It is the intent of this Ordinance that the organization established will

organization will also serve to combat natural disaster as herein defined.

The Office of Civil Defense created by this Ordinance will be the coordinating
agency for all activity in connection with the Civil Defense program; and during
a period of attack or natural disaster it will be the instrument through which the

This Ordinance will not relieve any City department or agency of the
normal responsibilities or authority ascribed to them in the City Charter, nor
will it adversely affect the work of the American Red Cross or other volunteer
agencies dedicated to diaster-relief activities.
Section 2. DEFINITIONS:
For the purpose of this Ordinance, certain words or terms used herein
are hereby defined:
"Citylt shall mean the City of Clearwater, a municipal corporation.

Clearwater or its environs by the forces of a hostile nation or the agents thereof, {

"Natural Disaster" shall mean any condition seriously affecting or
threatening public health, welfare or security as a result of severe fire, explosion,
flood, tornado, hurricane, earthquake or similar natural or accidental cause
and which is beyond the control of public or private agencies ordinarily
responsible for the control or relief of such conditions.

"Civil Defense Forces" shall mean the employees, equipment and faci-
lities of all City departments, divisions, boards, institutions and commissions
suitable for, or adaptable to, Civil Defense and designated by the Director of
Civil Defense to participate in the Civil Defense program; and, in addition, it
'shall include all volunteer personnel, equipment, supplies and facilities con-
?e'; tributed by, or obtained from, volunteer persons or agencies.

unable to perform his duties under this Ordinance by reason of his absence or

"Civil Defense Council" shall mean the City Commission sitting in

Civil Defense Advisory Council" shall mean a committee of private
citizens representing the several facets of the population complex, appointed by

.x'tst'='? "Director" shall mean the Director of the Office of Civil Defense
appointed by Civil Defense Council or the Executive Director duly appointed
and acting for the Director in accordance with the provisions of this

"Volunteer" shall mean contributing a service, equipment, supplies
or facilities to the Civil Defense organization without remuneration or' without
a formal agreement or contract of hire.
"Civil Defense Volunteer" shall mean any person duly registered and
appointed by the Director of the Office of Civil Defense and assigned to partici-
pate in civil defense activity.
"Person" = shall mean every natural person, firm, co-partnership,
association' or corporation and their legal successor.
Section 3. CIVIL DEFENSE COUNCIL - POWER AND DUTIES:
It shall be the duty of the Clearwater Civil Defense Council, and it is
hereby empowered to review and recommend for adoption, Civil Defense and
Mutual Aid Plans and Agreements and such resolutions and rules and regulations
as are necessary to implement such plans and agreements. The Civil Defense
Council shall meet upon call of the Mayor, any 2 members of the Civil
Defense Council or the Civil Defense Director.
Section 4. DIRECTOR OF CIVIL DEFENSE:
The Civil Defense Council shall appoint the City Manager to be Director
of Civil Defense (without additional salary). The City Manager shall appoint an
Executive Director, who shall perform all duties relative to Civil Defense, as
Executive Head of the Department of Civil Defense.
The Director is hereby empowered and directed:
A. To prepare a Civil Defense Operating Plan for the City conforming
to the County and State Civil Defense Plan and Program.
B. To control and direct the effort of the Civil Defense Organization
of this City for the accomplishment of the purposes of this Ordinance.
C. To direct coordination and cooperation between Departments,
Services and Staff of the Civil Defense Organization of this City, and to resolve
que's tions of authority and responsibility that may arise between them,

D. To represent the Civil Defense Organization of this City in all
dealings with public or private agencies pertaining to Civil Defense and Disaster.
Section 5. EMERGENCY POWERS AND DUTIES OF THE
DIRECTOR OF CIVIL DEFENSE:
The Director of Civil Defense may exercise the emergency power and
authority as specified herein. Whenever a situation requires or is likely to re-
quire that the Director of Civil Defense invoke such polver and authority, he shall
forthwith convene the City Commission to perform its legislative and administrative
powers as the situation demands, and shall immediately report to that body relative
to Civil Defense activities. Nothing in this Ordinance shall be construed as power
or authority to abridge or reduce the legislative and administrative powers of the
City Commission unless such is specifically granted herein.
1. Under the following circumstances the Director of Civil
Defense mayassemble and utilize the Civil Defense forces and
he may prescribe the manner and conditions of their use:
a. Whenever, on the basis of information received from
authoritative sources, he feels that attack on the City is
probable or imminent.
b. During any period of attack on the City and thereafter
as long as he shall deem it necessary.
2. During any period when attack on the City is probable or
imminent, or when the City has been subjected to attack, the
Director of Civil Defense may promulgate such reasonable regu-
lations as he deems necessary to protect life and property and
preserve critical resources. Such regulations may include but
shall not be limited to the following:
a. Regulations prohibiting or restricting the movement
of vehicles in order to facilitate the mass movement of
persons from critical areas of the City.
b. Regulations pertaining to the movement of persons
from areas deemed to be hazardous or vulnerable to
attack.
The Director of Civil Defense shall report these regulations to the City
Commission; and said City Commission shall by resolution adopt, amend or
revoke such regulations.
3. The Director of Civil Defense shall order Civil Defense forces to
the aid of other communities when required in accordance with the statutes of the
State; and he may request the State or political subdivisions of the State to send
aid to the City of Clearwater in case of natural disaster or in case of disaster
resulting from enemy attack when conditions in the City are beyond the capabili-
ties of the local civil defense forces.
4. When obtaining formal approvals would result in delay of disaster-
relief activity, the Director of Civil Defense may, until City Commission con-
venes, waive procedures and formalities otherwise required pertaining to the
performance of public works, entering into contracts, the incurring of obli-
gations, the employment of temporary workers, the rental of equipment, the
purchase and distribution of supplies, materials and facilities, and the ex-

c. Regulations designed to lessen the hazard to people
and property from attack. Such regulations may include
black-outs, dim-outs and other measures to reduce the
vulnerability of the City.

penditure of existing funds, The City Commission is also empowered to waive
any such procedures and formalities,
5. Whenever the Director of Civil Defense finds that any condition in the
City has attained, or threatened to attain, the proportions of natural disaster,
he may assemble and utilize Civil Defense forces and he may prescribe the
manner and conditions of their use, He may, when he deems it in the public
interest, send Civil Defense forces of tlfe City to the aid of other communities
stricken by natural disaster when such disaster is affecting the national defense
effort or is seriously affecting the health, welfare or security of the stricken
community; provided that after the City Commission convenes, the further con-
tinuance of any such natural disaster relief and the period thereof shall be subject
to the action of the City Commission,
The Director of Civil Defense may promulgate regulations to assemble and
utilize the Civil Defense forces and request disaster-relief as prescribed in
Sub-sections 1, 2 and 3 of this Section; and he may make regulations authorizing
the conduct of practice air raid alerts or tests of the Civil Defense organization.
Such regulations shall be filed with the City Commission and shall be binding upon
the Civil Defense forces when they have been approved by resolution of the City
Commission.
Section b. POWERS AND DUTIES OF THE
DIRECTOR OF CIVIL DEFENSE
The Director of Civil Defense shall be responsible to the Civil Defense
Council for the supervision over the planning and administration of the Civil
Defense program of the City. He shall maintain liaison with State and Federal
authorities and the authorities of Pinellas County, and other political sub-
divisions to insure the most effective implernertatlon of the Civil Defense plans.
His duties shall include the following-
1. Development of plans for the co-ordinated utilization
of all the resources and facilities of the City for Civil
Defense.
2. Go-ordinating the recruitment of volunteer personnel
and agencies to augment the personnel and facilities of the
City for Civil Defense purposes.
3. Through public education programs, preparing the
civilian population for the protection of their person and
property in case of enemy attack or natural disaster.
4. Conducting practice alerts and exercises to insure
the efficient operation of the Civil Defense organization
and to familiarize the citizens with Civil Defense regula-
tions and procedures. The Director shall notify the Civil
Defense Council in writing prior to any such alerts or
exercises and embody therein the regulations and procedures
pertaining thereto. Normal staff exercises and instructions
of volunteers are excluded from the provisions of this
paragraph.
5. Co-ordinating the activities of all public and private
agencies comprising the Civil Defense organization, in-
cluding the co-ordination of planning and purchasing of
Civil Defense equipment and supplies for the City.

Section 7. COOPERATION WITH THE DIRECTOR AND

boards, institutions and other agencies of the City government designated by the

mulation and development of the Civil Defense plan, and they shall comply with the;;;"
directives of the Director when such directives are issued pursuant to the provi-
sions of this Ordinance.
Section 8, APPOINTMENT OF VOLUNTEERS:
The Director may at any time appoint, or authorize the appointment of
volunteer citizens to augment the personnel of any City department or agency for ?a
emergency operations. Such volunteer citizens shall be enrolled as Civil Defense
volunteers in cooperation with the heads of City Departments or agencies concerned
and they shall be subject to the rules and regulations set forth by the Director T'
for such volunteers.
The Director may also appoint volunteer citizens to form the personnel
of the Civil Defense services for which the City has no counterparts, or to tem-
porarily augment the personnel of the City in Civil Defense operations.
Section 9. UNAUTHORIZED DISPLAY OF INSIGNIA:
1. It shall be a violation of this Ordinance for any person
to display anj identifying Civil Defense insignia for any
purposes other than that for which it was intended, or under
circumstances not authorized by the Director.
2. It shall be a violation of this Ordinance for any person
to wear or display in any manner any insignia, sign or
device purported to be a Civil Defense insignia, except when
such insignia has been duly issued by the office of Civil
Defense and said insignia is displayed in accordance with
regulations established by the Director.
Section 10. FALSE ALARMS AND TAMPERING WITH AIR RAID
WARNING DEVICES:
1. It shall be unlawful to give, or cause to be given a false
alarm of enemy attack, and each such act shall be punishable
to the full limits of the authority of the Municipal Court of
the City of Clearwater. It is provided, however, that when
the prosecution of such unlawful acts is undertaken by Federal
or State authorities under the provisions of pertinent Federal
and State laws such Federal and State laws shall take precedence
over the provisions of this subsection.

Z, It shall be unlawful to tamper with, or to damage or
destroy or to render inoperative by any means whatsoever
any air raid warning systems, equipment, instruments or
devices installed and maintained by the City of Clearwater,
and each such unlawful act shall be punished to the full
limits of the Municipal Court of the City of Clearwater. It
is provided, however, that when prosecution of such un-
lawful acts is undertaken by Federal and State authorities
under the provisions of pertinent Federal and State laws,
such Federal and State laws shall take precedence over

The City assumes no liability for injury or death of Civil Defense " rr ?'': `-•
volunteers in performance of their duties as such volunteers except that which
is imposed by State law or by ordinance or resolution of the City Commission
of the City of Clearwater. This does not, however, preclude the receipt of any
benefits or compensation under the provisions from the State Workmen's Compen-
sation administration. s
Section 12, RIGHTS OF CITY EMPLOYEES:
City employees assigned to duty as a part of the Civil Defense forces
pursuant to the provisions of this Ordinance shall retain all of the rights,
privileges and immunities of City employees, and shall receive the compensation
incident to their regular employment.
Section 13. VIOLATION OF REGULATIONS:
It shall be unlawful for any person to violate any of the regulations
issued pursuant to the authority contained in this Ordinance, or to wilfully
obstruct, hinder or delay any member of the Civil Defense organization: in
the enforcement of such regulations.
Section 14. NO CONFLICT WITH STATE OR FEDERAL STATUTES:
This Ordinance shall not be construed to conflict with any State or
Federal statutes or with any military or naval order, rule or regulation.
Section 15, REPEALS OTHER ORDINANCES:
Any and all ordinances pertaining to Civil Defense formerly enacted
by the City Commission are hereby repealed.
Section 16 SEVERABILITY:
Should any provision of this Ordinance be declared invalid for any
reason, such declaration shall not affect the validity of the Ordinance as a
whole, it being the legislative intent that this Ordinance shall remain valid
notwithstanding such declaration.
