WHEREAS, on August 9, 1965, the City Conu-nission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning ordinance and zoning map of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to
the zoning ordinance and the zoning asap were approved by the City Commis-
lion after its evaluation of all evidence presented at the public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 3. Subsections (6) and (7) of Section 26-5E, USE REGULATIONS—
SHOPPING CENTER DISTRICT, of Code of Ordinances, City of Clearwater,
Florida, 1962, are amended to read as follows:
Sec. 26-5E. Use Regulations--Shopping center district.
(6) Point of purchase signs and identification signs to be
permitted flush with the building. However, for each
street frontage one additional identification sign for each
place of business may be hanging if less than 6 square feet
and under marquee or arcade. No sign shall be activated.
(7) One prime identification sign is permitted for each street
frontage. The prime identification sign(s) of shopping
center shall be set back a minimum of at least 15 feet from
the street right-of-way line. No portion of the display
surface of such sign(s) shall be less than nine (9) feet
above the ground. Such structure may not include more
than three (3) double faced supplemental signs attached
thereto. Surface area of center identification signs shall
be limited in accordance with the following:

Section 4. Section 26-11 (6), LOCATION, HEIGHT AND AREA
REGULATIONS--SETBACKS, LOT SIZE, HEIGHT, AREA, of Code of
Ordinances, City of Clearwater, Florida, 1962, is amended to read as
follows:
Sec. 26-11. Location, height and area regulations--Setbacks,
lot size, height, area.
(6) Fences and walls, other than necessary retaining walls,
erected or maintained along or inside of lot lines in, "R-111, "R-211, IIR-4",
and IIR--M" use districts, shall not exceed or be maintained at a height in
excess of six (6) feet from the ground level of subject property or of property
immediately adjacent thereto, whichever has the higher level, except as
herein otherwise provided:
(a) This fence and wall height restriction shall also govern
for residential used properties (single family, duplex
and multi-family structures, including motels) in. a "BII
or I'M" zone when they abut another residential used
property.
(b) Fences and walls, other than necessary retaining walls,
may exceed six (6) feet in height, but shall not exceed ten
(10) feet in height, when erected or maintained along the
lot line between a residential zoned district property and
any zoned district property other than residential.
This section shall not be construed to allow the construction or maintenance
of fences or walls along or across easements and shall not be construed to
allow the fences and walls when they would be in violation of other provisions
of this chapter.

Section ,6. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the same shall
not affect the validity of the ordinance as a whole, or any part thereof
other.than the part declared to be invalid.
Section 7. Any, person or persons, firm or corporation or
association of persons, who shall violate or fail to comply with any of the

terms or provisions of this ordinance shall, upon conviction in the Municipal
Court, be fined not exceeding the sum of Two Hundred Dollars ($200. 00),
or imprisonment in the City Jail for not exceeding sixty (60) days, or -by both
such fine and imprisonment in the discretion of the Municipal Judge. Each
day that a violation is permitted to exist shall constitute a separate offense.
Section 8. The provisions of this Ordinance shall take effect
immediately upon its passage.
