(3) (6) BOARDINGHOUSE: A building other than hotel where meals and lodging are provided for compensation and for a total of 5 to 19 boarders. Chapter 26, Article 1, pertaining to Zoning, of the Code of Ordinances, City of Clearwater, Florida, 1962, is hereby amended by adding thereto Section 26-3A to read as follows: Section 26-3A. Use Regulations--"AG" Agriculture District This district comprises lands which are predominantly rural. Lands in the Agriculture District are devoted to the agricultural uses or are undeveloped. Regulations in these districts provide minimum restrictions for uses and are intended to primarily protect the nearby residential uses from objectionable effects of certain agricultural operations such as livestock raising, storage of fertilizer, sawmills and other similar operations. (1) Permitted uses: Within Agriculture District only the following uses al.,, 11 be permitted: Single and two-family (duplex) dwellings with their customary accessory uses when complying with lot and building regulations. (Sec. 26-11 (7) ). Cattle grazing, general farming, poultry raising, citrus cultivation and forestry. Home occupation as defined. Nurseries, greenhouses and truck farming. Sale of produce and livestock which is raised on the premises, providing such sale is conducted either in the open or in a temporary structure and further provided that the point of such sale is setback in accordance to Sec. 26-11 (7). Riding stables when located on a tract of land of a minimum of ten (10) acres, provided, however, that no structure, pen or corral housing animals shall be closer than 150 feet from any property line. Churches and structures appurtenant thereto when located on a tract of land of a minimum of 2-1/2 acres. S chools. Clubs, public and private, including, but not limited to, country and golf clubs, fishing clubs. Public utilities structures. New Cemeteries, provided graves are over 50 feet from an abutting lot or parcel and providing that monuments or structures which are over 6 inches above grade are over 200 feet from an abutting lot or parcel. Buildings within this class would require site plan to be approved, and recorded. (3) Lot and Building Requirements - See Schedule Section 26-11 (7). (4) Off-street Parking - See Section 26-11A. Section 5. Section 26-5A, Use Regulations--"R-3" Districts, of Code of Ordinances, City of Clearwater, Florida, 1962, is hereby repealed in its entirety and a new Section 26-5A is added thereto to read as follows: Sec. 26-5A. Use Regulations--"R-3" Districts. (Planned Unit Development--Residential (PUD-R)--See Sec. 26-8) In the R-3 (LD) Low Density Multiple Dwelling District no premises or buildings shall be used or occupied and no building shall be hereafter erected or structurally altered, unless otherwise provided in this ordinance, except for one or more of the following uses: (1) Permitted uses: Any use permitted in an "R-1" Residence District. (See Section 26-11 (8) ). Two-family dwellings, commonly called a "duplex". (See Section 26-11 (8) ). (5) Special Building Requirements - Courts (a) Minimum distance between wings of a structure or between structures (court yards) shall. be not less than the height of the abutting structures. In the case of varying height of buildings abutting said court yard, the distance shall be the average of the heights. (b) Projection into required courts. Open, balconies, bay windows, uncovered porches and the like may project into required courts not to exceed ten per cent of required distance between structural wings or between structures. (14) and (15) to read as follows: (14) Dormitory, lodging (rooming) house, boardinghouse in a R-3 (LD) District provided that it is located within a radius of 1 mile of the site of a recognized and established higher educational institution. (15) The following uses may be permitted in an AG Agriculture Zoning District provided plan is submitted and it is determined that such proposed use is compatible with abutting existing or proposed ownership usage: 0 Section 14. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid.
