AN ORDINANCE OF THE CITY OF CLEARWATER
AUTHORIZING CONDEMNATION OF NECESSARY RIGHTS
OF WAY FOR THE EXTENSION OF MYRTLE AVENUE
ALONG MARSHALL STREET TO DOUGLAS AVENUE
WITHIN THE CORPORATE LIMITS OF THE CITY OF
CLEARWATER; SAID PROPERTIES TO BE ACQUIRED
FOR STREET RIGHTS OF WAY, AS WELL AS ALL
OTHER INCIDENTAL MUNICIPAL PURPOSES NECESSARY
OR PERTAINING s' THERETO; DIRECTING THE PROPER
OFFICIALS TO FORTHWITH INSTITUTE SUCH PROCEED-
INGS; AUTHORIZING EXECUTION OF NECESSARY
DOCUMENTS, CHECKS FOR PAYMENT OF MONEY,
BONDS, PLEADINGS, OR OTHER PAPERS INCIDENTAL
OR REQUIRED IN ORDER TO COMPLETE THE ACQUISITION
OF SAID PROPERTIES BY CONDEMNATION; AND
PROVIDING T1IAT THIS ORDINANCE SHALL TAKE EFFECT
IMMEDIATELY UPON ITS PASSAGE.

WHEREAS, the City of Clearwater has determined that the extension
of Myrtle Avenue along Marshall Street to Douglas Avenue within the
corporate limits of the City of Clearwater is necessary in order to
expedite and facilitate movement of traffic; and

WHEREAS, the Commission has been unable to acquire the
necessary rights of way for the extension of said street; and
WHEREAS, the City's only means of completing said project is
by acquisition of property in fee simple for said necessary rights of
way, by means of condemnation proceedings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
hereby instructed and directed to obtain all necessary surveys and execute
all necessary instruments, documents, checks for payment of money,
bonds, pleadings and other papers which are incidental and necessary to the
institution of condemnation proceedings to acquire the properties in fee
simple as are set forth by parcels in the attached "Schedule of Information
for Suit" which is incorporated herein by reference and made a part hereof
as though set out;
