BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. WHEREAS, a general sanitary sewer collection and
disposal system is vitally necessary to the health and welfare of the
citizens of Clearwater, Florida; and
WHEREAS, such a system is presently in use in the City of
Clearwater and is presently being greatly expanded, most of said system
being financed by revenue certificates issued against the revenues of the
water and sewer systems.

Section 2. Chapter 26 of the Code of the City of Clearwater, Florida,
1950, is hereby amended by adding the following provisions.
Except as herein specifically provided, all buildings designed. or
used for human habitation or occupancy shall be connected to the sanitary
sewer system of the City of Clearwater, Florida, and no permit for the
erection of any such building shall be issued unless provision is made for
such sanitary sewer connection, unless the Building or Plumbing Inspector
shall find that a sanitary sewer main is not reasonably available and that such
a main will not be available by the time that the building is ready for use.
Such Inspector may find that such main is not reasonably available if the
property does not abut on a sewer main or that the distance of said building
from the main exceeds two hundred (200 ft.) feet or that a connection to said
main is not feasible in the opinion of the City Engineer. For the purposes

Section 4. All buildings designed or used for human habitation or t

occupancy that are hereafter erected in the City of Clearwater, Florida,
in locations where sanitary sewer mains are not available for connection
at the time such buildings are completed or occupied, may be connected
temporarily to septic tanks or such other method of sewage disposal as
may be approved by the applicable health authorities; however, such
buildings shall be connected to the sanitary sewer system of the City of
Clearwater within one year (1) after the completion of such building or
within one (1) year after the system becomes available for connection,
whichever time shall be the longer.
Section 5. Septic Tanks - (a) Where the City of Clearwater has n
failed to provide adequate sanitary sewer facilities in any given piece or

parcel of land within the City limits, upon which there is located or to be

located a dwelling house or building in which sanitary facilities are needed
or required, the owner thereof or a licensed master plumber may upon
written application to the City Building Inspector obtain a permit to build
a septic tank, providing that construction thereof is to be in conformity

with all existing requirements of the City of Clearwater and State laws,
rules and regulations. No permit hereunder shall be issued more than
two (2) weeks prior to the date construction of the building shall begin.
(b) Where septic tanks have already been installed upon real
' property within tho City limits prior to the installation of adequate
sanitary sewer facilities by the City of Clearwater, the owner or occupant
of said property may, subject to the limitations of Sections 1, 2, 3 and
4 above, continue to use such septic tank or tanksuntil such time as a

Section 6, All connections to the sanitary sewers of the City of (i "1

Code of the City of Clearwater and to the appurtenant City, State and ;.j
County rules, regulations and laws. All such connections must be in- r ,
spected and approved by the City Plumbing Inspector and all fees and
charges therefor due the City must be paid as a condition precedent to ° .
approval. This section however shall not be construed to prohibit a h
private owner fxom performing his own work as provided in the Plumbing
Code of the City of Clearwater.
Section 7. Permits - (a) When Required. No person shall, after
the effective date of this Ordinance, construct, replace, clean or repair any
septic tank in the City of Clearwater without first having obtained a written
permit therefor from the City Building Inspector.
(b) When Used. The City Building Inspector shall upon receipt
of a signed application for permit to construct, replace or repair a septic =?" 1
tank issue such permit as a matter of course when: (1) it appears that
