1249 M- 014 ORDINANCE NO. 1249 AN ORDINANCE AMENDING CHAPTER 18, SIGNS, OF THE CODE OF ORDINANCES OF THE CITY OF CLEAR- WATER, FLORIDA, 1962, BY AMENDING SECTION 18-5, PENALTY FOR VIOLATION OF CHAPTER PRO- VISIONS, TO IMPOSE THE MAXIMUM FINE OF FIVE HUNDRED DOLLARS ($500. 00); BY AMENDING PARAGRAPH (3), OF SUB-PARAGRAPH (D), OUTDOOR ADVERTISING DISPLAY SIGNS--CHARACTER, OF SECTION 18-6, DEFINITIONS, TO DEFINE BANNERS, STREAMERS, SPINNERS AND PENNANTS AND TO PROHIBIT SAME WITHIN THE CITY OF CLEARWATER; BY AMENDING PARAGRAPH (2), SAFETY REQUIRE- MENTS, OF SUB-PARAGRAPH (a), INTERFERENCE WITH PUBLIC, OF SECTION 18-21, REGULATIONS GOVERNING SIGNS GENERALLY, TO PROVIDE REGULATIONS FOR INTENSELY LIGHTED AREAS; BY AMENDING PARA- GRAPH (6), DISTRACTIONS, OF SUB-PARAGRAPH (a), PROHIBITED SIGNS, OF SECTION 18-31, REGULATIONS GOVERNING SPECIFIC TYPE SIGNS, TO PROVIDE THAT BANNERS, STREAMERS,SPINNERS, PENNANTS AND SIMILAR DISTRACTIVE DISPLAYS SHALL BE PROHIBITED ONE HUNDRED TWENTY DAYS AFTER THE EFFECTIVE DATE OF THIS ORDINANCE AND PROVIDING CERTAIN CONDITIONS UNDER WHICH A PERMIT FOR SAME MAY BE ISSUED; BY AMENDING SUB-PARAGRAPH (h), SERVICE STATIONS, OF SECTION 13-41, OUTDOOR ADVERTISING DISPLAY, ON PREMISE, TO ADD A REFERENCE TO BANNERS, STREAMERS, SPINNERS AND PENNANTS; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THE TERMS OF THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 18-5, Penalty for Violation of Chapter Provisions, of Chapter 18, Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Sec. 18-5. Penalty for violation of chapter provisions. Any person or persons, firm or corporation or association of persons who shall violate or fail to comply with any of the terms or provisions of this chapter shall, upon conviction in the Municipal Court, be fined not exceeding the sum of Five Hundred Dollars ($500. 00), or imprisoned in the City Jail for not exceeding sixty (60) days, or by both fine and imprisonment in the discretion of the Municipal Judge. (b)Banners, Streamers, Spinners, Pennants--Within the scope of this Code shall be considered as a special form of advertising composed of, but not limited to the above materials, with or without letters or symbols, erected for the purpose of attracting attention to an area or a point. Paragraph (2), Safety Requirements, of Sub-Paragraph (a), Interference with Public, of Section 18-21, Regulations Governing Signs Generally, of Chapter 18, Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to add a now paragraph (c) to read as follows: (2) Safety requirements- (c)Intensely lighted areas, created for the purpose of sales attraction may be considered as distractive displays. Such displays may be a hazard to safe passage of vehicular traffic and divert driver attention from certain necessary traffic controls and/or pedestrian crossing zones. Such intensely lighted areas may be prohibited at certain locations by the Traffic Department and confirmed by the City Commission. Section 4. Paragraph thy, Distractions, of Sub-Paragraph (a), Prohibited Signs, of Section 18-31, Regulations Governing Specific Type Signs of Chapter 18, Signs, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: t6? One hundred twenty (120) days after the effective date of this ordinance, the display of banners, streamers and spinners and pennants as defined shall be prohibited. (c) The above prohibited uses shall not apply to private and public, interests involved with a declared public or non- commercial celebration of significant civic, religious, municipal, county, state or national events or periods. On such occasions, the City Commission shall authorize the City Building Department to issue permits for said special situations. The conditions of permit issuance shall be publicized by the Commission stating the nature and period of display and setting a final date for removal. Fees, if and when required, shall be established by the City Commission. (d)Business groups may apply to the City Building Department for special permission to have commercial displays, as defined in Paragraph 2 A and B, of a temporary nature for certain commercial celebrations, for example grand openings, change in ownership, 100 year anniversaries, but not for the purpose of just advertising sales and other promotional gimmicks. If an application is denied, the applicant may appeal to the City Manager and if he denies same, then to the City Commission which said Commission shall make a determination as to whether such celebration or promotion is in the interest of the public welfare, and if it so determines, then the City Commission may order the City Building Department to issue such permit. Authorization shall include (but not be limited to)' the following: (1)-Organization (s) responsible for erection and removal (2) Time of Erection--Deadline for Removal (3) Nature and Location of each Display (4)Fees shall be at the rate of $25. 00 for the permit. (5) Permit shall not exceed a period of two (2) weeks. However, on appeal and determination by the City Commission, the length of the permit may be extended up to a total period not to exceed one (1') month upon a (showing of public interest and public welfare by the applicant. Section 5.
