PERTAINING TO ZONING, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER# FLORIDA, 1962, AND AMENDING
THE ZONING MAP OF THE CITY OF CLEARWATER, FLORIDA,

CERTAIN PROPERTIES AS DESCRIBED HEREIN; BY AMENDING

WHEREAS, on April 27, 1970, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the

its evaluation of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA!

Florida, are hereby classified and zoned as hereinafter indicated and

(2) Minimum Mobile Home (dwelling unit) Setbacks for front of Mobile

(a)On official designated right of way of 100 feet or less - 40 feet
except Gulf to Bay which shall be 200 feet from the centerline
(b) On official designated right of way of more than 100 feet - a distance
equal to the right of way width as a setback from the centerline
of the right of way
(c) Or greater if designated on the official zoning map.
Section 4. Chapter Z6, Zoning, of Code of Ordinances, City of
Clearwater, Florida, 1962, is amended to add a new Section 26-9B, Use
Regulations, Aquatic Park District, to read as follows:
Sec. 26-9B. Use Regulations--Aquatic Park District.
1. Purpose of Zone and Application
To affirm the authority of the City of Clearwater to regulate
and control the use and occupancy of all public waters,
waterways and water bottoms within the corporate limits of
the City for the benefit of the health, welfare, safety and
convenience of its inhabitants.
b. Application - The AP District shall be established upon all
waters, including but not limited to all basins, bays, bayous,
canals, lakes, rivers, streams, waterways and waters of the
Gulf of Mexico and all publicly owned submerged lands thereunder,
including all water over privately or publicly owned submerged
lands from the present high tide mark seaward or seaward from
any engineered bulkhead line•which may be established by the
City Commission.

2. Permitted Uses - In an AP Zoning District, the permitted uses'
for lands and waters shall be: boating, swimming, fishing,
diving, water skiing, wading and related water-oriented
recreational uses.

d. Not create any alteration of water flow, accumulation of
debris or creation of water pockets for incubation of "red tide";
e. Demonstrate that adequate precautions are taken to prevent
salt water intrusions into surface water tables; and
f. Display that there are proper provisions to be taken for
protection of and access to existing or proposed navigable
channels or basins.
Section 5. Section 26-11 (7), Schedule of Lot and Building Regulations,
for all Use Districts, of Code of Ordinances, City of Clearwater, Florida,
1962, is hereby amended to provide for changes in regulations for Mobile
Home Park Use Districts as follows:
(See Schedule of Lot and Building Regulations attached).
Section 6. Sub-paragraph (a) of Sub-section (2), Definitions, of
Section 26-11A, Off-street Parking Requirements, of Cade of Ordinances,
City of Clearwater, Florida, 1962, is hereby amended to read as follows:
(a)- For the purpose of this section "off-street parking
spacer" shall consist of a minimum net area of one
hundred and eighty (180) square feet of appropriate
dimensions for parking an automobile. Off-street
parking area as required shall be the proper number
of -spaces as required in (4) plus the access drives and
manuevering space thereto, all to be within the property
lines.

Section 7. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 8. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 9. Any person or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction in the Municipal Court,
be fined not exceeding the sum of Five Hundred Dollars ($500, 00), or
imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense.
Section 10. The Planning Director is directed to include and set out
and show upon the official zoning map of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 11. The provisions of this ordinance shall take effect
immediately upon its passage.
