ORDINANCE NO. 1212
AN ORDINANCE OF THE CITY OF CLEARWATER,
AMENDING CHAPTER 2, ADMINISTRATION, OF THE
CODE OF ORDINANCES, CITY OF CLEARWATER,
FLORIDA, 1962, TO ADD A NEW SECTION 2-31 TO
EMPOWER THE CITY TO ENTER INTO AGREEMENTS
AND CONTRACTS WITH ANY UNCLASSIFIED SERVICE
EMPLOYEES ESTABLISHING AND PROVIDING FOR
DEFERRED COMPENSATION PROGRAMS WHICH SAID
AGREEMENTS AND CONTRACTS SHALL PROVIDE THE
METHOD AND SOURCE OF THE FUNDS FOR SAID
PROGRAMS AND THE APPROVED PROCEDURE FOR
ADMINISTERING, INVESTING AND DISBURSING THE
FUNDS INVOLVED; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, the City of Clearwater, Florida, has in its employment
certain employees who are listed in the unclassified service under the Civil
Service Law applicable to the City of Clearwater; and
WHEREAS, by virtue of being listed in the unclassified service,
said employees are not eligible or entitled to participate in any of the
pension funds and programs established and administered for the classified
employees of the City of Clearwater; and
WHEREAS, said unclassified employees have rendered and will in
the future render valuable service to their employer, the City of Clearwater,
and it is the desire of the City to have the benefit of their continued loyal
service and counsel and to provide on their behalf for the contingencies
of death and old age dependency; and
WHEREAS, the City of Clearwater, Florida, a municipal corporation,
has under the State of Florida Constitution and applicable statutes been
granted broad exercise of home rule powers in its governmental and
proprietary activities;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 1. Chapter 2, Administration, of the Code of Ordinances,,
City of Clearwater, Florida, 1962, is hereby amended by adding thereto the'.
following now Section Z-31:
Section Z-31. '
The City of Clearwater, Florida, a municipal corporation,
is hereby authorized and empowered to enter into agreements
and contracts with any unclassified service employee of the
City of Clearwater establishing and providing for deferred
compensation program for said employee. Said individual
agreements and contracts shall provide and specify the method
and source of the funds for said program and the approved
procedure for administering, investing and disbursing the
funds involved in connection therewith.
Section Z. The provisions of this Ordinance shall take effect .
immediately upon its passage.
