BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:

Section 1. That Section 2-21, Supplementary Police Pensions and
Retirement--Powers of Trustees, of Code of Ordinances, City of Clearwater,
Florida, 1962, is amended to read as follows:
Sec. 2-•21. Supplementary Police Pensions and Retirement-- ' •? ' '?? ; ?
Powers of Trustees.
The board of trustees may:
({?1
(a) Invest and reinvest the assets of the retirement fund in
annuity and life insurance contracts of life insurance
companies in amounts sufficient to provide, in whole or
in part, the benefits to which all of the participants in
the supplementary police officers I retirement fund shall
be entitled under the provisions herein stated, and pay
the initial and subsequent premiums thereon.
(b) Invest and reinvest the assets of the supplementary police
officers I retirement fund in:
(1) Time or savings accounts of a national bank, a state
bank insured by the Federal Deposit Insurance Cor-
poration, or a savings and loan association insured
by the Federal Savings and Loan Insurance Corporation.
(2) Obligations of the United States or in obligations
guaranteed as to principal and interest by the United
States.
(3) County bonds containing a pledge of the full faith and
credit of the county or district involved, provided
that such bonds are approved by the State Board of
Administration as to legal and fiscal sufficiency;
bonds of the Florida Development Commission, or
any other state agency, which have been approved as
to legal and fiscal sufficiency by the State Board of
Administration.

(4) Obligations of any municipal authority issued pur-
suant to the laws of this state, provided, however,
that for each of the five (5) years next preceding
the date of investment the incomes of such authority
available for fixed charges shall have been not loss
than one and one-half (1-112) times its averages annual
fixed charges requirement over the life of its obligations.
(5) Common stocks, preferred stocks and bonds and
other evidences of indebtedness issued or guaranteed by
a corporation organized under the laws of the United
States, any state, or organized territory of the United
States or the District of Columbia., provided:
(aa) The corporation is listed on any one or more
of the recognized national stock exchanges and
holds a rating in one of the three highest
classifications by a major rating service;
(bb) The corporation has paid cash dividends for a
period of seven (7) fiscal years next preceding
the date of acquisition;
(cc) The corporation fulfills either of the following
standards: Over the period of the seven (7) fiscal
years immediately preceding purchase the corpora-
tion must have earned after federal income taxes,
an average amount per annum at least equal, to
two times the amount of the yearly interest charged
upon its bonds, notes or other evidences of in-
debtedness of equal or greater security outstanding
at date of purchase, and earned after federal
income taxes, an amount at least equal to two (2)
times the amount of such interest charges in each
of the three (3) fiscal years immediately preceding
purchase; or the corporation over the period of
seven (7) fiscal years immediately preceding purchase
must have earned after federal income taxes, an
average amount per annum at least equal to six per
cent (6%) of the par value of its bonds, notes or
other evidences of indebtedness of equal or greater
security outstanding at date of purchase, and earned
after federal income taxes, an amount at least equal
to six per cent (676) of the par value of such obligations
in each of the three (3) fiscal years immediately
preceding purchase. No investment shall be made
under this paragraph upon which any interest obligation
is in default or which has been in default within the
immediately preceding five (5) year period;
(dd) The board of trustees shall not invest more than one
per cent (1%) of its assets in the common stock or
capital stock of any one issuing company, nor shall
the aggregate investment in any one issuing company
exceed one per cent (156) of the outstanding capital
stock of that company; nor shall the aggregate of its
investments under this section at cost exceed ten per
cent (1016) of the fund's assets.

(c) Issue drafts upon the supplementary police officers' retirement fund pursuant to the rules and regulations
prescribed by the board of trustees. All such drafts

(d) Any and all acts and decisions shall be by at least three

(e) Finally decide all claims to relief under the board's
rules and regulations.
(f) Convert into cash any securities of the fund.
(g) Keep a complete record of all receipts and disburse-
ments and of the boardts acts and proceedings.
(h) The trustees in the performance of their duties are
authorized to seek, obtain and engage independent
professional investment counsel and advice and to pay
reasonable charges for said service. The general
administration of, and the responsibilities for, the
proper operation of the supplementary police officers'
retirement fund are vested in the board of trustees.
The board of trustees may adopt rules of procedure not
in conflict with provisions of Sections 2-19 through 2-29,
inclusive, for the administration of its duties in the
exercise of its powers herein. The board of trustees
shall keep in convenient form such data as shall be
necessary for an actuarial valuation of the retirement
fund and for checking the actual experience of the fund.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
