ORDINANCE NO, 1237 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ANNEXING LOTS 1 THROUGH 24, INCLUSIVE, BOYLAN SUBDIVISION, AND LOT 1, WEST 1/2 OF E LOT 2, AND LOTS 4 THROUGH 25, INCLUSIVE, BOYLAN SUBDIVISION 1ST ADDITION, TOGETHER WITH ALL ABUTTING STREETS, INTO THE CORPORATE LIMITS OF THE CITY OF CLEARWATER, FLORIDA, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITIONS, ACCORDING TO THE PRO- VISIONS OF CHAPTER 69-958, SPECIAL ACTS OF FLORIDA, 1969, AND OTHER APPLICABLE LAWS, STATUTES AND CHARTER PROVISIONS; AFTER PROPER PUBLIC NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING THE ZONING USE DISTRICT AND FIRE DISTRICT CLASSIFICATIONS FOR SAID PROPERTY AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. 4, WHEREAS, the Legislature of the State of Florida enacted Chapter 69-958, Special Acts of Florida, 1969, which became a law without the Governor's approval when it was filed in the Office of the Secretary of State on July 3, 1969; and WHEREAS, said Act provided for the enlargement and redefining of the boundaries and territorial limits of the City of Clearwater, Florida; and WHEREAS, Section z of said Act provided that all parcels of property included within the specified description that have not been previously annexed prior to the effective date of said Act, shall be deemed to be excluded therefrom until approved by a referendum election of the owners of the property in each parcel, or in the alternative, an application and waiver of referendum signed by a majority of the owners of property within each parcel; and WHEREAS, the City of Clearwater has now received a petition signed by more than a majority of the owners of property in certain specified portions of Boylan Subdivision and Boylan Subdivision Ist Addition waiving the referendum requirement and requesting the annexation of said properties into the City of Clearwater; and ' -1- •0rd,J1237 R -- ti,y?E-(a?r?,t'+5.c=:,r..,.?:9--: y5' ? , .?"s31E1yyv • .. ... Irl J `S 1, 1 i•??'d' ri Y . *I =I WI R MW WHEREAS, it is the desire of the City of Clearwater that this property be annexed into the City of Clearwater in accordance with the provisions of said Special Act and other applicable laws, statutes and charter provisions; and WHEREAS, on November 24, 1969, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning and fire district classifications for said real property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER. FLORIDA: Section 1. After its evaluation of all evidence presented at a proper public hearing, the City of Clearwater, acting by and through its City Commission, by the authority and under the provisions of Chapter 69-958, Special Acts of Florida, 1969, and other applicable laws, statutes and charter provisions, hereby annexes into the corporate limits of the City of Clearwater, Florida, and redefines the boundary lines of said City so as to include the following described parcels of real property in Pinellas County, .Florida, and to establish zoning and fire district classifications therefor: Lots 1 through 24, inclusive, Boylan Subdivision, according to the xnap or plat thereof as recorded in Plat Book 30, page 47 of the Public Records of Pinellas County, Florida, together with all abutting streets. AND Lot 1, West 1/2 of Lot 2, and Lots 4 through 25, inclusive, Boylan Subdivision 1st Addition, according to the map or plat thereof as recorded in Plat Book 33, page 6 of the Public Records of Pinellas County, Florida, together with all abutting streets. The above described property is hereby zoned 1131-211 (Duplex) and designated as Fire District No. 2. Section 2. The City Commission hereby formally and according to law accepts the dedication of all easements, streets, parks, plazas, places, rights of way and other dedications to the public which have heretofore been made by plat, deed or user within the areas so annexed.
