AN ORDINANCE AMENDING CHAPTER 26, AS AMENDED,
PERTAINING TO 7ONING, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER. FLORIDA, 1962, AND AMEND-
ING THE 70NING MAP OF THE CITY OF CLEARWATER,
FLORIDA OF 1962, BY RECLASSIFYING AND 70NING
CERTAIN PROPERTIES AS DESCRIBED HEREIN; BY
ESTABLISHING AND ADDING REQUIREMENTS REGULAT-
ING PRIME IDENTIFICATION SIGNS, POINT OF PURCHASE
SIGNS AND IDENTIFICATION SIGNS IN PROFESSIONAL
AND RELATED SERVICES DISTRICTS; BY ESTABLISHING
REGULATIONS FOR THE PRIME IDENTIFICATION SIGNS
OF SHOPPING CENTERS; BY ESTABLISHING ADDITIONAL
MINIMUM BUILDING SETBACKS FOR NEW STRUCTURES
ALONG PORTIONS OF MYRTLE, GREENWOOD AND
MISSOURI AVENUES; BY ADDING AND PROVIDING
CERTAIN EXCEPTIONS CONCERNING OFF-STREET PARKING
SPACE REQUIREMEN'T'S FOR BUILDINGS OF MIXED USES;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING PENALTIES FOR
THE VIOLATION OF THIS ORDINANCE AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, Senate Bull No, 526, Laws of Florida, Regular Session,
1963, became a law on May 10, 1963, and it amended Section 79, pertaining
to planning and zoning, of the Charter of the City of Clearwater; and
WHEREAS, Chapter 176 of the Florida Statutes, 1961, pertains
to Municipal zoning; and

WHEREAS, on August 5, 1963, the City Commission of the City of
Clearwater, Florida, enacted Ordinance No. 980 which established the
procedure for amending, supplementing or changing the zoning ordinance
and zoning reap of the City of Clearwater; and
WHEREAS, on September 30, 1963, the City Commission of the
City of Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the zoning ordinance and zoning map of the
City of Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to
the zoning ordinance and the zoning map were approved by the City Commission
after its evaluation of all evidence presented at the public hearing;

Section 2. Section 26-5D, Use Regulations--Professional and Related

is amended by repealing the last paragraph of said section pertaining to signs
and enacting in place thereof tho following:
"Signs: A prime identification sign(s) may be permitted for each
building or group of buildings. Maximum total surface shall not
exceed one square foot single face for each foot of lot frontage with
' a maximum surface single face of 100 square feet per sign. Sign
shall not be activated. No portion of the display surface: of such
sign(s) shall be less than nine (9) feet above the'ground.
Point of purchase signs and identification signs for individual
businesses shall not be illuminated nor activated, shall not be
greater than 20 square feet and shall only be erected on or
attached to the building. 11
Section 3. Section 26-5E, Use Regulations--Shopping Center
District, of Code of Ordinances, City of Clearwater, Florida, 1962, is
amended by adding a new Sub-paragraph (7) under minimum requirements
to be met by applicant, as follows:
11(7) The prime identification sign (s) of Shopping Center
shall be set back a minimum of at least 15 feet from the
street right of way line. No portion of the display surface
of such sign(s) shall be less than nine (9) feet above the ground.
Such structure may not include more than three (3) double
faced supplemental signs attached thereto. Surface area of
center identification signs shall be limited in accordance with
the following:

(b) For buildings of mixed uses, the parking facilities
required shall be the sum of the requirements for the various
uses, computed separately in accordance with this ordinance.
Parking facilities for one use shall not be considered as
providing the parking facilities for another use, except in the
case of motc;l, hotel or similar transient accommodations
when supporting other uses under the same management or
ownership. Such conference and/or assembly rooms, restaurant, ?
bar or commercial recreation facilities when combined shall a
have a requirement of 10076 of the, principal use (by units or ,
guest rooms) plus 407o of each of the accessory use require-
ments in summation, "
Section 6. All ordinances or parts of ordinances in conflict here- L?
with are to the extent of such conflict hereby repealed,
Section 7. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other
than the part declared to be invalid.
Section B. Any person or persons, firm or corporation or M.v` association of persons, who shall violate or fail to comply with any of the {
terms or provisions of this ordinance shall, upon conviction in the Municipal
Court, be fined not exceeding the sum of Two Hundred ($200. 00) Dollars,
or imprisonment in the City Jail for not exceeding sixty (60) days, or by
both such fine and imprisonment in the discretion of the Municipal Judge.
Each day that a violation is permitted to exist shall constitute a separate
offense,
