AN ORDINANCE OF THE CITY OF CLEAR WATER,
FLORIDA, AMENDING CHAPTER 5, ANIMALS AND
FOWLS, OF THE CODE OF ORDINANCES, CITY OF
CLEARWATER, FLORIDA, .1962, IN THE FOLLOWING
PARTICULARS; BY AMENDING SECTION 5-2 TO PERMIT
BELLS ON CATS; BY AMENDING SECTION 5-3 TO
PROVIDE THAT CONFINEMENT OF ANY DOG OR. CAT
IN AN AUTOMOBILE, TRUCK, PEN OR OTHER EN-
CLOSURE WITHOUT ADEQUATE VENTILATION SHALL
BE CONSTRUED AS CRUEL TREATMENT; BY AMEND-
ING SUB-PARAGRAPHS (a), (d) AND (e) OF SECTION
5-6 TO PROVIDE THAT NO PERSON SHALL SHOOT ANY
ANIMAL WITH A BOW AND ARROW, AND THAT NO
PERSON WHO OWNS ANY HORSE, COW, OR OTHER
DOMESTIC ANIMAL OR PET, INCLUDING DOGS, SHALL
PERMIT SAME TO WANDER ON THE PUBLIC STREETS
OR TO .'TRESPASS UPON THE PROPERTY OF ANOTHER;
BY AMENDING SECTION 5-16 TO PROVIDE THAT THE

ABLE; BY AMENDING SECTION 5-19 TO PROVIDE THAT
ALL DOGS AND CATS MUST BE VACCINATED AND
LICENSED PRIOR TO JANUARY FIRST OF EACH YEAR;
BY AMENDING SECTION 5-20 TO PROVIDE FOR EVIDENCE
OF VACCINATION FOR A CAT; BY AMENDING SECTION
5-21 TO PROVIDE FOR VETERINARIANS TO REPORT
ANNUALLY TO THE CITY TREASURER ON THE NUMBER

OF JUNE OF EACH YEAR; BY AMENDING SECTION 5-27

Section 5-2. Keeping of animals to which bells, etc. attached.
It shall be unlawful for any person to keep within the City any
horse, cattle, sheep, goat or other domestic animal to which
is attached any bell or other noise-making device; however, ky^'
bells on cats are permitted.

Section 2. Section 5-3, Cruelty, of Chapter 5, Animals and Fowls, ,.'
of the Code of Ordinances, City of Clearwater Florida 1962, is hereby
amended to read as follows:
It shall be unlawful for any person to overdrive,, overload
or to drive when overloaded, or to overwork or deprive of
necessary sustenance, torture, torment or cruelly beat,
mutilate or cause or procure to be so overdriven, overloaded,
overworked, deprived of necessary sustenance, tortured,
tormented or cruelly beaten or mutilated, any animal either
as owner or otherwise, or to permit any such animal to be
without proper protection from the weather and from flies or
other insects, or td knowingly or wilfully permit or authorize
the same to be done. Confinement of any dog or cat in an
automobile, truck, pen or other enclosure without adequate
ventilation shall be construed as cruel and inhuman treatment
and a violation of this section.
The word "animal", as used in this section, shall include every i
living dumb creature. The words "torture, It "torment" and
"cruelty" shall include every act, omission or neglect whereby ?,•?
unnecessary or unjustifiable physical pain or suffering is caused -,
or permitted.
Section 3, Sub-Paragraphs (a), (d) and (e) of Section 5-6 of Chapter
5, Animals and Fowls, of the Code of Ordinances, City of Clearwater, u. t
Florida, 1962, are hereby amended to read as follows:
Section 5-6. Shooting; barking dogs; abandonment; livestock at
large; hitching livestock in streets; trespass of dog 7

(a)No person shall shoot or shoot at any bird, cat, dog or
other animal or fowl in the City, with either a firearm or other
weapon utilizing the principle of compressed air, or any
type of weapon commonly referred to as an "air rifle". or
any type of bow and arrow,
(d) It shall be unlawful for any person who owns, harbors, keeps or
maintains any horse, cow, or other domestic animal or pet,
including dogs, to permit same to wander on the public streets 'r
or on the property of another, nor shall such animals be secured +

except temporarily on the public streets, parks, property
of another or parkways of the City, and any such horse,
cow and other animal or pet, including dogs, found to
be wandering at large out of presence of the owner, or
tied or secured on the public streets or parkways of the
City, except temporarily, shall be impounded, and may
be redeemed in accordance with the provisions of Section
5-36, and upon the failure of the owner to redeem such
animal, such animal shall be disposed of in accordance
with the provisions of Section 5-36.
(e) No person while in control of any dog or other animal
whether by leash or other manner shall allow said dog
or other animal to trespass upon the property of another.

Section 4. Section 5-16, Rules and Regulations Generally, of Chapter
5, Animals and Fowls, of the Code of Ordinances, City of Clearwater, Florida,
1962, is hereby amended to read as follows:
Section 5-16. Rules and regulations generally.
For the purpose of providing proper enforcement of the
provisions of this article, the City Manager shall promulgate
such rules and regulations as seem proper for the carrying
out of the purpose of this article. It shall be his duty to appoint
qualified veterinarians as City rabies inspectors who shall be
under the jurisdiction of and responsible to the City Manager
who shall supervise the provisions of this article, It shall
be the duty of the police officers and other law enforce-
ment agencies to enforce the provisions of this article.
Section 5. Section 5-17, Dog License and Registration--Required,
fees, of Chapter 5, Animals and Fowls, of the Code of Ordinances, City
of Clearwater, Florida, 1962, is hereby amended to read as follows:
Section 5-17. Dog and Cat License and Registration--Required, fees.
All dogs and cats kept, harbored or maintained by their owners
or any other persons in the City shall be licensed and registered
if over six months of age. Dog and cat licenses shall be issued
by the City Treasurer or his agent upon presentation of a certificate
signed by a duly licensed veterianary surgeon or the duly appointed
representative of the Society for the Prevention of Cruelty to
Animals of Clearwater, Inc., that such dog and cat has been
vaccinated against rabies in accordance with the provisions of
Section 5- 19, Dog and cat licenses shall be issued by the City
Treasurer upon the payment of a license tax of Two Dollars
($2. 00) for each dog or cat. The owner shall state at the time
application is made for such licenses and upon printed forms to
be provided for such purpose, the name and address of the owner,
and the name, breed, color and sex of each dog and cat owned,
kept, harbored or maintained by such owner. The provisions
of this section shall not be intended to apply to dogs and cats
brought into the City for the purpose of participating in any
dog shows, nor to "Seeing-eye" dogs properly trained to assist
blind persons, when such dogs are actually being used by
blind persons for the purpose of aiding them to go from place
to place.

Section 6. Section 5-18, Dog License and Registration--Tag and
Collar, Duplicate, of Chapter 5, Animals and Fowls, of the Code of
Ordinances, City of Clearwater, Florida, 1962, is hereby amended to
read as follows:
Section 5-18. Dog and Cat License and Registration--Tag and
collar, duplicate.
Upon payment of the license fee, the City Treasurer or his
agent shall issue to the owner or person paying same, a
license certificate and a metal tag for each dog and cat so
licensed. The shape of the tag shall be changedaery year
and shall have stamped thereon the year for which it was
issued and a number corresponding with the number of the
certificate. Every owner harboring, keeping or maintaining
a dog shall be required to provide each dog so kept, harbored
or maintained with a collar to which the license tag must be
affixed, and shall see that the collar and tag are constantly
worn. In case a dog or cat tag is lost or destroyed, a
duplicate shall be issued by the City Treasurer upon pre-
sentation of a receipt showing the payment of a license fee
for the current year and upon payment of a fifty cent fee
for the duplicate. Dog or cat tags shall not be transferable
from one dog or cat to another, and no refunds shall be made
upon any dog or cat license fee because of the death of the
dog or cat, or of the owner leaving the City before expiration
of the license period.

Section 7. Section 5-19, Vaccination--Required, of Chapter 5,
Animals and Fowls, of the Code of Ordinances, City of Clearwater, Florida,
1962, is hereby amended to read as follows:
Section 5-19. Vaccination-Required.
Prior to January first, of each year, every person who owns,
harbors, keeps or maintains any dog or cat within the City shall
cause such dog or cat to be vaccinated against rabies by a licensed
veterinarian or other person designated by the City Manager
as being qualified to administer such vaccine unless such a dog
or cat has been vaccinated with a new and improved type of vaccine,
the effect of which shall extend for a period substantially greater
than one year; and the person owning, harboring, keeping or
maintaining such dog or cat shall present to the City Treasurer
at the time of application for annual license, a certificate signed
by the veterinary surgeon who administered such new and im-
proved vaccine certifying the date of such vaccination, an adequate
description of the dog or cat and the period during which such
vaccination shall be effective.
On and after January first of each year, any person who owns,
harbors, keeps or maintains any dog or cat not wearing a license
tag as evidence of vaccination, and for which no approved
certificate can be produced, shall be in violation of this chapter
and shall be punished in accordance with the penalty provision
of this chapter; provided, however, the licensing, registration
and vaccination provisions of this chapter shall not apply to
any dog or cat until he has reached the age of six months, and
shall not apply to a dog or cat of any age until said dog or cat
has been in the City for sixty days.

Section 8. Section 5-20, Vaccination--Evidence thereof, of Chapter
5, Animals and Fowls, of the Code of Ordinances, City of Clearwater,
Florida, 1962, is hereby amended to read as follows:
Section 5-20. Vaccination--Evidence thereof.
Evidence of vaccination shall consist of a certificate signed
by the person administering the vaccine and containing
pertinent data for the identification of the dog or cat and
a description of the period of duration for which the certificate
is effective. Two copies stall be given to the owner and
one copy shall be retained as a permanent record by the persons
administering the vaccine.
Section 9. Section 5-21, Reports of Veterinarians, of Chapter 5,
Animals and Fowls, of the Code of Ordinances, City of Clearwater, Florida,
1962, is hereby amended to read as follows:
Section 5-2I. Reports of veterinarians.
All persons authorized to vaccinate dogs and cats under this
chapter, who have vaccinated one or more dogs or cats
under this chapter, shall be required to report annually
to the City Treasurer, such report shall be rendered on
the first day of June in each ensuing year.
Section 10, Section 5-27 of Chapter 5, Animals and Fowls, of the
Code of Ordinances, City of Clearwater, Florida, 1962, is hereby amended
to read as follows:
Section 5-27. Impounding officer; appointment, term and compensation.
The City Manager may appoint an impounding officer who shall
be known as the poundmaster of the City, and who shall serve
for such compensation and during such term as may, from
time to time, be determined by the City Manager; the pound-
master may or may not be an employee of the City as the City
Manager may from time to time determine to be to the best
interest of the City. It shall be the duty of the poundmaster to
pick up and impound all stray, fierce or infected dogs, cats
and other animals and/or any dogs or cats creating a nuisance.
Section 11. Section 5-28 of Chapter 5, Animals and Fowls, of the
Code of Ordinances, City of Clearwater, Florida, 1952, is hereby amended
to read as follows:
Section 5-28. Proclaiming emergency by Mayor.
Whenever it becomes necessary to safeguard the public from
the dangers of rabies, the Mayor, if he deems it necessary,
may issue a proclamation ordering every person owning or
keeping a dog or cat to confine it securely on his premises.
Any dog or cat running at large during the effective period of
such proclamation shall be seized and impounded. Dogs or
cats impounded during the effective period of such proclamation
shall, if claimed within six days, be released to their owners,
unless infected with rabies, upon payment of the impounding
charges provided for in Section 5-36, and upon the owners
complying with all the conditions and provisions of this
article and of such proclamation.

Section 12, Section .5-30 of Chapter 5, Animals and Fowls, of the
Code of Ordinances, City of Clearwater, Florida, 1962, is hereby repealed
in its entirety and a now Section 5-30 is enacted in lieu thereof to read
as follows:
Section 5-30, Disposition of animal biting person.
Any dog, cat or other animal, whether vaccinated or not,
which bites any person shall be immediately reported to the
City Poundmaster or the police by the owner or other person
having control of the animal and such dog, cat or other animal
shall be.immediately quarantined by the owner or other person
having control of said animal or placed in the City Pound under
the supervision of the City Poundmaster, having a suitable
observation period of fourteen days or until released by the
Poundmaster for the purpose of determining if the animal has
rabies. Such event shall likewise be immediately reported
to the County Health Officer.
It shall be unlawful for any person who has reasonable notice that
a dog, cat or other animal is rabid to fail to notify the
authorities set out herein or to dispose of any dog, cat or other
animal or to allow any other dog, cat or animal to be
disposed of in a manner inconsistent with this article.
Section 13. Section 5-32 of Chapter 5, Animals and Fowls, of the
Code of Ordinances, City of Clearwater, Florida, 1962, is hereby amended
to read as follows:
Section 5-32. Disposition of fierce, dangerous or vicious animals.
Every dog, cat or other animal of fierce, dangerous or vicious
propensities shall be confined within a building or secure
enclosure and the owner shall not take such dog, cat or other
animal out of such building or secure enclosure unless such
animal is securely muzzled, Every female dog or cat in heat
shall be kept confined in a building or secure enclosure or in
a veterinary hospital or boarding kennel in such manner that
such female dog or cat cannot come in contact with another
dog or cat except for intentional breeding purposes. If any
such dog, cat or other animal is found running at large in
violation of this provision, it shall be taken up and impounded
and shall not be released except upon approval of the pound-
master and after payment of the fees provided for in Section
5-36; providing, however, if dangerous, fierce or vicious
dogs, cats or other animals so found at large cannot be safely
taken up and impounded, such dogs, cats or other animals
may, upon the direction of the chief of police or the pound-
master be destroyed.
Section 14. Section 5-33 of Chapter 5, Animals and Fowls, of the
Code of Ordinances, City of Clearwater, Florida, 1962, is hereby repealed
in its entirety.

Section 16. Any person who shall violate any provision of this Ordinance

exceeding the sum of One Hundred Dollars ($100. 00) or imprisonment in the
City Jail for not exceeding fifteen (15) days, or by both such fine and im-
prisonment in the discretion of the Municipal Judge.'
Section 17. All ordinances or parts of ordinances in conflict herewith r,
are to the extent of such conflict he reby-.- repealed.
Section 18. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 19. This ordinance shall become effective sixty (60) days
after its passage.
