WHEREAS, the City of Clearwater on July 19, 1965, passed and
adopted Ordinance No. 1059, which adopted and approved that certain code
known as the Southern Standard Building Code, 1965 Edition, save and except
such portions as were deleted, modified or amended by Sections 2 and 3 of
said Ordinance; and
WHEREAS, the City desires to amend a certain additional portion of
said Southern Standard Building Code, 1965 Edition, as previously adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. The Southern Standard Building Code, 1965 Edition thereof,
as previously amended and changed and adopted by the City of Clearwater on
July 19, 1965, is further amended and changed in that Section 2204, Moving
of Buildings, Sub-Sections 2204. 1, 2204. 2 and 2204. 3 are amended to read
as follows:

2204. 1--General.
No building or part of any building,shall be moved through or
across any sidewalk, street, alley or highway within the govern-
mental limits without first obtaining a permit from the Building
Official, which permit shall provide that no work shall be
commenced until the expiration of the appeal period provided
in Section 2204. 3' below.
ZZ04. Z--Written Application Must,Be Filed.
Any person desiring to move a building shall first file with the
Building Official a written application setting forth the following
information:
(a) Type and kind of building to be moved.
(b) The original cost of such building.
(c) The extreme dimensions of the length, height and width of
the building.
(d) its present location and proposed new location by lot, block,
subdivision and street numbers.
(e) The approximate time such building will be upon the streets,
and the contemplated route that will be taken from present
to new location.
(f) The names and addresses of all property owners within
250 feet o£ the proposed new location of said building,
provided that new location is located within the confines
of the City of Clearwater.
Upon receipt of an application to move a building, the Building
Official shall mail a notice of said application to the owners of
all properties situated within 250 feet of the subject property.
All such notices shall be sent by mail to the last known names
and addresses as indicated on the tax roll of Pinellas County,
Florida.
2204. 3--Building Official Shall Reject When
(a) If in the opinion of the Building Official, the moving of any
building will cause serious injury to persons or property or
serious injury to the streets or other public improvements,
or the building to be moved has deteriorated more than fifty
per cent of its original value by fire or other element, or if
the moving of the building will violate any of the requirements
of this Code or of the Zoning Regulations, or if the building
to be ]moved is a residence and if in the opinion of the Building
Official said residence does not conform with the general
architectural design and construction of other residences
presently situated within 250 feet of the proposed new location
of said residence, the permit shall not be issued and the
building shall not be moved over the streets.
(b) Any building being moved for which permit was granted shall
not be allowed to remain in or on the streets for more than
forty-eight hours.

(c) No permit for the moving of any building shall be issued by

the Building Official until said written application has been }! '
on file with him for a minimum period of seven days after
the filing of such application to allow the Building Official
to give written notice of said application to all property ; ..;' ',±r y?I

said building.
(d) Any person, firm or corporation desiring to appeal any °'fy1 ?' f ' -'s
decision of the Building Official in granting or denying any
permit for the moving of any building may appeal such
decision to the Building Board of Adjustments and Appeals. ???;:,;,:'r •???;?;?,??? ?;. ??.:
Such appeal shall be taken by filing written native thereof .f
in duplicate with the Building Board of Adjustments and
Appeals within two days after the date of the decision of
the Building Official. The Building Board of Adjustments`
and Appeals shall have the power, after due notice to the !
appellant, the applicant and all property owners within 250
feet from the proposed location of said building, to hold a
hearing from said appeal at which any party may appear in1
person or by attorney or by designated representative. The
hearing so held shall be de novo. The Building Board of
Adjustments and Appeals shall have the power after notice ..;
and hearing as aforesaid, to reverse any decision of the
Building Official in granting or rejecting any application
for moving any building when it feels that said application t
properly complies with all the requirements of Section
2204. 3 or there is a hardship involved.

(e) Any person adversely affected by a decision of the Board,
or any officer, department director, board or bureau of t.
the City may appeal such decision to the City Commission.
Such appeal shall be taken by filing written notice thereof,
in duplicate, with the City Clerk within ten days after the
• decision of the Board. The City Clerk shall forthwith T

transmit one copy thereof to the Secretary of the Board, who
shall then forthwith transmit to the Clerk fox the use of the P
City Commission, all the papers constituting the record upon
which the action appealed from is taken. The City Commission
shall, after due notice to the appellant, the applicant and
all property owners within 250 feet from the proposed location w
of said building, not less than twelve days and not more than
forty-five days after the filing of an appeal hold a public
hearing thereon and promptly render its decision. At the
hearing any party may appear in person or by attorney or by
delegated representative. The hearing before the Commission
shall be de novo. The City Commission shall have power, after
due notice and hearing as aforesaid, to reverse any decision :s
of the Board iii granting or rejecting any application for moving I
any building when it feels that said application properly complies
with all the requirements of Section 2Z04. 3 or there is a
hardship involved. The decision of the City Commission shall

be superior to that of the Board and shall be binding upon all
concerned subject only to the court review as provided by law.

Section Z. Any person, organization, society, association or
corporation, or any agent or representative thereof who skull violate any
provisions of this Ordinance shall be subject, upon conviction in the Municipal
Court, to a fine not exceeding the sum of Five Hundred Dollars ($500, 00),
or imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4, Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. This ordinance shall become effective immediately upon
its passage.
