4 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ORDINANCE NO. 1057 WHICH ADOPTED THE FIRE
PREVENTION CODE, 1965 EDITION, BY AMENDING ARTICLE
13, FIREWORKS, SECTION 13.2, DEFINITION, TO PROVIDE
A DIFFERENT DEFINIMON OF THE TERM FIREWORKS AS
CONTAINED THEREIN; PROVIDING A PENALTY FOR FAILURE
TO COMPLY THEREWITH; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS' ORDINANCE.
WHEREAS, the City of Clearwater on July 19, 1965, passed and
adopted Ordinance No. 1057, which adopted and approved that certain code
known as the Fire Prevention Code recommended by the American Insurance
Association, being particularly the 1965 edition thereof, and the whole thereof
save and except such portions as were deleted, modified or amended by
Section 3 of said Ordinance; and
WHEREAS, the City desires to amend a certain additional portion of
said Fire Prevention Code, 1965 edition, as previously adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The Fire Prevention Code, 1965 edition thereof, as
previously amended and changed and adopted by the City of Clearwater on
July 19, 1965, is further amended and changed in that Article 13, Fireworks,

Section 13. 2, Definition, is amended to read as follows:
Sec. 13.2. Definition.
(1) The term "fireworks" shall mean and include any
combustible or explosive composition, or any substance or
combination of substances, or, except as hereinafter provided,
any article prepared for the purpose of producing a visible
or an audible effect by combu?fon, explosion, deflagration
r- , or detonation, and shall include blank catridges and toy cannons
in which explosives are used, the type of balloons which require
fire underneath to propel the same, firecrackers, torpedoes,
skyrockets, roman candles, daygo bombs and any fireworks
containing any explosives or flammable compound or any tablets
or other device containing any explosive substance.
(2) The term "fireworks" shall not in sparklers, toy pistols, toy
canes, toy guns, or other devices in which paper caps containing
twenty-five hundredths grains or less of explosive compound are
used, providing they are so constructed that the hand cannot
come in contact with the cap when in place for the explosion,
-and toy pistol paper caps which contain less than twenty hundredths
grains of explosive mixture, the sale and use of which shall be
permitted at all times.

Section 2,0 Any person, organization, society, association or
corporation, or any agent or representative thereof who shall violate any
provisions of this Ordinance shall be subject, upon conviction in the Municipal
t Court, to a fine not exceeding the sum of Five Hundred Dollars ($500.-00),
or imprisonment in the City Jail for not exceeding"sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
_ Section 4` Should any part of provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. This ordinance shall become effective immediately upon
its passage.
