BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sub-paragraph (A) (9) of Section ll-27, Noises—
Enumeration; exceptions; responsibility, of the Code of Ordinances, City
of Clearwater, Florida, 1962, is hereby amended to read as follows:
{9} Defect in vehicle or load. The use of any automobile, IMR&P OM ` ,j_i
motorcycle or any other type of motor vehicle so out of
repair, so loaded or in such manner as to create loud and a
unnecessary grating, grinding, rattling or other noise or ? +:• j

Section 2. Sub-paragraph 8 of Section 22-1 Definitions of
Chapter 22, Traffic, of the Code of Ordinances, City of Clearwater, q'•'
Florida, 1962, is hereby amended to read as follows:
(8) Motor vehicle. Every vehicle which is self-propelled,
including but not limited to automobiles, motorcycles, 'r
motor trucks and other vehicles propelled by power other , .
than muscular power, but excepting therefrom traction :
engines, road rollers and such other vehicles as run only
upon rails or tracks.

Sec, ZZ-51. Motor vehicles not to be operated under certain
circumstances.
No motor vehicle shall be operated within the City:
(1) That is not in a safe and proper mechanical condition.
(2) By a driver who is under fourteen years of age or whose
physical condition or disabilities are such as to affect or
impair his proper control of the vehicle.'
(3) Without lights properly dimmed or deflected on all
streets where a street lighting system is maintained.
(4) Without adequate lights as required by state law.
(5).Without being equipped with a muffler in good working order
and in constant operation to prevent excessive or unusual
noise or annoying smoke, and no person shall operate a motor
vehicle on the streets equipped with a muffler cut out, bypass
or other similar device,
(a) A "muffler" as used herein is defined as a device consisting
of a series of chambers or other mechanical devices designed for
receiving the exhaust gases from, an internal combustion engine
for the purpose of breaking up the sound waves and the diffusion
of smoke emitting from such engine.
(b) No person shall introduce any foreign material or obstruction
into the muffler or exhaust pipe which causes or is capable of
causing exhaust gases to ignite, burn or flash in any manner or
form.
(6) In such a manner as to cause intensive, loud or unusual noise
which would disturb the citizens of the City of Clearwater,
If any motor vehicle is stopped within the City of Clearwater by a
police officer of the City of Clearwater, and determined to be operated
with improper equipment or in an improper mechanical condition,
then the police officer may, in his discretion, either issue a citation
for said violation or allow the owner or operator thereof a period of
forty-eight hours from the date thereof to have said vehicle repaired
and put in proper mechanical condition. If the owner or operator
shall fail to have said vehicle repaired in the designated period of time,
then any further operation of said vehicle on the streets of the City of
Clearwater shall constitute a violation of this ordinance.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
. Section 5. Any person who shall violate any provision of this Ordinance
shall be subject, upon conviction in the Municipal Court, to a fine not
exceeding the sum of Five Hundred Dollars ($500. 00), or imprisonment in the
City Fail for not exceeding sixty (60) days, or by both such fine and im-
prisov.mmt in the discretion of the Municipal Judge.

Section 6. Should any part or provision of this Ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity.of the ordinance as a .whole, or any part thereof other than the
part declared to be invalid.
Section 7. This Ordinance shall become effective immediately upon
its passage.
