section, he shall, in accordance with established procedure'
for legal notices, give the owner, agent, or person in control
of such building or structure written notice stating the defects
thereof. This notice shall require the owner to commence

improving or repairing said defects within fifteen (15) days
and complete the improvements and repairs within forty-five
? y. ;.
(45) days, and further if said owner fails to commence im-
proving or repairing the premises within the stated time, r.
then said building or structure should begin to be demolished
or removed, together with the debris therefrom, within fifteen
(15) slays. f;
(7) If the occupant or the owner of a building fails to comply 4
with the written notice of the Building Official to repair,
alter or improve, or to vacate or close a building, or to
remove or demolish the dwelling or building in accordance
with the terms thereof, or fails to comply with the decision .:'
of the Building Board of Adjustment and Appeals if the ;
decision of the Building Official is appealed to said Board,
then written notice of said failure shall be furnished by the ;
Building Official to the City Commission. Thereafter the {
City Commission shall give notice of a scheduled public a
hearing by publication in some newspaper published in the ,.
City, once a week for at least two (Z) weeks, the first
publication to be at least ten (10) days prior to the hearing 7
provided therein, and shall also mail a notice of the scheduled K=
public hearing by certified mail, return receipt requested,
to the occupant at the street address of the property,and to =•
the owner of the property addressed as indicated on the current _
tax roll of Pinellas County, Florida. Said notice shall require
all persons interested to show cause why the occupant or the ?p
owner or both should not comply with the order of the Building #
Official or the decision of the Building Board of Adjustments
and Appeals.
(8) If at the public hearing designated in the notice no objections
x?
are filed or presented, or if objections filed or presented
shall be deemed insufficient by the City Commission, it shall
then by resolution order that said repair, alteration or im-
provement, or vacation or closing of said building, or the ?.
removal or demolition of said building or dwelling, be completed
by the occupant or owner thereof within thirty (30).days after
the passage and adoption of said resolution. If the occupant
or owner of the property fails to comply with said resolution
in accordance with the terms thereof, the City Commission shall

cause the correction, repair, alteration or improvement,
or vacation or closing of said building, or the removal or
demolition of said building or dwelling, to be done in accordance
with the requirements of the Southern Standard Building Code
and shall charge upon those benefitted thereby such special
assessment of necoseary costs incurred as. may be determined
by the City Commission and provide that such assessment be
a lien upon the real estate improved.
(9)' The City Commission as soon as practicable after the
assessment against the real estate improved is made, shall
issue a certificate of indebtedness against the property assessed
for the amount of the assessment, which certificate shall
contain a description of the land, the amount of the assessment
and a statement of the general nature of the improvement for
which the assessment is made, which certificate shall constitute
and be a prior lien to all other liens except the lien for taxes.
A notice of lien setting forth said information shall be filed
against the assessed property in the Public Records of Pinellas
County, Florida. The,. certificate shall be payable to bearer
in not exceeding ten (10), equal annual installments, with interest
at a rate not greater than eight per cent (81o): per annum, payable
annually; and the payment of said certificate, with interest as
specified, shall be guaranteed by the City of Clearwater, and
in case of nonpayment of annual interest, or the principal at
maturity, by the property owner, then the same sha.ll be redeemed
by the City at the option of the holder of such certificate; but
such redemption by the City shall not discharge the lien of such
assessiner_t or certificate against the assessed property. The
certificate when issued shall be turned over to the City Treasurer,
who, when so ordered to do by the City Commission, shall sell
or dispose of 'the sane in such manner as may be provided by the
City Commission, in payment for such work or improvement, or
for cash.
(10) If the certificate of indebtedness or the annual installments
of interest or principal are not paid when due, the City or the holder
of such certificate shall have the option to declare the whole of
such certificate immediately due and payable, and may institute
suit thereon or foreclose the same. In cases where suits are
instituted, the City or the holder of such certificate shall be
entitled to all costs of collection, including a reasonable attorney's
fee, and the same shall be a lien of equal dignity against the
property against which the said certificate is issued.
Section 112, Appeals, is amended by repealing sub-section (b)"
hereunder and enacting a new sub-section (b), to read as follows:
(b). The time for taking of such appeals is limited to a period of
fifteen (15)` days after the decision is rendered by the Building
Official. Appeals hereunder shall be on forms provided by
the Building Official. A fee of Ten Dollars ($10. 00)' shall
accompany such notice of appeal.

Section 113. 2, Decisions, is amended by amending sub-section (a)
hereunder to read as follows:

(a) Every decision of the Building Board of Adjustments and
Appeals, except as herein otherwise set out, shall be final, i i,• ;'?:{:''°..; ::;

subject, however, to such remedy as any aggrieved party
might have at law or in equity. It shall be in writing and
shall indicate the vote upon the decision. Every decision
shall be promptly filed in the office of the Building Official,
and shall be open to public inspection; a certified copy shall c:e
be sent by mail, or otherwise to the appellant and a copy shall ^? :,._ •'1; ;,
be kept publicly posted in the office of the Building Official for
two weeks after filing. All decisions of the Building Board ' ',;:.;YY?'• r}" t r` `.
of Adjustments and Appeals pertaining to the subject of unsafe
buildings may be appealed to the City Commission in accordance
with the procedures as outlined in Sec. 103. 4 of this Code.

Section 504, Temporary Structures, is amended by amending Section
504. 1, Pcrmit, to read as follows:;
504.1 - PERMIT
A special building permit for a limited period of time must
be obtained before the erection of Temporary Structures as: :I
(a) Construction sheds and construction field or project offices. "r
(b) Fences used in connection with construction work.
(c) Temporary sales and model structures showing the units
to be available in a duly authorized construction project.
1. Temporary Trailer Sales Offices, Used Car Sales
Offices and Parking Lot Buildings, which must have
a minimum clearance from other buildings of 20 feet
on all sides.
Sales Offices and Parking Lot Buildings shall be
limited in size to 200 square feet.
(d) Seats, canopies and tents.
OR for temporary purposes such as reviewing stands.
Such special building permits shall not be approved and issued
without first obtaining the written approval of the following
municipal departments:
(a) Fire Department
.{b)'' Engineering Department
(c) Building Department
Such special building permits shall require the structures be
completely demolished or removed from the specified premises
upon the expiration of the time limit stated in the permit or
upon the expiration of any duly authorized extension thereof.

The Building Official, as a condition precedent to the
issuance of such a special building permit, may require the
applicant to execute and deposit with him a cash or surety bond
in an amount not to exceed fifty per cent (5016), of the valuation
of the proposed temporary structure. Such bond shall be made
payable to the City and shall be conditioned upon and liable for
strict compliance with the terms of the special building permit
as issued and the proper and timely demolition or removal of
the temporary structure at the expiration of the period specified
in the permit or any authorized extension thereof. °, •..F-'.'`'. L.,; .

The bond shall provide that if the temporary structure is not
demolished or removed at the expiration of the authorized period
of time that the City or its representatives, without subjecting JMLw?.6{?;
themselves to liability therefor, may immediately enter upon !µ?''=M'w-' '
said premises and have the structure demolished or removed
from the premises. All reasonable expenses incurred by the r?
City in connection with the demolition or removal of said K `
structure shall be summarily recoverable by the City from said

cash or surety bond previously posted by the applicant.
Section 2204, Moving of Buildings, Sub-sections 2204. 1, 2204.2 u : ,k•
and 2204.3 are amended to read as follows:
2204. 1--General.
No building or part of any building shall be moved through or
across any sidewalk, street, alley or highway within the govern-
mental limits without first obtaining a permit from the Building
Official, which permit shall provide that no work shall be
commenced until the expiration of the appeal period. provided
in Section 2204. 3 below.
2204. 2--Written Application Must be Filed.
Any person desiring to move a building shall first file with the
Building Official a written application, together with a fee of
Ten Dollars ($10. 00), setting forth the following information:
(a) Type and kind of building to be moved.
(b) The original cost of such building.
(c) The extreme dimensions of the length, height and width of
the building.
(d) its present location and proposed new location by lot, block
subdivision and street numbers.
{e) The approximate time such building will be upon the streets,
and the contemplated route that will be taken from present
to new location.
4f) The names and addresses of all property owners within
250 feet of the proposed new location of said building,
provided that new location is located within the confines
of the City of Clearwater.
Upon receipt of an application to move a building, the Building
Official shall mail a'notice of said application to the owners of
all properties situated'within 250 feet of the subject property.
All such notices shall be sent by mail to the last known names
and addresses as indicated on the tax roll of Pinellas County,
Florida.

2204.3--Building Official Shall Reject When "? `•i
(a) If in the opinion of the Building Official, the moving of any
building will cause serious injury to persons or property or
serious injury to the streets or other public improvements,
or the building to be moved has deteriorated more than fifty :, '• ;.:'w;v`+'
per cent of its original value by fire or other element, or if
the moving of the building will violate any of the requirements ; ?. w; e,:4?h4=4`:
of this Code or of the Zoning Regulations, or if the building
to be moved is a residence and if in the opinion of the Building r - :t;s'"""'!' r,? ;!`:•
Official said residence does not conform with the general
architectural design and construction of other residences
presently situated within 250 feet of the proposed new location
of said residence, the permit shall not be issued and the
building shall not be moved over the streets.

(b) Any building being moved for which permit was granted shall }1Y` ..

not be allowed to remain in or on the streets for more than yy4,,fi
forty-eight (48): hours.
(c) No permit for the moving of any building shall be issued by

the Building Official until said written application has been
on file with him for a minimum period of seven (7) days after
the filing of such application to allow the Building Official
to give written notice of said application to all property
owners within 250 feet of the proposed new location of
said building.
(d) Any person, firm or corporation desiring to appeal any
decision of the Building Official in granting or denying any
permit for the moving of any building may appeal such
decision to the Building Board of Adjustments and Appeals.
Such appeal shall be taken by filing written notice thereof
in duplicate with the Building Board of Adjustments and
Appeals within two days after the date of the decision of F
the Building Official. The Building Board of Adjustments
and Appeals shall have the power, after due notice to the ?
appellant, the applicant and all property owners within 250
feet from the proposed location of said building, to hold a u
hearing from said appeal at which any party may appear in
person or by attorney or by designated representative. The • rF?,f
hearing so held shall be de novo. The Building Board of ,F
Adjustments and Appeals shall have the power after notice
and hearing as aforesaid, to reverse any decision of the
Building Official in granting or rejecting any application a;
for moving any building when it feels that said application
properly complies with all the requirements of Section
2204.3 or there is a hardship involved.
(e) Any person adversely affected by a decision of the Board,
or any officer, department director, board or bureau of
the City may appeal such decision to the City Commission.
Such appeal shall be taken by filing written notice thereof,
in duplicate, with the City Clerk within ten days after the

decision of the Board. The City Clerk shall forthwith
transmit one copy thereof to the Secretary of the Board, who
shall then forthwith transmit to the Clerk for the use of the y

which the acti6n appealed from is taken. The City Commission
shall, after due notice to the appellant, the applicant and
all property owners within 250 feet from the proposed location
of said building, not less than twelve days and not more than
forty-five days after the filing of an appeal hold a public
hearing thereon and promptly render its decision. At the''
hearing any partymay appear in person or by attorney or by
delegated representative. The hearing before the Commission
shall be de novo. The City Commission shall have power, after
due notice and hearing as aforesaid, to reverse any decision
of the Board in granting or rejecting any application for moving
any building when it feels that said application properly complies
with all the requirements of Section 2204.3 or there is-a
hardship involved. The decision of the City Commission shall
be superior to that of the Board and shall be binding upon all
concerned subject only to the court review as provided by law.
Section 3. Sub-section (b) of Section 7-1 of Chapter 7, pertaining to
Buildings, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby amended to read as follows:
(b), The Southern Standard Building Code, 1969 Edition ,
and the 1970 Revision to the 1969 Edition, as adopted
by the Southern Building Code Congress, is adopted in
all other respects except Chapter XXIII, Section 114,
Section 107.4 and any other sections pertaining to permit
fees, which portions are hereby excluded. Permit fees
shall be charged as now provided or as may hereafter
be provided by ordinances of the City of Clearwater.
Section 4. Section 7-1 of Chapter 7, pertaining to Buildings, of the
Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended by adding a new Sub-section (c) to read as follows:
(cam) Appendix D, Hurricane Requirements, and Appendix E,
Sound Isolation, are hereby adopted and made a part of
the official building code of the City of Clearwater and all
construction and alterations of any structure within the
City of Clearwater after the effective date of this ordinance
shall be required to conform and comply therewith.
Section 5. Section 7-5, Permit Fee, of Chapter 7, pertaining to
Buildings, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
is hereby amended to read as follows:

Sec. 7-5. Permit fee.
For all buildings, structures or alterations which require
a building permit, the applicant shall at the time of filing
an application, pay a fee as required in the following schedule:
(1) Where the valuation does not exceed $25.00, no fee shall. rAr}'"":?`t
be required, unless an inspection is required in which

case there shall be a $3.00 fee.
(2) For total valuation of more than $25.00, to and including i<<rrr'ti?`*}:
$1200. 00, there shall be a $3.00 tae.
(3) For total valuation in excess of $1200.00, to and in eluding $100, 000. 00 or fraction thereof, the fee shall

be one-fourth of one per cent of the estimated cost.
(4) For apermit for each additional $ 1, 000. 00 valuation
above $100, 000. 00, the permit fee shall be one-eighth !I;,
• of one per cent.
(5); For the demolition of any building or structure, the permit
fee shall be $4. 00.
(6) For the moving of any building or structure, the permit ;.J
fee shall be $10. 00.
Section 6. Any person, organization, society, association or
corporation, or any agent or representative thereof who shall violate any
provisions of this Ordinance or the code hereby adopted or fail to comply
therewith, or who shall violate or fail to comply with any order made there-
under, or who shall build in violation of any detailed statement of specifications
or plans submitted and approved thereunder, or any certificate or permit
issued thereunder, shall, upon conviction in the Municipal Court, be fined
not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisoned in
the City Tail for not exceeding sixty (60) days, or by both such fine and
imprisoxunent, in the discretion of the Municipal Judge. Any violation of
the provisions of this Ordinance or the Code hereby adopted may also be
grounds for the City of Clearwater to Suspend or revoke the offending
party's contractor's or nub-contractor°s license issued by the City of
Clearwater. Each day's continuance of any violation of any provision
of this Ordinance or the Code herebyadopted shall constitute a separate
offense. The imposition of one penalty for any violation shall not excuse
the violation or permit it to continue; and all such persons shall be

required to correct or remedy such violations or defects within a reasonable
time. The application of the above penalty shall not be held to prevent the
enforced removal of prohibited conditions.
Section 7. All former ordinances or parts thereof conflicting or
inconsistent with the provisions of this ordinance or of the code hereby
adopted are hereby repealed.
Section B. Should any section, paragraph, sentence or word of
this ordinance or of the code, as amended, hereby adopted be declared for
any reason to be invalid, the same shall not affect the validity of the ordinance
or code,'. as amended, as a whole, or any part thereof other than the part
declared to be invalid.
Section 9. This ordinance shall become effective immediately
upon its passage.
