FLORIDA, AMENDING CHAPTER. Z5 PERTAINING TO
VEHICLES FOR HIRE, ARTICLE I, TAXICABS, TO
` ADD DEFINITIONS FOR TAXIMETER AND TAXI STAND;;
CLARIFYING CONTENTS OF CHAUFFEUR'S PERMIT,
REQUIRING APPLICANT TO BE AT LEAST TWENTY-
ONE YEARS OF AGE AND SETTING FORTH REQUIRE-
MENTS FOR FINGERPRINTS OF APPLICANT; PRO-
VIDING FOR FILING OF ANNUAL PHYSICIAN'S
CERTIFICATE WITH CHIEF OF POLICE; PROVIDING
THAT CHIEF OF POLICE RETAINS RIGHT TO SUSPEND
OR REVOKE ANY CHAUFFEUR'S PERMIT AND SETTING
UP PROVISIONS FOR APPEAL OF SUCH SUSPENSION OR
REVOCATION TO THE CITY MANAGER AND THEN TO
THE CITY COMMISSION; REPEALING PROVISION FOR
GOVERNORS ON TAXICABS; PROVIDING FOR FULL
REPORT OF ALL INSPECTIONS OF TAXICABS MUST BE
FILED WITH CHIEF OF POLICE; PROHIBITING ANY BUT
METERED TAXICABS TO SOLICIT 1USINESS OR PICK UP
PASSENGERS IN A TAXI STAND AND PROHIBITING ANY
TAXICAB OPERATOR TO SOLICIT BUSINESS OR PICK UP
PASSENGERS IN A BUS STOP; PROVIDING THAT CHIEF
OF POLICE SHALL NOTIFY CITY MANAGER OF ANY
AND ALL VIOLATIONS OF ANY ORDINANCE OF THE CITY
BY ANY TAXICAB OPERATOR OR CHAUFFEUR; PRO-
VIDING THAT EVERY TAXICAB SHALL HAVE PAINTED
UPON EACH SIDE OF SAID CAB IN MINIMUM SIZE OF TWO
INCH LETTERS THE RATES CHARGED AND FURTHER
THAT A COMPLETE SCHEDULE OF RATES AND CHARGES
SHALL BE POSTED IN A CONSPICUOUS PLACE INSIDE
SAID TAXICAB; PROVIDING THAT A SCHEDULE OF RATES
OR FARES TO BE CHARGED FOR TRANSPORTATION OF
PASSENGERS MUST BE FILED WITH THE CHIEF OF POLICE
BY OPERATORS OF TAXICABS NOT EQUIPPED WITH A
TAXIMETER; PROVIDING ISSUANCE OF A TAXI PERMIT
TO BE DISPLAYED AT ALL TIMES ON EACH TAXICAB;
ESTABLISHING UNIFORM SCHEDULE OF RATES FOR ALL
TAXICAB OPERATORS OPERATING TAXICABS EQUIPPED
WITH APPROVED TAXIMETERS; PROVIDING THAT EVERY
TAXICAB OPERATOR SHALL ADOPT AND USE A DISTINCTIVE,
UNIFORM[ AND DECORATIVE COLOR SCHEME; PROVIDING
THAT EVERY TAXICAB OPERATOR SHALL SUBMIT TO
THE CHIEF OF POLICE QUARTERLY A SWORN WRITTEN
REPORT CONTAINING CERTAIN SPECIFIED INFORMATION
ON EACH TAXICAB; PROVIDING THAT ALL TAXICAB
OPERATORS HOLDING LICENSES TO OPERATE ONE OR MORE
TAXICABS WITHIN THE CITY SHALL HAVE NINETY DAYS
FROM THE DATE OF THIS ORDINANCE TO EQUIP ALL TAXI-
CABS OPERATED BY THEM WITH INSPECTED AND APPROVED
TAXIMETERS IF SAID TAXICABS SHALL SOLICIT BUSINESS
OR PICK UP PASSENGERS FROM DESIGNATED TAXI STANDS;
PROVIDING THAT ALL TAXICAB OPERATORS PRESENTLY
HOLDING LICENSES TO OPERATE ONE OR MORE TAXICABS
SHALL HAVE ONE YEAR FROM DATE OF THIS ORDINANCE
WITHIN WHIUH TO COMPLY WITH REQUIREMENTS FOR
PAINTING AND MAINTAINING ALL TAXICABS AS SPECIFIED
HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING PENALTIES FOR
THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; AND PRO-.

Any person twenty-one years of age or over may make application
to the Chief of Police of the City for a chauffeur's permit. It
shall be the duty of the Chief of Police to make an investigation
to determine the moral character and fitness of the applicant
and the knowledge of the applicant of the provisions of this
z' article and the traffic regulations of the City. It shall be the
duty of the Chief of Police, if the applicant be a person of good
moral character and fitness and possesses sufficient knowledge
of the provisions of this article and of the traffic regulations
of the City, and when the applicant complies with Section 25-17
(a) to issue such person a written permit, such permit shall
be signed by the Chief of Police and shall bear the name,
address, sex, color, age, signature and photograph of the
applicant,

Sec. 25-14. Chauffeur's Permit--Fingerprints and photographs,
The Chief of Police shall pfocure the fingerprints and a
photograph of the applicant and shall keep iho same on permanent
file in his office, Such prints and photographs shall be
voluntarily furnished by tho applicant at the time of filis g
his application,
" Section 4. Sub-paragraph (b) of Section 25-17, Chauffeur's Permit—
Physical examinations; physician's certificate, of Article I, Taxicabs, of '
Chapter 25, Vehicles for Hire, of the Code of Ordinances, City of Clearwater,
Florida, 1962, is hereby amended to read an follows;
(b)' The holder of a chauffeur's permit shall, prior to
issuance thereof and upon renewal each year, submit to
the examination prescribed in this section. The physician's
{ certificate issued pursuant to such an examination shall be
filed with the Chief of Police. Upon the-failure of the holder
of a chauffeur's permit to submit to an examination as herein
prescribed, or if upon such examination he shall be found
physically unfit to operate a motor vehicle upon the public
streets, the chauffeur's permit theretofore issued to the
applicant shall be suspended or revoked by the Chief of Police.
Section S. Section 25- 18, Chauffeur's Permit--Suspension and
revocation, -of Article 1, Taxicabs, of Chapter 25, Vehicles for Hire, of the
Code of Ordinances, City of Clearwater, Florida, 1962, is hereby amended
to read as follows:
Sec. 25-18. Chauffeur's Permit-, Suspension and revocation; right
of appeal.
The (Chief of Police of the City retains the right to suspend
or revoke any chauffeur's permit previously issued if upon
investigation he shall find that the holder of such chauffeur's
permit has violated any of the provisions of this chapter, or
has been convicted of a felony, or has been convicted of driving
a taxicab or other motor vehicle while under the influence of
intoxicating liquor, or if such person is suffering from a
contagious or communicable disease, or defect or impairment
of vision or hearing, or other physical impairment, or if the
person is not a person of good moral character and fitness, or
if such person has been twice convicted of reckless driving
within any period of twelve months. Before such chauffeur's
permit shall be suspended or revoked, however, notice of
intention thereof shall be served upon the person either by
registered mail or personal service, and such person shall
be given an opportunity to be heard.

Sec. 2524. Restricted areas of operation.

No taxicab operator shall solicit business or pick up
passengers within any area within the City designated
by the Chief of Police as a taxi stand unless said
taxicab is equipped with a taximeter which has been
inspected and approved by the Chief of Police or his
designated representative, No taxicab operator shall
solicit business or pick up passengers within any area
within the City designated by the Chief of Police as a
bus stop.
Section 9. Section 25-25, Duties of Chief of Police generally,
of Article I, Taxicabs, of Chapter 25, Vehicles for Hire, of the Code of
Ordinances, City of Clearwater, Florida, 1962, is hereby amended to
read as follows:
Sec, 25-25. Duties of Chief of Police generally,
It shall be the duty of the Chief of Police to notify the
City Manager of any and all violations of any ordinance
of the City by any taxicab operator or chauffeur.
Section 10. Sections 25-26, Rate--Schedules --Display required,
of Article 1, Taxicabs, of Chapter 25, Vehicles for Hire, of the Code of
Ordinances, City of Clearwater, Florida, 1962, is hereby amended to
read as follows:
Sec. 25-26. Rate--Schedules--Display required.

Every taxicab operating in the City shall have painted upon
each side of said cab in minimum size of two inch letters,
in accordance with instructions issued by the Chief of Police,
the rates charged for transportation in such taxicab. Every
taxicab operating in the City shall also have posted in a
conspicuous place therein a complete schedule of all rates
and charges for the transportation in such taxicab of
persons, packages and baggage.

Sec. 25-27, Rate--Schedules--Filing with Chief of Police;
amended schedules.
Every person owning, operating or controlling any motor
vehicle operated as a taxicab, without being equipped with
an approved taximeter, within the City shall file with the
Chief of Police a schedule of the rates or fares to be
charged for transportation of passengers in such taxicabs,
and all charges shall be strictly in accordance with such
schedule. Such person may file with the Chief of Police ,
an amended schedule of fares at any time, and upon approval
by him such amended schedule shall become effective.
Section 12, Article I, Taxicabs, of Chapter 25, Vehicles for
Hire, of the Code of Ordinances, City of Clearwater, Florida, 1962, is
hereby amended by adding a new Section 25-31 to read as follows:
Sec. •25-31. .
Upon approval by the City Commission of an application
for a taxicab license and the issuance of said license and
compliance with all other provisions of this Chapter, the
Chief of Police shall issue a taxi permit which shall be
required to be displayed at all times in the lower rightha.nd
corner of the taxicab windshield.
Sect on 13, Article I, Taxicabs; of Chapter Z5, Vehicles, for
Hire, of the Code of Ordinances, City of Clearwater, Florida, 1962, is
hereby amended by adding a new Section 25-32 to read as follows:
Sec. 25-32.
There is hereby established a uniform schedule of
rates which shall be adhered to and complied with by all
taxicab operators operating taxicabs equipped with an
approved taximeter within the City of Clearwater, Said
uniform schedule of rates is as follows:
(1)50 drop (first 3/5 mile) then''10?'each additional
115 mile, for one or two passengers.
(2) 2 minute limit from point of origin until customer is
in cab before driver trips the taximeter.
(3)Extras: 25? for handling anything over 2 grocery bags
25? for handling 2 suitcases, 15? for each additional
25} for each passenger in excess of 2
(4) 10? for 1-1/2 minutes waiting time. '

It shall be unlawful for any driver, operator or, ciiau€four
of any meter equipped taxicab to charge a fare either
greater or less than the fare as registered on said
taximeter. Said schedule of rates shall be subject to
review and change by the City Commission at any time.
Section 14; Article 1, Taxicabs, of Chapter 25, Vehicles for
Hire, of the Code of Ordinances, City of Clearwater, Florida, 1962, is
hereby amended by adding a new Section 25-33 to read as follows:
Sec. 25-33, Color schemes for taxicabs --Required; approval,
changes.
Every operator holding a license to operate- one or
more taxicabs within the City of Clearwater shall adopt
and use, after approval by the Chief of Police, a.distinctive,
uniform and decorative color scheme for all taxicabs
operated by such operator. The Chief of Police shall
refuse to issue•a permit for operation'if, in his opinion,
the proposed color scheme will infringe upon any color
scheme already in use by another taxicab operator.
Changes or alterations in the color scheme used by any
license holder may be accomplished upon approval
by the Chief of Police.
Section 15. Article 1, Taxicabs, of Chapter 25, Vehicles for
'Hire, of the Code of Ordinances, City of Clearwater, Florida, 1962, is
hereby amended by adding a new Section 25-34 to read as follows:
Sec. 25-34. ,
Every operator holding a'license tooperate one or
more taxicabs within the City of Clearwater shall within
ten,(10) days from the end of each calendar- quarter submit
to the Chief of Police a sworn written report containing the
following information on each taxicab operated by it within
the City of Clearwater:
(1)A description of the motor vehicle being•used as
a taxicab, setting forth the make, model, year,
color, body style, motor vehicle identification
and license tag number thereof,
(2) Speedometer mileage, reading at the beginning and
at the end of each quarter for each said taxicab,
(3) Each taxicab permit number,
(4)A list setting forth the names and addresses of all
drivers operating taxicabs for said operator within
the City of Clearwater.

Section 17. All ordinances or parts of ordinances in conflict herewith
to the extent of such conflict are hereby repealed.
Section 18. Any person, organization, society, association or
corporation, or any agent or representative thereof who shall violate any
provisions of this Ordinance or fail to comply therewith, or who shall
violate or fail to comply with any order made thereunder shall, upon
conviction in the Municipal Court, be fined not exceeding the sum of Five
Hundred Dollars ($500. 00), or imprisoned in the City Jail for not exceeding
sixty (60) days, or by both such fine and imprisonment, in the discretion
of the Municipal Judge.
Section 19. Should any section, paragraph, sentence or word of
this ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other than
the part declared to be invalid.
